RAMKUMAR, J.\n\n                        - - - - - - - - - - - - - - - - -\n\n                         Crl.M.C.NO.734\/2007\n\n                         - - - - - - - - - - - - - - - -\n\n            Dated this the 16th Day of March, 2007\n\n\n                                 O R D E R\n<\/pre>\n<p id=\"p_1\">             In this petition filed under <a href=\"\/doc\/1679850\/\" id=\"a_1\">section 482<\/a> Cr.P.C., the<\/p>\n<p>petitioner who is the second accused in Crime No.196\/1999 of<\/p>\n<p>Thampanoor   Police   station   for   an   offence   punishable   under<\/p>\n<p><a href=\"\/doc\/1101188\/\" id=\"a_1\">Section   379<\/a>   IPC   in   respect   of   a   vehicle,   seeks   to   quash   the<\/p>\n<p>final report.\n<\/p>\n<p id=\"p_1\">      2.     The   petitioner   has   a   contention   that   even   though<\/p>\n<p>the   FIR   was   registered   on   13.1.1999,   final   report   was   filed<\/p>\n<p>only   on   21.1.2004,   i.e.,     long   after   the   limitation   prescribed<\/p>\n<p>under   <a href=\"\/doc\/1599077\/\" id=\"a_2\">Section   468<\/a>   Cr.P.C   for   the   offence     punishable   under<\/p>\n<p><a href=\"\/doc\/1101188\/\" id=\"a_3\">Section 379<\/a> IPC   and the Magistrate has taken cognisance of<\/p>\n<p>the   offence   without   even   condoning   the   delay   and   without<\/p>\n<p>hearing   the   petitioner   who   had   a   right   to   be   heard.     Yet<\/p>\n<p>another contention raised is that the petitioner  was a juvenile<\/p>\n<p>on the date of commission of the offence.\n<\/p>\n<p id=\"p_2\">      3.     The   case   is   now   pending   before   the   J.F.C.M-III,<\/p>\n<p>Thiruvananthapuram in C.C.No.141\/2004.  Consequent on the<\/p>\n<p>non   appearance   of   the   petitioner   before   that   Court,   non<\/p>\n<p>bailable warrants  of arrest are pending against the petitioner.\n<\/p>\n<p id=\"p_3\">Since   the   contentions raised   above   are worthy of   serious<\/p>\n<p>consideration, I  am   inclined to  give    the   petitioner   an<\/p>\n<p>opportunity   to   raise   both   the   contentions   before   the<\/p>\n<p>Magistrate.     This   Crl.M.C.   is   Accordingly   disposed   of   as<\/p>\n<p>follows:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>         If   the   petitioner   surrenders   before   the<\/p>\n<p>         J.F.C.M-III,   Thiruvananthapuram   and<\/p>\n<p>         files   an   application   for   regular   bail   the<\/p>\n<p>         same   shall   be   considered   and   disposed<\/p>\n<p>         of preferably on the same date on which<\/p>\n<p>         it   is   filed,   after   examining   the<\/p>\n<p>         aforementioned   contentions   raised   by<\/p>\n<p>         the   petitioner.     It   shall   be   open   to   the<\/p>\n<p>         petitioner   to   produce   evidence   in<\/p>\n<p>         support   of   his   age   to   buttress     his<\/p>\n<p>         contention   that   he   was   juvenile   on   the<\/p>\n<p>         date of commission of offence.<\/p><\/blockquote>\n<p id=\"p_4\">        4.
