He<br \/>\nhas challenged the order dated 28.04.2010 passed by learned<br \/>\nAdditional Sessions Judge, Surendranagar in Criminal Revision<br \/>\nApplication No.66 of 2009.\n<\/p>\n<p id=\"p_3\">\tRespondents<br \/>\nhad filed application under <a href=\"\/doc\/1056396\/\" id=\"a_1\">Section 125<\/a> of the Code of Criminal<br \/>\nProcedure, 1973 being Criminal Misc. Application No.55 of 2008 before<br \/>\nthe concerned magistrate seeking maintenance from the petitioner.<br \/>\nLearned Chief Judicial Magistrate, Surendranagar vide order dated<br \/>\n29.06.2009 granted Rs.2,000\/- and Rs.1,000\/- p.m. in favour of<br \/>\nrespondent Nos.1 and 2 respectively. Petitioner did not challenge the<br \/>\nsaid order. Respondents, however, desired enhancement. They,<br \/>\ntherefore, filed revision application being Criminal Revision<br \/>\nApplication No.66 of 2009 before the Sessions Court. Learned<br \/>\nAdditional Sessions Judge passed the impugned order dated 28.04.2010<br \/>\nawarding Rs.5,000\/- and Rs.2,000\/- p.m. in favour of respondent Nos.1<br \/>\nand 2 respectively. Hence, the petition.\n<\/p>\n<p id=\"p_4\">\tFrom<br \/>\nthe perusal of the documents and the orders on record, it appears<br \/>\nthat the learned Additional Sessions Judge has enhanced the monthly<br \/>\nmaintenance in favour of the respondents without assigning any<br \/>\nreasons. Ordinarily, therefore, I would have remanded the proceedings<br \/>\nbefore the Sessions Court. However,<br \/>\nin the present case, unfortunately, the petitioner, after recording<br \/>\nof evidence of the wife, had not led any evidence of his side. In the<br \/>\ninterest of justice, therefore, proceedings be remanded to the<br \/>\nconcerned learned magistrate for fresh hearing and disposal,<br \/>\npermitting both the sides to lead evidence, if they so desire. In the<br \/>\nmeantime, the petitioner must continue to pay maintenance as fixed by<br \/>\nthe Sessions Court.\n<\/p>\n<p id=\"p_5\">\tIn<br \/>\nthe result the petition is disposed of with the following directions:\n<\/p>\n<p id=\"p_6\">\tboth<br \/>\n\tthe order dated 29.06.2009 passed by learned Chief Judicial<br \/>\n\tMagistrate, Surendranagar in Criminal Misc. Application No.55 of<br \/>\n\t2008 and order dated 28.04.2010 passed by learned Additional<br \/>\n\tSessions Judge, Surendranagar in Criminal Revision Application No.66<br \/>\n\tof 2009 are set aside;\n<\/p>\n<p id=\"p_7\">\tproceedings<br \/>\n\tare remanded for fresh hearing and disposal and after giving<br \/>\n\topportunity of leading evidence to both sides;\n<\/p>\n<p id=\"p_8\">\tsuch<br \/>\n\tremanded proceedings be disposed of expeditiously, preferably by<br \/>\n\t30.04.2011;\n<\/p>\n<p id=\"p_9\">\tboth<br \/>\n\tsides shall co-operate with early disposal of hearing;\n<\/p>\n<p id=\"p_10\">\ttill<br \/>\n\tlearned magistrate passes a fresh order, the petitioner shall<br \/>\n\tcontinue to pay maintenance, as fixed by the Sessions Court.<br \/>\n\tNeedless to state that learned magistrate shall dispose of the said<br \/>\n\tproceedings without being influence by this order or by the order of<br \/>\n\tSessions Court;\n<\/p>\n<p id=\"p_11\">\tThe<br \/>\n\tpetitioner shall also pay costs of Rs.5,000\/- to the respondents<br \/>\n\twithin a period of four weeks from today.\n<\/p>\n<p id=\"p_12\">\tRule<br \/>\nis made absolute accordingly.\n<\/p>\n<p id=\"p_13\">Sd\/-\n<\/p>\n<p id=\"p_14\">[AKIL<br \/>\nKURESHI, J]<\/p>\n<p>Bhavesh*<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Rameshbhai vs Vaishaliben on 17 January, 2011 Author: Akil Kureshi,&amp;Nbsp;
