Mudgil, Advocate <\/p>\n<p>  \u00a0<\/p>\n<p> 18.07.2008 <\/p>\n<p>  \u00a0<\/p>\n<p> O<br \/>\nR D E R <\/p>\n<p> \u00a0<\/p>\n<p> Prima<br \/>\nfacie, it appears that the State Commission forgets that, in addition to the<br \/>\nappellate and revisional jurisdiction under <a href=\"\/doc\/1327546\/\" id=\"a_1\">Section<br \/>\n24-B<\/a> of the Consumer Protection Act, National Consumer Disputes Redressal Commission (hereinafter referred to as the National<br \/>\nCommission for brief) is having supervisory jurisdiction over consumer fora in<br \/>\nthe country. This should be remembered<br \/>\nby the State Commission before commenting that the orders passed by the<br \/>\nNational Commission are not binding to the Delhi State Commission. Hence, unless there is a contrary judgement by the   Apex Court,<br \/>\nthe State Commission is bound to follow the decision rendered by the National<br \/>\nCommission. Further, if there are<br \/>\nconflicting decisions rendered by the National Commission, the State Commission<br \/>\nmay decide the matter appropriately accepting one or the other judgement.\n<\/p>\n<p> \u00a0<\/p>\n<p id=\"p_5\"> Further,<br \/>\nthe State Commission must remember that constitution of Bench before the<br \/>\nNational Commission is absolutely within the jurisdiction of the President of<br \/>\nthe National Commission and the Benches are to be constituted on the basis of<br \/>\npower conferred under <a href=\"\/doc\/1014113\/\" id=\"a_1\">Section 20<\/a> of the Act.<br \/>\nThe State Commission has no business to interfere and criticize whether<br \/>\nthe constitution of Bench is justified or not.\n<\/p>\n<p> \u00a0<\/p>\n<p id=\"p_6\"> In view of<br \/>\nthe above, Notice to the parties returnable on  28th August 2008.\n<\/p>\n<p> \u00a0<\/p>\n<p id=\"p_7\">Meantime, observations made by<br \/>\nthe State Commission in the impugned order are stayed because it may lead to<br \/>\nindiscipline and insubordination with other consumer fora.\n<\/p>\n<p> \u00a0<\/p>\n<p id=\"p_8\">Registry is directed to call for<br \/>\nthe record of this matter from the State Commission.\n<\/p>\n<p> \u00a0<\/p>\n<p id=\"p_9\">.J.\n<\/p>\n<p id=\"p_10\">( M.B.
