(J)\n\nCITATION:\n 1996 AIR 1517\t\t  1996 SCC  (3) 403\n JT 1996 (3)   647\t  1996 SCALE  (3)239\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">\t\t      J U D G M E N T<br \/>\nSEN, J.\n<\/p>\n<p id=\"p_1\">     Special leave granted.\n<\/p>\n<p id=\"p_2\">     This is  an  extra-ordinary  case.\t A  private  dispute<br \/>\nbetween a  landlord and\t a  tenant  was\t taken\tup  in\twrit<br \/>\njurisdiction and  mandatory orders were passed directing the<br \/>\nState  and   the  police   authorities\tto  allow  the\twrit<br \/>\npetitioner (the\t landlord) to have ingress and egress to and<br \/>\nfrom the  disputed premises. On the basis of this order, the<br \/>\nlandlord with  the help\t of police  authorities evicted\t the<br \/>\ntenant from  his flat, In other words, the landlord was able<br \/>\nto get\tback possession\t of tenanted premises without having<br \/>\nto go  through the  usual landlord  and\t tenant\t proceedings<br \/>\nbefore appropriate forum in accordance with law.\n<\/p>\n<p id=\"p_3\">     It appears\t that  after  instituting  proceeding  under<br \/>\n<a href=\"\/doc\/930621\/\" id=\"a_1\">Section 144<\/a>  of the  Criminal Procedure Code in the Court of<br \/>\nthe Executive  Magistrate, the landlord moved the High Court<br \/>\nunder its  constitutional writ\tjurisdiction. Shyamal  Kumar<br \/>\nSen, J.\t on 13th  August, 1993 passed an order directing the<br \/>\nOfficer in  Charge, Muchipara  Police Station,\tto  make  an<br \/>\nenquiry into  the complaint dated 26th July, 1993 and submit<br \/>\na report  on 19th  August, 1993.  This was  an exparte order<br \/>\nwithout any  notice to\tthe tenant. On 30th Augusts 1993 the<br \/>\nwrit petition  was finally  disposed of\t on the basis of the<br \/>\npolice report. It was alleged that Robin Roy and his brother<br \/>\nGobinda Roy had taken forcible possession of the first floor<br \/>\nand other portion of the premises which had not been let out<br \/>\nto Rabin Roy, The police authorities were directed to ensure<br \/>\nthat the free egress and ingress of the landlord to and from<br \/>\nthe disputed  flat was not interfered with by the tenant. If<br \/>\nnecessary, the\tpolice authorities  were directed  to remove<br \/>\nthe obstruction to such free egress and ingress. All parties<br \/>\nincluding the  Officer-in Charge,  Muchipara Police Station,<br \/>\nwere directed  to act on a signed copy of the minutes of the<br \/>\norder. It is not known how the proceedings under <a href=\"\/doc\/930621\/\" id=\"a_1\">Section 144<\/a><br \/>\nof the\tCriminal Procedure  Code ended.\t But, as a result of<br \/>\nthe order  passed by  the writ court, the police evicted the<br \/>\ntenant from  the disputed premises and the landlord was able<br \/>\nto resume possession immediately with police help.\n<\/p>\n<p id=\"p_4\">     The scope\tof writ\t jurisdiction of  the Court was lost<br \/>\nsight of by the learned Judge and an extraordinary situation<br \/>\nwas brought  about by  an improper  and unjust\torder passed<br \/>\nwithout any  affidavit\tin  less  than\tthree  weeks&#8217;  time.<br \/>\nBetween 13th  August, 1993  and 30th  August,  1993  a\twrit<br \/>\npetition  was  moved,  taken  up  for  hearing\tand  finally<br \/>\ndisposed of.  A\t tenant\t was  dislodged\t from  the  disputed<br \/>\npremises with  police help.  No proper\thearing was given to<br \/>\nthe respondents.  