AND P.O.- BEGUSARAI, DISTT.- BEGUSARAI\n                              -----------\n<\/pre>\n<p>03.   30.11.2010            Heard learned counsel for the petitioners.<\/p>\n<p>                              It is not considered necessary to issue notice<\/p>\n<p>                   at this stage to the respondent in view of the nature of<\/p>\n<p>                   the order to be passed.\n<\/p>\n<p>                              The petitioners are aggrieved by the order<\/p>\n<p>                   dated 5.11.2009 by which their request to direct for<\/p>\n<p>                   closure of the filing of the objections to the Pleader<\/p>\n<p>                   Commissioner report by the respondents had been<\/p>\n<p>                   rejected. Alternatively, the respondent be directed to<\/p>\n<p>                   file their objections.\n<\/p>\n<p>                              It is submitted that the petitioners are the<\/p>\n<p>                   plaintiffs in the suit for declaration of title and<\/p>\n<p>                   possession. A Pleader Commissioner report has been<\/p>\n<p>                   submitted which according to the petitioners is in their<\/p>\n<p>                   favour. The respondent did not file any objection.<\/p>\n<p>                   During his cross-examination the respondent has<\/p>\n<p>                   stated that he shall file an objection, if deemed<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>       appropriate at the appropriate time. The submission<\/p>\n<p>       therefore is that the respondent is only trying to delay<\/p>\n<p>       the proceedings and seeks to take advantage to file<\/p>\n<p>       objections after his cross-examination is over to fill up<\/p>\n<p>       any lacunae.\n<\/p>\n<p>                  A   Pleader    Commissioner     report   is   not<\/p>\n<p>       sacrosanct by itself with regard to its contents.<\/p>\n<p>       Objections may or may not be filed against it. Non-<\/p>\n<p>       filing of objections does not ipso facto lend full<\/p>\n<p>       credibility to the report. The filing of objections likewise<\/p>\n<p>       does not ipso fact negate the report. The evidentiary<\/p>\n<p>       value of the Pleader Commissioner report and the<\/p>\n<p>       acceptance thereof ultimately remains in the discretion<\/p>\n<p>       of the Court concerned to be exercised in accordance<\/p>\n<p>       with law. If the respondents do not wish to file<\/p>\n<p>       objections, the petitioner cannot compel them to do so.<\/p>\n<p>       If the apprehension of the petitioners with regard to<\/p>\n<p>       the any future conduct of the respondent turns out to<\/p>\n<p>       be correct at a subsequent stage, the petitioner shall<\/p>\n<p>       avail his appropriate remedies under the Code of Civil<\/p>\n<p>       Procedure.\n<\/p>\n<p>                  The application stands disposed with the<\/p>\n<p>       aforesaid observations.\n<\/p>\n<pre>P.K.
