MUKHOPADHAYA)<\/p>\n<p>\t\tLearned<br \/>\nAssistant Government Pleader appearing on behalf of the State<br \/>\nsubmitted that during pendency of the case, having noticed illegal<br \/>\nallotment in favour of some of the persons, those four allotments<br \/>\nhave been cancelled. Special Civil Application No. 5706 of 2009 has<br \/>\nbecome infructuous.\n<\/p>\n<p>2.\t\tLearned<br \/>\ncounsel for the petitioner while accepted  that Special Civil<br \/>\nApplication no.5706 of 2008 has become infructuous;  contends that<br \/>\nthe respondents should take penal action against Municipal<br \/>\ncouncillors who illegally allotted  lands in favour of some persons.<br \/>\nSuch prayer was opposed by learned  counsel appearing on behalf of<br \/>\nsome of the councillors in Special Civil Application No. 4880 of<br \/>\n2009.  According to them, the allotment was made on behalf of the<br \/>\nMunicipality and not by Councillors in their  individual capacity. It<br \/>\nis also alleged that the petitioner being  a politician i.e. Ex-MLA<br \/>\nwith a motive to harass the respondents impleaded only some of the<br \/>\ncouncillors of the Municipality  and those councillors who are close<br \/>\nto the petitioner and were parties to the decision have not been<br \/>\nimpleaded.\n<\/p>\n<p>3.\t\tWe<br \/>\nhave heard learned counsel appearing on behalf of the parties and<br \/>\nnoticed their rival contentions. We have also perused the record.\n<\/p>\n<p>4.\t\tIt<br \/>\nis not in dispute that  Municipality second time   allotted land in<br \/>\nfavour of some of  individuals who were already allotted such land,<br \/>\nand such allotment has now been cancelled. In that background,<br \/>\nsubstantial relief having been granted, one of the cases has become<br \/>\ninfructuous. So far as question  whether action requires to be taken<br \/>\nagainst one or other individual Councillor is concerned, such<br \/>\ndetermination is not required to be given  in a petition under<br \/>\nArticle 226 of the Constitution, particularly when all the<br \/>\ncouncillors of the Municipality have not been impleaded as<br \/>\nparty-respondents. Further, taking into account  the political<br \/>\nbackground of the petitioner in Special Civil Application No. 4880 of<br \/>\n2009, we are not inclined to make any observation about illegal<br \/>\nallotment.\n<\/p>\n<p>5.\t\tBoth<br \/>\nthe petitions thereby stand disposed of.