A copy  of the police report was not given<br \/>\nto the\trespondents. No\t direction was\tgiven for  filing of<br \/>\naffidavits even\t to the\t State, There  is no explanation why<br \/>\nthe proceedings\t were not  allowed to  be continued  in\t the<br \/>\nCourt of the Executive Magistrate in accordance with law. It<br \/>\nwas  most   unfortunate\t that  the  Court  intervened  in  a<br \/>\nproceeding under  <a href=\"\/doc\/930621\/\" id=\"a_2\">Section 144<\/a> of the Criminal Procedure Code<br \/>\nwhich was  actually being  heard and a drastic order of this<br \/>\nnature was  passed by  the court  in such  a manner  without<br \/>\nissuing a  Rule Nisi  and  without  any\t proper\t hearing.  A<br \/>\nprocedure unknown  to law  was adopted\tfor disposing  of  a<br \/>\nlandlord-tenant dispute.\n<\/p>\n<p id=\"p_5\">     What happened  thereafter was also very unfortunate for<br \/>\nthe appellant.\tThe appeal  court on October 14, 1993 passed<br \/>\nthe following order:\n<\/p>\n<p id=\"p_6\">&#8220;The Hon&#8217;ble A.M. Bhattacharjee, the Chief Justice<br \/>\n\t\tand<br \/>\nThe Hon&#8217;ble Justice N.K. Batabyal,<br \/>\nOctober 14, 1993.\t\tPrasanna Kr. Roy Karmakar<br \/>\n\t\t\t\t\t vs.\n<\/p>\n<p id=\"p_7\">\t\t\t\tState of West Bengal &amp; Ors.\n<\/p>\n<p id=\"p_8\">     THE COURT heard learned counsel for<br \/>\n     the parties. It is purely a private<br \/>\n     dispute   between\t  the\t private<br \/>\n     parties.  We  are\tfully  satisfied<br \/>\n     particularly   in\t view\tof   the<br \/>\n     decision  of   the\t Supreme   Court<br \/>\n     reported in  Mohan Pandey &amp; Anr. v.\n<\/p>\n<p id=\"p_9\">     Usha Rani Rajgaria &amp; Ors., AIR 1993<br \/>\n     SC 1225,  that  the  writ\tpetition<br \/>\n     which has given rise to this appeal<br \/>\n     ought not to have been entertained.\n<\/p>\n<p id=\"p_10\">     That being so, we allow this appeal<br \/>\n     and  set\taside  the  order  under<br \/>\n     appeal.\n<\/p>\n<p id=\"p_11\">\t  All parties to act on a signed<br \/>\n     copy of  the minutes  of this order<br \/>\n     on the usual undertaking&#8221;.\n<\/p>\n<p id=\"p_12\">     This order,  however, did\tnot enable  the appellant to<br \/>\nget back possession. The appeal court lost sight of the fact<br \/>\nthat the  writ Court  had intervened  in  a  purely  private<br \/>\ndispute and  as a result of its order the appellant had been<br \/>\ndispossessed by the police.\n<\/p>\n<p id=\"p_13\">     A further\tapplication,  therefore,  was  made  to\t the<br \/>\nappeal court for necessary relief. On 14th January, 1994 the<br \/>\nappeal court passed the following order.\n<\/p>\n<blockquote id=\"blockquote_1\"><p>\t  &#8220;The appeal  has already  been<br \/>\n     disposed of and we have accordingly<br \/>\n     become  functions\t officio.   This<br \/>\n     application can therefore no longer<br \/>\n     be entertained and is rejected.<\/p><\/blockquote>\n<p id=\"p_14\">     The two  orders passed  by the  appeal court on October<br \/>\n14, 1993 and January 14, 1994 did not give any relief to the<br \/>\nappellant, even\t though his appeal was allowed and the order<br \/>\nunder appeal  was set  aside. The appeal court lost sight of<br \/>\nthe fact  that the  appellant, who  had been dispossessed by<br \/>\nthe order  passed by  the writ\tcourt, had to be put back in<br \/>\npossession after setting aside the writ Court&#8217;s order.