BASANT, J.\n           ````````````````````````````````````````````````````\n                W.P.(C) No. 6197 OF 2008 K\n           ````````````````````````````````````````````````````\n          Dated this the 22nd day of February, 2008\n\n                         J U D G M E N T\n<\/pre>\n<p id=\"p_1\">           The petitioner is the de facto complainant in crime<\/p>\n<p>No.45\/08 of Pambady police station, Kottayam.                     The<\/p>\n<p>grievance of the petitioner is that no proper investigation is<\/p>\n<p>being conducted into that crime. The delay is likely to prove<\/p>\n<p>fatal to the petitioner&#8217;s cause. In these circumstances, it is<\/p>\n<p>prayed that the jurisdiction under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> may be invoked<\/p>\n<p>and appropriate directions for expeditious investigation to the<\/p>\n<p>police may be issued.\n<\/p>\n<p id=\"p_1\">      2.   The learned counsel for the petitioner was<\/p>\n<p>requested to explain how in the light of the decision in Sakri<\/p>\n<p>Vasu Vs. State of U.P. [ 2008 AIR SCW 309] the petitioner<\/p>\n<p>can approach this Court for issue of direction under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article<\/p>\n<p>226<\/a> of the Constitution. He has not approached the learned<\/p>\n<p>Magistrate for issue of any directions.                 No satisfactory<\/p>\n<p>explanation is offered. I am satisfied that the petitioner must<\/p>\n<p>approach the learned Magistrate and seek appropriate<\/p>\n<p>WPC.6197\/08<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               : 2 :<\/span><\/p>\n<p>direction under <a href=\"\/doc\/99487\/\" id=\"a_2\">section 156(3)<\/a> Cr.P.C. The Supreme Court<\/p>\n<p>has specifically and definitely wanted that the High Courts<\/p>\n<p>should not encourage persons rushing to this Court with<\/p>\n<p>petitions under <a href=\"\/doc\/1679850\/\" id=\"a_3\">section 482<\/a> Cr.p.C. and <a href=\"\/doc\/1712542\/\" id=\"a_4\">Article 226<\/a> of the<\/p>\n<p>Constitution without and before exhausting the remedy which<\/p>\n<p>is available to them under <a href=\"\/doc\/99487\/\" id=\"a_5\">section 156(3)<\/a> Cr.P.C.<\/p>\n<p id=\"p_2\">      3.   This writ petition is, in these circumstances,<\/p>\n<p>dismissed with the clarification that the dismissal of this writ<\/p>\n<p>petition will not in any way fetter the rights of the petitioner to<\/p>\n<p>approach the learned Magistrate and seek directions for<\/p>\n<p>expeditious and proper investigation.
