No. 43\/90\/66 Appt. 4 dated 18.7.1972  had\tbeen\nrevoked\t by the Government letter dated\t 1.3.1979--Construc-\ntion  and  scope  of the letter\t dated\t1.3.1979  explained-\nConstitution of India, 1950, <a href=\"\/doc\/1673816\/\" id=\"a_1\">Article 38.<\/a>\n\n\n\nHEADNOTE:\n    As\tfar  back as 1972, the Uttar Pradesh  Government  by\nG.O.  No.  43\/90\/66-Apptt. 4 dated July 18,  1972  announced\n\"for the physically handicapped persons, the reservation  in\nall  the services under the Government shall be 2%\". AH\t the\nGovernment  Departments were directed to follow\t the  policy\nfor reservation in services accordingly. Later, by G.O.\t No.\n7\/4\/1971-Personnel-2  dated May 20, 1978 the  Government  of\nUttar  Pradesh while affirming the \"reservation of 2%  posts\nfor the' appointment of disabled persons in all the services\nunder the Government\", defined who a physically\t handicapped\nperson\twas.  Pursuant to a letter from the  Public  Service\nCommission there was  a proposal not to reserve any post for\ndisabled  persons  in  the Provincial  Civil  Service.\tThis\nproposal,  however,  did not result in the issuance  of\t any\nG.O.  by the Government. But the Public\t Service  Commission\nwas  informed  by  the\tGovernment  by\ttheir  letter  dated\n1.3.1979 that none of the categories of disabled persure was\nsuitable  for appointment to the U.P. Civil Service  (Execu-\ntive  Branch) and no reservation for disabled persons  might\nbe made in the Provincial Civil (Executive Branch)  Service.\nIn  1981  the Chief Secretary, Government of  Uttar  Pradesh\naddressed  all\tthe Secretaries to the Government,  Head  of\nDepartment  and Commissioners in Uttar Pradesh pointing\t out\nthat though a provision for reservation of 2% posts was made\nfor  physically\t handicapped persons by\t G.O.  No.  43\/90\/66\ndated July 18, 1972 in the services under the State  Govern-\nment, appointments had not been made of handicapped  persons\nin accordance with the reservation. The necessity of  making\nappointments  of physically handicapped persons to  the\t re-\nserved\tposts was impressed upon all the Secretaries,  Heads\nof  Departments\t and Commissioners and it  was\tparticularly\nbrought\t to their attention that 1981 had been\tdeclared  as\n\"the International Year for\n575\nthe  physically Handicapped Persons'. It was  also  directed\nthat vacancies should be carried forward and efforts  should\nbe  made  to ensure that the maximum  number  of  physically\nhandicapped persons were appointed.\n    The\t appellant, a disabled person who was successful  at\nthe combined State Services Examination held in 1982 by\t the\nUttar Pradesh Public Service Commission was offered the post\nof  Manager Marketing and Economic Survey instead of a\tpost\nin  the Provincial Civil Service (Executive) Branch  on\t the\nground\tthat the reservation of 2% to the  disabled  persons\nhad  been revoked by the Government letter  dated  1.3.1979.\nThe  Writ Petition filed by the appellant was  dismissed  by\nthe Allahabad High Court. Hence the appeal by special leave.\nAllowing the appeal, the Court.\n    Held:  A perusal of the letter dated 1.3.1979  indicates\nthat  it was confined to \"recruitment on the basis  of\tCom-\nbined State Services Examination, 1978\". It was not intended\nto be an amendment of G.O. No. 43\/90\/66 dated July 18,\t1972\nor G.O. No. 7\/4\/1971 dated May 20, 1978. It was not intended\nto  depart from general rule of reservation of 2%  posts  in\nfavour\tof  disabled persons in the case of  the  Provincial\nCivil Service (Executive Branch). Further in the face of the\ncommunication in 1981 by the Chief Secretary drawing  atten-\ntion  of all departments to the G.O. 1972, it is now  futile\nfor  the Government to contend that the appellant cannot  be\nappointed   to\tthe  Provincial\t Civil\tService\t  (Executive\nBranch).  