\n<\/p>\n<p id=\"p_15\">     A Special\tLeave Petition\twas made  against the afore-<br \/>\nsaid two  orders passed by the appeal court on 14th October,<br \/>\n1993 and  14th January,\t 1994. It may be mentioned here that<br \/>\nthe Special  Leave Petition  was dismissed  for default, but<br \/>\nlater on  restored on  an application made by the appellant.<br \/>\nMr. Ganguli  appearing on  behalf of the respondents has not<br \/>\ntried to  justify  the\textraordinary  and  unfair  ex-parte<br \/>\norders passed.\tIn fact,  he fairly  admitted that  the writ<br \/>\ncourt had  exceeded its\t jurisdiction in  intervening  in  a<br \/>\nprivate dispute.  He also  did not  seriously object  to the<br \/>\nproposition that  since by  an erroneous order the appellant<br \/>\nhad  been  evicted  from  the  possession  of  the  disputed<br \/>\npremises, it  was  the\tduty  of  the  appeal  court,  after<br \/>\nreversing the  order of\t the Trial  Court,  to\trestore\t the<br \/>\nappellant back into possession. If the appellant was ejected<br \/>\nfrom the  disputed premises  with .  police help pursuant to<br \/>\nthe order  which was  set aside,  the possession should have<br \/>\nbeen  restored\tto  him\t with  police  help,  if  necessary.<br \/>\nOtherwise, even after succeeding in the appeal the appellant<br \/>\nwill remain without remedy and out of possession as a result<br \/>\nof the order passed by the Trial Court. Actus curiae neminem<br \/>\ngravabit An  act of the Court shall prejudice no man. It was<br \/>\nthe duty  of the  Appeal Court to Status quo ante to passing<br \/>\nof the order on 30th August, 1993.\n<\/p>\n<p id=\"p_16\">     Mr. Ganguli  has, however, contended that the appeal is<br \/>\nbeing conducted\t in the name of the appellant, who is not an<br \/>\ninterested party  any more.  Mr. Sen  appearing on behalf of<br \/>\nthe appellant  has seriously  disputed this  proposition. We<br \/>\nare not inclined to go\tinto this controversy at this stage.<br \/>\nIf the\tappellant has been dispossessed by court order which<br \/>\nhas been reversed by the court of appeal, as is the position<br \/>\nin this case, his possession must be restored.\n<\/p>\n<p id=\"p_17\">     In view  of the  aforesaid, the  order  passed  by\t the<br \/>\nappeal court  dated 14th  January, 1994\t is set aside and we<br \/>\nremand the  case back  to the appeal court. The appeal court<br \/>\nwill direct  an enquiry\t as to\twhether Prasanna  Kumar\t Roy<br \/>\nKarmakar was  the  person  who\twas  actually  evicted\tfrom<br \/>\npossession on  the strength of the order passed on 30.8.1993<br \/>\nand, if\t so, restore  Prasanna Kumar  Roy Karmakar back into<br \/>\nthe possession\tof the disputed premises. Before passing any<br \/>\norder the  court must satisfy itself as to the true identity<br \/>\nand the\t wish of the appellant, Prasanna Kumar Roy Karmakar.<br \/>\nIf necessary,  the Court  will\tdirect\tPrasanna  Kumar\t Roy<br \/>\nKarmakar to be personally present in  the Court.\n<\/p>\n<p id=\"p_18\">     The appeal\t court will be at liberty to pass such order<br \/>\nin  the\t  interest  of\t justice  as  it  thinks  fit  after<br \/>\nascertaining the  facts and  in\t accordance  with  law.\t The<br \/>\nrespondents, who  were the  writ petitioners  in this  case,<br \/>\nwill pay costs assessed at Rs. 1,000\/- to the appellant.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Prasanna Kumar Roy Karmakar vs State Of West Bengal And Others on 26 March, 1996 Equivalent citations: 1996 AIR 1517, 1996 SCC (3) 403 Author: S Sen Bench: Sen, S.C.
