According to the<br \/>\nlearned advocate, no reasons have been assigned for enhancement in<br \/>\nthe market value of the property than what is referred to in the sale<br \/>\ndeed. It has also been contended by the learned advocate that no<br \/>\nopportunity of hearing was afforded to the petitioner before passing<br \/>\nthe impugned order.  It has also been contended that the relevant<br \/>\nguidelines have also not been followed by the respondent authority<br \/>\nand therefore, the decision taken by the authority for arriving at a<br \/>\nhigher market value is absolutely arbitrary in nature.  It is finally<br \/>\ncontended that the respondent authority has fixed the valuation of<br \/>\nthe property ignoring the Bombay Stamp (Determination of Market Value<br \/>\nof Property) Rules, 1984 as also the guidelines provided by the<br \/>\nBombay Stamp Act, 1958 and, therefore, the respondent authority can<br \/>\nfix the valuation of the property using different yardsticks which<br \/>\nwould tantamount to discrimination. It is submitted by learned<br \/>\nadvocate that in a casual manner the respondent authority has fixed<br \/>\nthe market value of the property in question at a higher price and<br \/>\ntherefore, deficit stamp duty of Rs.26,710\/- with fine of Rs.250\/-<br \/>\nwas required to be paid to the authorities  and accordingly notice<br \/>\nwas sent to the petitioner. It is submitted by him that the<br \/>\nrespondent authority has not considered the fact that the petitioner<br \/>\nhas purchased the property in question by paying the market value<br \/>\nprevalent, but the authority has not considered the same as per the<br \/>\nJantri decided by the State.  Therefore it is prayed that the<br \/>\ndecisions of the respondent authorities are required to be quashed<br \/>\nand set aside.\n<\/p>\n<p id=\"p_5\">5.\tIn<br \/>\nsupport of his submission, learned advocate has placed reliance on<br \/>\nthe following decisions:\n<\/p>\n<p id=\"p_6\">(i)\t[(2006)12<br \/>\nGHJ 533 ?  (<a href=\"\/doc\/55984\/\" id=\"a_1\">Vinaybhai P.Patel v. State \tof Gujarat<\/a>)];\n<\/p>\n<p id=\"p_7\">(ii)\t[(2006)12<br \/>\nGHJ 646 ?  (Manubhai Vaghjibhai Dabhi <\/p>\n<p>\tv.\n<\/p>\n<p id=\"p_8\">State of Gujarat and anr.)]; and<\/p>\n<p id=\"p_9\">(iii)[(2006)12<br \/>\nGHJ 538 ?  (A.P.M.C., Patan v. State of \tGujarat and anr.]; and<\/p>\n<p id=\"p_10\">(iv)<br \/>\n2006(2) GLR 1735 ?  (New Kalindi Co.op.<a href=\"\/doc\/800011\/\" id=\"a_1\">Housing Society Ltd. v. State<br \/>\nof Gujarat and ors<\/a>.).\n<\/p>\n<p id=\"p_11\">6.\tAs<br \/>\ncan be seen from the aforesaid decisions, this Court has time and<br \/>\nagain rendered decisions for quashing and setting aside the<br \/>\nprinted\/cyclostyled type orders and non speaking orders by holding<br \/>\nthat it is the duty vested in the respondent authorities to justify<br \/>\nits say for higher market value for the land in question. In the<br \/>\ninstant case, it is clear that the impugned order cannot be sustained<br \/>\nin the eye of law. Reference in this connection may also be had to<br \/>\nthe decision rendered in the case of Bal Nalkantha Khedoor Mandal<br \/>\nv. State of Gujarat, decided on 26th July 1999 in<br \/>\nSpecial Civil Application No.1731 of 199 (Coram: Hon&#8217;ble<br \/>\nK.G.Balakrishnan, CJ &amp; Hon&#8217;ble Mr.Justice S.D.Dave).\n<\/p>\n<p id=\"p_12\">7.\tHaving<br \/>\nconsidered the aforesaid authorities and for the reasons as discussed<br \/>\nabove, in my considered opinion, the impugned orders are passed in<br \/>\nbreach of the provisions of the Act, 1958 and the Rules, 1984 as they<br \/>\nare thoroughly non speaking orders and no reasons have been assigned.\n<\/p>\n<p id=\"p_13\">8.\tIn<br \/>\nthat view of the matter, the petition is allowed. The impugned order<br \/>\ndated 31.12.2001 passed by the Dy.Collector, Stamp Duty Valuation<br \/>\nDepartment, Himatnagar, Rajkot, and the order dated 11.12.2007 passed<br \/>\nby the Chief Controller, Stamp Duty Valuation Department,<br \/>\nGandhinagar, respondent Nos.1 and 2 herein respectively are hereby<br \/>\nquashed and set aside. The matter is remanded to the respondent No.2<br \/>\nfor taking a fresh decision and for passing a speaking order as per<br \/>\nthe Act, 1958 read with the Rules, 1984 and after giving an<br \/>\nopportunity of hearing to the petitioner.