Having announced very rightly their  determination\nto rehabilitate physically handicapped persons, by reserving\nposts  for them in all the services of the  Government,\t the\nGovernment cannot now create needless hurdles. [577C-H]\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">    CIVIL  APPELLATE JURISDICTION: Civil Appeal No. 4460  of<br \/>\n1986.\n<\/p>\n<p id=\"p_1\">    From  the  Judgment and Order dated\t 16.10.1985  of\t the<br \/>\nAllahabad  High Court in Civil Misc. Writ Petition No.\t5440<br \/>\nof 1983.\n<\/p>\n<p id=\"p_2\">S.N. Kacker and J.M. Khanna for the Appellant:<br \/>\nAnil Dev Singh and Mrs. Shobha Dikshit for the Respondents.<br \/>\nThe Judgment of the Court was delivered by<br \/>\n<span class=\"hidden_text\" id=\"span_1\">576<\/span><br \/>\n    CHINNAPPA REDDY, J: Special leave granted. The appellant<br \/>\nis  a physically handicapped person. He has  an\t orthopaedic<br \/>\nproblem. He suffers from a permanent impediment of the\tleft<br \/>\nleg, the result Of an old compound fracture. His  impediment<br \/>\ndid not prevent him from good academic performance. He\twent<br \/>\nfurther. He appeared at the combined State Services Examina-<br \/>\ntion  held  in February, 1982 by the  Uttar  Pradesh  Public<br \/>\nService Commission. According to the advertisement issued by<br \/>\nCommission, one post in the Provincial Civil Service (Execu-<br \/>\ntive Branch) was reserved for handicapped persons.  However,<br \/>\nthe appellant was offered the post of Manager, Marketing and<br \/>\nEconomic  Survey instead of a post in the  Provincial  Civil<br \/>\nService (Executive Branch). He was not offered a post in the<br \/>\nProvincial  Civil Service (Executive Branch) on\t the  ground<br \/>\nthat the reservation of 2% in the Uttar Pradesh Civil  Serv-<br \/>\nices for physically handicapped persons had been revoked  by<br \/>\nthe  State  Government by their letter dated  1.3.  1979  in<br \/>\nregard\tto the Provincial Civil Service (Executive  Branch).<br \/>\nThereupon the appellant filed a Writ Petition under  <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article<br \/>\n226<\/a>  of\t the Constitution in the Allahabad High\t Court.\t The<br \/>\nWrit Petition was dismissed by the High Court on the  ground<br \/>\nthat there was no reservation of posts for physically handi-<br \/>\ncapped\tpersons in the Provincial Civil\t Service  (Executive<br \/>\nBranch). The appellant has come before us under <a href=\"\/doc\/427855\/\" id=\"a_2\">Article\t 136<\/a><br \/>\nof the Constitution.\n<\/p>\n<p id=\"p_3\">    As\tfar  back as 1972, the Uttar Pradesh  Government  by<br \/>\nG.O.  No.  43\/90\/66-Apptt. 4 dated July 18,  1972  announced<br \/>\n&#8220;for the physically handicapped persons, the reservation  in<br \/>\nall the services under the Government shall be 2%.&#8221; All\t the<br \/>\nGovernment  Departments were directed to follow\t the  policy<br \/>\nfor reservation in services accordingly. Latter, by G.O. No.<br \/>\n7\/4\/1971-Personnel-2  dated May 20, 1978 the  Government  of<br \/>\nUttar  Pradesh while affirming the &#8220;reservation of 2%  posts<br \/>\nfor the appointment of disabled persons in all the  services<br \/>\nunder the Government,&#8221; defined who a physically\t handicapped<br \/>\nperson was and added the following instruction:&#8211;\n<\/p>\n<p id=\"p_4\">    &#8220;That in this context, I have to make it clear that\t the<br \/>\nphysical  disability should not be of the nature  which\t may<br \/>\ncause  interference in discharge of duties  and\t obligations<br \/>\nattached to the concerned service. Accordingly if the  serv-<br \/>\nice  is as such that it require continuous use of eye,\tthen<br \/>\nin  such case reservation cannot be given to the blind\tper-<br \/>\nsons.  In  the\tsame manner if\tsome  services\tspecifically<br \/>\ninvolves  the  hearing faculty then no\treservation  can  be<br \/>\ngiven to the deaf persons in such services and in a  service<br \/>\nwhere the use of a particular organ of the body<br \/>\n<span class=\"hidden_text\" id=\"span_1\">577<\/span><br \/>\nis  to be used then the person disabled of  that  particular<br \/>\norgan  cannot be given reservation in that service.  