DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 06\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">This<br \/>\n\tapplication is filed under <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section 438<\/a> of the Code of Criminal<br \/>\n\tProcedure in connection with first information report registered at<br \/>\n\tCR No.I 782\/2010 with Satellite Police Station for the offences<br \/>\n\tpunishable under <a href=\"\/doc\/482448\/\" id=\"a_1\">Sections 376<\/a>, <a href=\"\/doc\/1289794\/\" id=\"a_2\">452<\/a>, <a href=\"\/doc\/19163\/\" id=\"a_3\">232<\/a>, <a href=\"\/doc\/445276\/\" id=\"a_4\">506(3)<\/a>, <a href=\"\/doc\/1086076\/\" id=\"a_5\">294(b)<\/a> etc. of<a href=\"\/doc\/1569253\/\" id=\"a_6\"> the<br \/>\n\tIndian Penal Code<\/a>.\n<\/p>\n<p id=\"p_1\">Learned<br \/>\n\tcounsel for the applicant submits that the victim herself clearly<br \/>\n\tadmits love affairs with the applicant since last one and half<br \/>\n\tyears.  Learned counsel further submits that considering the nature<br \/>\n\tof allegations, version of the complainant  herself, love affairs<br \/>\n\tbetween the victim and the applicant, the applicant deserves to be<br \/>\n\tgranted anticipatory bail.\n<\/p>\n<p id=\"p_2\">Heard<br \/>\n\tLearned APP for the respondent &#8211; State.\n<\/p>\n<p id=\"p_3\">Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and considering the nature of allegations and role attributed<br \/>\n\tto the applicant, without discussing the evidence, at this stage, I<br \/>\n\tam inclined to grant anticipatory bail to the applicant.\n<\/p>\n<p id=\"p_4\">Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p id=\"p_5\">In<br \/>\n\tthe result, this application is allowed by directing that in the<br \/>\n\tevent of the applicant herein being arrested pursuant to FIR being<br \/>\n\tCR No.I 782\/2010 registered with Satellite Police Station,  the<br \/>\n\tapplicant shall be released on bail on furnishing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand only) with one surety of like<br \/>\n\tamount on following conditions :-\n<\/p>\n<p id=\"p_6\">shall<br \/>\n\tcooperate with the investigation and make available for whenever<br \/>\n\trequired;\n<\/p>\n<p id=\"p_7\">shall<br \/>\n\tremain present at the concerned Police Station on 10.12.2010 at<br \/>\n\t11.00 a.m.;\n<\/p>\n<p id=\"p_8\">shall<br \/>\n\tnot hamper the investigation in any manner nor shall directly or<br \/>\n\tindirectly make any inducement, threat or promise to any witness so<br \/>\n\tas to dissuade them for disclosing such facts to the Court or to any<br \/>\n\tPolice Officer;\n<\/p>\n<p id=\"p_9\">at<br \/>\n\tthe time of execution of bond, furnish the address to  the<br \/>\n\tInvestigating Officer and the court concerned and shall not change<br \/>\n\tthe residence till the final disposal of the case of till further<br \/>\n\torders;\n<\/p>\n<p id=\"p_10\">will<br \/>\n\t not  leave India without the permission of the Court and, if is<br \/>\n\tholding a passport, shall surrender the same before the trial Court<br \/>\n\twithin a week;\n<\/p>\n<p id=\"p_11\">it<br \/>\n\twould be open to the Investigating Officer to file an application<br \/>\n\tfor remand, if he considers it just and proper and the concerned<br \/>\n\tMagistrate would decide it on merits;\n<\/p>\n<p id=\"p_12\">this<br \/>\n\torder will be operative if the applicant is arrested at any time<br \/>\n\twithin a period of 90 days;\n<\/p>\n<p id=\"p_13\">within<br \/>\n\ta period of ten days from the date of arrest, the applicant shall<br \/>\n\tapply for regular bail which application shall be decided by the<br \/>\n\tcompetent Court in accordance with law without being influenced by<br \/>\n\tthe fact that anticipatory bail was granted.\n<\/p>\n<p id=\"p_14\">With<br \/>\n\tthese directions, this Criminal Misc.
