SANKARAN, J.\n                   ---------------------------\n                    B.A. No. 4673 of 2009\n               ------------------------------------\n            Dated this the 26 th day of August, 2009\n\n                           O R D E R\n<\/pre>\n<p id=\"p_1\">      This is an application for bail under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of the<\/p>\n<p>Code of Criminal Procedure. Petitioner is accused No.1 in Crime<\/p>\n<p>No.447\/2009 of Koratty Police Station.<\/p>\n<p id=\"p_1\">      2. The offences alleged against the accused is under<\/p>\n<p><a href=\"\/doc\/1439698\/\" id=\"a_1\">Sections 302<\/a>, <a href=\"\/doc\/1439698\/\" id=\"a_2\">201<\/a> and <a href=\"\/doc\/1439698\/\" id=\"a_3\">120<\/a> B read with <a href=\"\/doc\/37788\/\" id=\"a_4\">Section 34<\/a> of the Indian<\/p>\n<p>Penal Code.\n<\/p>\n<p id=\"p_2\">      3. The first accused is the son of accused Nos. 2 and 3.<\/p>\n<p>Accused Nos. 2 and 3 had another son by name Jomon. It is<\/p>\n<p>stated that he was a drunkard and he used to create unpleasant<\/p>\n<p>scenes in the house.     On 05.07.2009, there was a quarrel<\/p>\n<p>between the first accused and Jomon during night. In the early<\/p>\n<p>hours on 6.07.2009, it is alleged, the first accused hit the victim<\/p>\n<p>with an iron rod and he died. The allegation against accused<\/p>\n<p>Nos. 2 and 3 is that they disposed of the          dead body in<\/p>\n<p>Chalakudy river and thus committed the offence under <a href=\"\/doc\/1439698\/\" id=\"a_5\">Section<\/p>\n<p>201<\/a> and     for commission of that offence they hatched a<\/p>\n<p>conspiracy. The petitioner was arrested on 18.07.2009 and        he<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">B.A. No. 4673 of 2009               2<\/span><\/p>\n<p>was remanded to judicial custody.\n<\/p>\n<p id=\"p_3\">         4. As per the order dated 29.07.2009 in B.A. No. 4219 of<\/p>\n<p>2009, bail was granted to accused Nos. 2 and 3.<\/p>\n<p id=\"p_4\">         5. Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioner, the nature of the offence and the present stage of<\/p>\n<p>investigation, I am of the view that bail can be granted to the<\/p>\n<p>petitioner.\n<\/p>\n<p id=\"p_5\">         5. The petitioner shall be released on bail on his executing<\/p>\n<p>a bond for Rs. 25,000\/- each with two solvent sureties each for<\/p>\n<p>the like amount to the satisfaction of the Judicial Magistrate of<\/p>\n<p>the First Class,Chalakudy subject to the following conditions:-<\/p>\n<blockquote id=\"blockquote_1\"><p>                A) The petitioner shall appear before the<br \/>\n                     Investigating Officer between 9. A.M.<br \/>\n                     and 11 A.M. on all Sundays, till the final<br \/>\n                     report is filed or until further orders.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>               B)    The petitioner shall      appear before the<br \/>\n                     Investigating Officer for interrogation as<br \/>\n                     and when required.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>               C)    The petitioner shall not enter the limits of<br \/>\n                     Koratty Police Station for a period of two<br \/>\n                     months,     except   for    complying   with<br \/>\n                     conditions (A) and (B).\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>               D) The petitioner shall not try to influence the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">B.A. No. 4673 of 2009              3<\/span><\/p>\n<p>                     prosecution witnesses or tamper with the<br \/>\n                     evidence.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>               E) The petitioner shall not commit any offence<br \/>\n                     or indulge in any prejudicial activity while<br \/>\n                     on bail.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>               F)    In case of breach of any of the conditions<br \/>\n                     mentioned above, the bail shall be liable<br \/>\n                     to be cancelled.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>         The Bail Application is allowed as above.<\/p><\/blockquote>\n<p id=\"p_6\">\n<p id=\"p_7\">                                     K.T.
