JUSTICE ALOK SINGH\n\nPresent: - Mr. Vikas Mohan Gupta, Advocate, for the petitioner.\n\n\n             1.Whether Reporters of local papers may be allowed to see the judgment?\n             2.Whether to be referred to the Reporters or not?\n             3.Whether the judgment should be reported in the Digest?\n\n                                   *****\n<\/pre>\n<p id=\"p_1\">ALOK SINGH, J (ORAL)<\/p>\n<p>             Notice of motion.\n<\/p>\n<p id=\"p_1\">             On being asked, Mr. Jaswinder Singh, learned Deputy<\/p>\n<p>Advocate General, Punjab, has accepted notice on behalf of respondents<\/p>\n<p>No.1 to 3.\n<\/p>\n<p id=\"p_2\">             Learned counsel for the petitioner states that he may be<\/p>\n<p>permitted to withdraw this petition, however, time to vacate the property<\/p>\n<p>in question may be granted till 31.3.2012. He further states that in view<\/p>\n<p>of the Division Bench judgment of this Court in the case of Munshi<\/p>\n<p>Ram Vs. State of Punjab and others, CWP No.17704 of 1997 decided<\/p>\n<p>on 4.10.2008, petitioner shall move representation to provide alternate<\/p>\n<p>site.\n<\/p>\n<p id=\"p_3\">             Mr. Jaswinder Singh, learned Deputy Advocate General,<\/p>\n<p>Punjab, has fairly stated that if petitioner furnishes undertaking in the<br \/>\n CWP No.18315 of 2011<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                                                      -2-<\/span><\/p>\n<p>shape of affidavit before the Collector that he shall hand over actual<\/p>\n<p>physical possession to the respondents on or before 31.3.2012, time may<\/p>\n<p>be granted to him till 31.3.2012.\n<\/p>\n<p id=\"p_4\">          Having considered arguments advanced by learned counsel for<\/p>\n<p>the parties, present petition is allowed to be withdrawn.        However,<\/p>\n<p>eviction order shall not be executed against the petitioner till 31.3.2012<\/p>\n<p>provided petitioner furnishes an undertaking in the shape of affidavit<\/p>\n<p>within two weeks from today before the Collector, Patiala, to the effect<\/p>\n<p>that he shall hand over actual physical vacant possession to the<\/p>\n<p>respondents on or before 31.3.2012 and meanwhile he shall pay mesne<\/p>\n<p>profit from the date of eviction order till possession is handed over to<\/p>\n<p>the respondents @ `2,000\/- per month.         Petitioner shall pay entire<\/p>\n<p>arrears within one month and shall keep on paying future mesne profit<\/p>\n<p>by 10th day of every month in advance. In case, representation is moved,<\/p>\n<p>same shall be considered sympathetically in view of the Division Bench<\/p>\n<p>judgment of this Court in the case of Munshi Ram (supra).
