As per the Circular No. 1824 dated<br \/>\n25.04.1953, necessary order for allotting the land to the members of<br \/>\nthe Co-operative Society of Harijans [hereinafter referred to as &#8220;the<br \/>\nSociety] was passed with the consent of the village people. However,<br \/>\nas there was breach of the conditions of the grant allotted to the<br \/>\nSociety, the Deputy Collector initiated proceedings  being Case No.<br \/>\n3\/95-96 against the said Society. Pursuant thereto, the Deputy<br \/>\nCollector on 31.07.2002 issued show cause notice to the present<br \/>\noccupants and the members of the Society. The Deputy Collector vide<br \/>\norder dated 22.09.2008 ordered to forfeit the land with a direction<br \/>\nto the Mamlatdar to take possession of the land on behalf of the<br \/>\nGovernment. Being aggrieved by the said order, the petitioner and<br \/>\nother persons who were in possession of the lands of the Society<br \/>\npreferred Appeals No. 78\/2008 to 83\/2008, 90\/2008 to 98\/2008 before<br \/>\nthe District Collector, Porbandar.  The District Collector, vide<br \/>\norder dated 31.07.2009 rejected the appeals and confirmed the order<br \/>\ndated 22.09.2008 passed by the Deputy Collector.\n<\/p>\n<p id=\"p_2\">2.1.\t\tAgainst<br \/>\nthe said order, the petitioner preferred Revision Application<br \/>\nNo.49\/2009 before the Secretary (Appeals), Revenue Department. Along<br \/>\nwith the said revision application, the petitioner had also preferred<br \/>\nstay application.  The Secretary (Appeals)-respondent no. 1 herein<br \/>\nafter considering the material produced before it, vide order dated<br \/>\nrejected the said stay application preferred by the petitioner.<br \/>\nHence, this petition.\n<\/p>\n<p id=\"p_3\">3.\t\tMr.\n<\/p>\n<p id=\"p_4\">Hathi, was not in a position to show anything from record that the<br \/>\npetitioner was in legal possession of the land in question.  Thus,<br \/>\nthe findings  recorded by the authority is tentative, but prima<br \/>\nfacie it seems to be correct.  At this stage, Mr. Dave, learned<br \/>\nAGP appearing for the respondents had made an endeavor by placing<br \/>\nreliance upon the observations made by the Deputy Collector and<br \/>\nDistrict Collector  in the order dated 22.09.2008 and 31.07.2009<br \/>\nrespectively. Looking to the facts of the case,  it will not proper<br \/>\nto revert the averments made against the petitioner by the<br \/>\nauthorities below. However, I am of the opinion that ends of justice<br \/>\nwould be met by passing the following order.\n<\/p>\n<p id=\"p_5\">4.\t\tPending<br \/>\nthe revision application, the land in question which is held by the<br \/>\npetitioner shall not be allotted to any other person by the authority<br \/>\nconcerned. In the meantime, the petitioner shall prefer an<br \/>\napplication to the concerned authority for expeditious hearing of the<br \/>\nrevision application.
