M. SAHAI)<\/p>\n<p id=\"p_1\">1.\tHeard<br \/>\nMr.Sunit Shah, learned counsel assisted by Mr.N.V.Gandhi for the<br \/>\nappellants.\n<\/p>\n<p id=\"p_2\">2.\tLearned<br \/>\ncounsel for the appellant has challenged the judgment and order of<br \/>\nthe learned Single Judge dated 6.5.2010 by which the learned Single<br \/>\nJudge has illegally rejected the claim made by the appellants for<br \/>\nsanction\/approval and grant of all the benefits of revised pay scale<br \/>\nof 5th Pay Commission to all employees of the Gujarat Small<br \/>\nIndustries Corporation (&#8216;Corporation&#8217; for short) with effect from<br \/>\n1.1.1996 and the employees were also entitled for arrears along with<br \/>\ninterest at the rate of 18% per annum.\n<\/p>\n<p id=\"p_3\">3.\tLearned<br \/>\ncounsel submitted that the appellants are working with the aforesaid<br \/>\nCorporation and were treated as employees of the State Government.<br \/>\nThey were earlier granted the benefits of 3rd and 4th Pay Commission<br \/>\nwhich were approved by the State Government, but the 5th Pay<br \/>\nCommission benefits have not been granted to the appellants or the<br \/>\nemployees of the Corporation.  Learned counsel vehemently argued that<br \/>\nas the learned Single Judge has not dealt with other aspects of the<br \/>\nmatter, namely, (i) three installments of interim reliefs were<br \/>\ndisbursed pending final outcome of 5th Pay Commission; (ii) surplus<br \/>\nstaff cell was opened and employees of respondent No.2 Corporation<br \/>\nwere eligible to be included in the said surplus staff cell so as to<br \/>\nget alternate job in Government or Government Boards\/Corporations<br \/>\nwhich was denied; (iii) the appellants were left with no option but<br \/>\nto accept the VRS under the economic duress\/pressure or helplessness,<br \/>\nand (iv) the employees of other public sector who were offered VRS<br \/>\nwere given arrears of 5th Pay Commission whereas appellants were<br \/>\ndenied the said benefit.\n<\/p>\n<p id=\"p_4\">4.\tThese<br \/>\narguments cannot be considered at this stage, as it is admitted by<br \/>\nthe appellants that the Corporation &#8211; Respondent No.2 is now in<br \/>\nliquidation. Therefore, the relief as asked by the learned counsel<br \/>\nfor the appellants cannot be granted at this stage. The controversy<br \/>\ninvolved in this matter is covered by the decision of the Apex Court<br \/>\nin <a href=\"\/doc\/1844057\/\" id=\"a_1\">Officers and Supervisors of I.D.P.L. vs. Chairman and M.D.,<br \/>\nI.D.P.L. and others<\/a>, AIR 2003 SC 2870.  In this view of the matter,<br \/>\nwe do not find any illegality in the impugned order of the learned<br \/>\nSingle Judge.
