JUSTICE SANDEEP MEHTA,VJ.\n<\/p>\n<p id=\"p_3\">Mr.Mahipal Bishnoi for the appellants.<br \/>\nMr. R.K.Bohra, P.P.\n<\/p>\n<p id=\"p_4\">\n            Heard learned counsel for the appellants and<br \/>\nlearned Public Prosecutor on application for suspension of<br \/>\nsentence.\n<\/p>\n<p id=\"p_5\">            Upon a consideration of the arguments advanced<br \/>\non behalf of the appellants and having regard to the facts and<br \/>\ncircumstances of the case, this Court is of the opinion that it is<br \/>\na fit case for suspending the sentences awarded to the<br \/>\naccused appellants.\n<\/p>\n<p id=\"p_6\">            Accordingly, the application for suspension of<br \/>\nsentence filed under <a href=\"\/doc\/985477\/\" id=\"a_1\">Section 389<\/a> Cr.P.C. is allowed and it is<br \/>\nordered that the sentences passed by the learned Special<br \/>\nJudge, SC &amp; ST (Prevention of Atrocities) Cases, Jodhpur vide<br \/>\njudgment dated 22.05.2015 in Sessions Case No.07\/2010<br \/>\nagainst the appellants-applicants No.1 Hitendra Singh alias<br \/>\nHitesh Singh son of Hem Singh Rajput and No.2 Mahendra<br \/>\nSingh son of Loon Singh, shall remain suspended till final<br \/>\ndisposal of the aforesaid appeal and they shall be released on<br \/>\nbail, provided each of them executes a personal bond in the<br \/>\nsum of Rs.40,000\/- with two sureties of Rs.20,000\/- each to<br \/>\nthe satisfaction of the learned trial Judge for their appearance<br \/>\nin this court on 27.07.2015 and whenever ordered to do so till<br \/>\nthe disposal of the appeal on the conditions indicated below:-\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                       -2-<\/span><\/p>\n<blockquote id=\"blockquote_1\"><p>                1. That they will appear before the trial Court<br \/>\n                in the month of January of every year till the<br \/>\n                appeal is decided.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>                2. That if the applicants change the place of<br \/>\n                residence, they will give in writing their<br \/>\n                changed address to the trial Court as well as to<br \/>\n                the counsel in the High Court.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>                3. Similarly, if the sureties change their<br \/>\n                address(s), they will give in writing their<br \/>\n                changed address to the trial Court.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>           The learned trial Court shall keep the record of<br \/>\n     attendance of the accused-applicant(s) in a separate file. Such<br \/>\n     file be registered as Criminal Misc. Case related to original<br \/>\n     case in which the accused-applicant(s) was\/were tried and<br \/>\n     convicted. A copy of this order shall also be placed in that file<br \/>\n     for ready reference. Criminal Misc. file shall not be taken into<br \/>\n     account for statistical purpose relating to pendency and<br \/>\n     disposal of cases in the trial court.
