(oral)\n\n\n\nORDER:\n<\/pre>\n<p id=\"p_1\">            By filing this writ petition, petitioner has laid challenge to the<\/p>\n<p>election of respondents No. 5 to 8 as Members of Custom and Central<\/p>\n<p>Excise Gazetted Officers Association, Chandigarh Zone, Chandigarh. It is<\/p>\n<p>contention of counsel for the petitioner that voting right was extended to<\/p>\n<p>those employees of the Custom and Central Excise Department, who were<\/p>\n<p>not eligible to cast vote.     Counsel further states that before election,<\/p>\n<p>Constitution was amended without taking permission from the competent<\/p>\n<p>authority. Be that as it may, during arguments, it transpires that a defeated<\/p>\n<p>candidate had already sent representations (P-12 and P-13), raising similar<\/p>\n<p>objections to the higher authorities. The petitioner may, if so advised, file a<\/p>\n<p>representation detailing his objections before the competent authority, as<\/p>\n<p>mentioned in this writ petition. If he does so within fifteen days from today,<\/p>\n<p>the competent authority shall decide representation of the petitioner, along<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> CIVIL WRIT PETITION NO. 12194 OF 2009                         -2-<\/span><\/p>\n<p>with representations P-12 and P-13 , filed by a defeated candidate, by<\/p>\n<p>passing a speaking order. Before passing any order, opportunity of hearing<\/p>\n<p>be granted to the affected parties. Needful be done within a period of three<\/p>\n<p>months from today.