On\t the<br \/>\nbasis of the principle every department will issue necessary<br \/>\norders regarding reservation for the post under their subor-<br \/>\ndination.&#8221;\n<\/p>\n<p id=\"p_5\">    It\tappears\t that there was some discussion\t within\t the<br \/>\ndepartment  pursuant  to a letter from\tthe  Public  Service<br \/>\nCommission and their was a proposal not to reserve any\tpost<br \/>\nfor  disabled persons in the Provincial Civil Service.\tThis<br \/>\nproposal,  however,  did not result in the issuance  of\t any<br \/>\nG.O.  by the Government. But the Public\t Service  Commission<br \/>\nwas  informed by the Government by their letter\t dated\t1.3.<br \/>\n1979  that  none of the categories of disabled\tpersons\t was<br \/>\nsuitable  for appointment to the U.P. Civil Service  (Execu-<br \/>\ntive  Branch) and no reservation for disabled persons  might<br \/>\nbe made in the Provincial Civil (Executive Branch)  Service.<br \/>\nA  perusal of the letter dated 1.3. 1979 indicates  that  it<br \/>\nwas confined to &#8220;recruitment on the basis of Combined  State<br \/>\nServices  Examination, 1978&#8221;. It was not intended to  be  an<br \/>\namendment  of G.O. No. 43\/90\/66 dated July 18, 1972 or\tG.O.<br \/>\nNo.  7\/4\/1971  dated May 20, 1978. It was  not\tintended  to<br \/>\ndepart\tfrom  general  rule of reservation of  2%  posts  in<br \/>\nfavour\tof  disabled persons in the case of  the  Provincial<br \/>\nCivil  Service (Executive Branch). Again in 1981  the  Chief<br \/>\nSecretary,  Government\tof Uttar Pradesh addressed  all\t the<br \/>\nSecretaries  to\t the Government, Heads\tof  Departments\t and<br \/>\nCommissioners  in Uttar Pradesh pointing out that  though  a<br \/>\nprovision for reservation of 2% posts was made for physical-<br \/>\nly handicapped persons by G.O. No. 43\/90\/ 66 dated July\t 18,<br \/>\n1972  in the services under the State  Government,  appoint-<br \/>\nments had not been made of handicapped persons in accordance<br \/>\nwith  the reservation. The necessity of making\tappointments<br \/>\nof physically handicapped persons to the reserved posts\t was<br \/>\nimpressed upon all the Secretaries, Heads of Departments and<br \/>\nCommissioners.\tand  it was particularly  brought  to  their<br \/>\nattention that 1981 had been declared as &#8216;the  International<br \/>\nYear  for the Physically Handicapped Persons&#8217;. It  was\talso<br \/>\ndirected  that vacancies should be carried forward  and\t ef-<br \/>\nforts  should be made to ensure that the maximum  number  of<br \/>\nphysically  handicapped persons were appointed. In the\tface<br \/>\nof  this  communication from the Chief Secretary,  we  think<br \/>\nthat it is now futile for the Government to contend that the<br \/>\nappellant cannot be appointed to the Provincial Civil  Serv-<br \/>\nice  (Executive Branch). Having announced  their  determina-<br \/>\ntion,  very  rightly  too in our  opinion,  to\trehabilitate<br \/>\nphysically handicapped persons, by reserving posts for\tthem<br \/>\nin all the services of the Government, the Government cannot<br \/>\nnow create needless hurdles. The State Civil Service (Execu-<br \/>\ntive  Branch)  is a large enough service  which\t can  easily<br \/>\naccommodate physically handicapped<br \/>\n<span class=\"hidden_text\" id=\"span_2\">578<\/span><br \/>\npersons\t in suitable posts. A direction will, therefore,  be<br \/>\nissued\tto  the Government of Uttar Pradesh to\tappoint\t the<br \/>\nappellant  to  the Uttar Pradesh  Civil\t Service  (Executive<br \/>\nBranch)\t with effect from the date on which he\tshould\thave<br \/>\nbeen  appointed in the ordinary course. He will be  entitled<br \/>\nto  all the other service benefits. He is also\tentitled  to<br \/>\ncosts.
