                IN THE HIGH COURT OF JUDICATURE AT PATNA\n                                Cr. Misc. No.5889 of 2011\n                Md. Rustam, Son of Md. Islam, R\/o-Vill.-Satyarganj, P.S.-Islampur,\n                District-Nalanda.                                            -Petitioner.\n                                        VERSUS\n                The State of Bihar                                      -Opposite Party.\n                                        -----------\n<\/pre>\n
02     25.03.2011                    This is a case of abuse of privilege of bail in connection<\/p>\n
                      with Malsalami P.S. Case No.107 of 1996 instituted under Arms Act<\/a><\/p>\n
                      for illegal possession of arms. Petitioner absconded while the trial was<\/p>\n
                      in progress in the year 2003 and has surrendered into the judicial<\/p>\n
                      custody on 23.12.2010.\n<\/p>\n
                                     In view of the aforesaid, I am not inclined to interfere<\/p>\n
                      in the matter at this stage.     I, therefore, direct the learned Sub-<\/p>\n
                      Divisional Judicial Magistrate, Patna City before whom the case is<\/p>\n
                      pending to take all effective steps to conclude the trial within six<\/p>\n
                      months from today. If petitioner cooperates and trial is not concluded<\/p>\n
                      within six months, the petitioner above-named be released on bail on<\/p>\n
                      furnishing a bail bond of Rs.10,000\/- (Rupees Ten Thousand ) with<\/p>\n
                      two sureties of like amount each to the satisfaction of the         Sub-<\/p>\n
                      Divisional Judicial Magistrate, Patna City in connection with<\/p>\n
                      Malsalami P.S. Case No.107 of 1996, subject to the condition that one<\/p>\n
                      of the bailor would be his father.\n<\/p>\n
                                     Let this order be communicated to the trial Court<\/p>\n
                      immediately.\n<\/p>\n
