          Petitioner is the second accused<\/p>\n
in C.C.167\/2006 on the file of Judicial<\/p>\n
First    Class           Magistrate’s                   Court-III,<\/p>\n
Kottayam, taken cognizance for the offences<\/p>\n
under Sections 109, 465 and 420 read with<\/p>\n
Section 34<\/a> of Indian Penal Code. Petition is<\/p>\n
filed under Section 482<\/a> of Code of Criminal<\/p>\n
Procedure to quash the                 proceedings against<\/p>\n
the  petitioner         contending                that    on   the<\/p>\n
materials, the offences are not attracted.<\/p>\n
Subsequent to the filing of Crl.M.C first<\/p>\n
accused was tried by                Judicial First Class<\/p>\n
Magistrate,    Kottayam              and         by     Annexure-C<\/p>\n
judgment dated 30\/4\/2010 first accused was<\/p>\n
acquitted.\n<\/p>\n

            2.  Learned  counsel appearing for the<\/p>\n
petitioner and      learned  counsel appearing for<\/p>\n
the       second respondent, de facto complainant<\/p>\n
were heard.\n<\/p>\n
            3.    Learned    counsel  relying   on<\/p>\n
Annexure-C judgment argued that case against<\/p>\n
the petitioner is that he abetted first accused<\/p>\n
and first accused forged concession cards and<\/p>\n
thereby committed the offences under Sections<\/p>\n
109<\/a>, 465<\/a> and 420<\/a> read with Section 34<\/a> of Indian<\/p>\n
Penal Code and after trial, first accused      who<\/p>\n
allegedly       forged the document was acquitted<\/p>\n
and therefore, prosecution against petitioner<\/p>\n
for abetting first accused committed offence<\/p>\n
will not stand      and therefore, the proceedings<\/p>\n
is to be quashed. Reliance was placed on the<\/p>\n
decision of the Full Bench of this Court in<\/p>\n
Moosa v. Sub Inspector of Police<\/a> (2006 (1) KLT<\/p>\n

552) and argued that finding that judgment of<\/p>\n
acquittal of co-accused      cannot be looked into<\/p>\n
is not applicable when      from substratum  of the<\/p>\n
case is found against in Annexure-C judgment.<\/p>\n
Learned       counsel pointed out that  Crl.M.C is<\/p>\n
not     filed    based  on   the  failure  of   the<\/p>\n
substratum      of  the  case,  consequent  to  the<\/p>\n
acquittal      of  the  first accused  but  on  the<\/p>\n
ground that materials relied on by the      learned<\/p>\n
Magistrate to take cognizance, is insufficient<\/p>\n
to proceed against the petitioner.<\/p>\n
            4. On   hearing the  learned    counsel<\/p>\n
appearing       for  the   petitioner  and   second<\/p>\n
respondent, I do not find it for this Court      to<\/p>\n
quash       the  proceedings  as   sought  for   on<\/p>\n
analyising the materials produced and finding<\/p>\n
that     there   is  no  material  to  connect the<\/p>\n
petitioner with the offences or based on the<\/p>\n

subsequent     decision  taken  by   the  learned<\/p>\n
Magistrate after trial of the first accused.<\/p>\n
Petitioner     is  entitled  to  raise   all  the<\/p>\n
contentions before the     learned Magistrate and<\/p>\n
seek an order of discharge under Section 239<\/a> of<\/p>\n
Code of Criminal Procedure, as it is submitted<\/p>\n
that charge against the petitioner has not been<\/p>\n
framed.     Learned  counsel  appearing  for  the<\/p>\n
petitioner then submitted that presence of the<\/p>\n
petitioner may not be insisted for the purpose<\/p>\n
of    claiming  an  order  of discharge  and  the<\/p>\n
learned Magistrate may be directed to consider<\/p>\n
effect of the acquittal of the co-accused and<\/p>\n
factum      of substratum  of  the   case,  while<\/p>\n
considering the question whether petitioner is<\/p>\n
to be discharged or not. If an application is<\/p>\n
filed under Section 205<\/a> of Code of Criminal<\/p>\n
Procedure to dispense with the presence of the<\/p>\n

\n                           5<\/span><\/p>\n
petitioner      for   the  purpose  of     claiming<\/p>\n
discharge under Section 239<\/a> of Code of Criminal<\/p>\n
Procedure, learned Magistrate not to insist for<\/p>\n
the presence of the petitioner for that limited<\/p>\n
purpose. Petitioner is entitled to raise all<\/p>\n
the     contentions    raised  herein   before  the<\/p>\n
learned Magistrate.\n<\/p>\n
