Justice R.BASANT\n\n Dated :19\/02\/2007\n\n O R D E R\n                                R.BASANT, J\n\n                             ----------------------\n\n                         W.P.C .No.1705 of 2007\n\n                       ----------------------------------------\n\n              Dated this the  19th day of February   2007\n\n\n\n\n                                  O R D E R\n<\/pre>\n<p id=\"p_1\">      The   petitioner   has   come   to   this   court   with   the   grievance<\/p>\n<p>that Protection Officers, as contemplated under the Protection of<\/p>\n<p>Women   from   <a href=\"\/doc\/542601\/\" id=\"a_1\">Domestic   Violence   Act<\/a>,   2005   (Act   43   of   2005)<\/p>\n<p>having not been appointed, the same is causing great prejudice<\/p>\n<p>and loss to the petitioner.   The learned Magistrate is not taking<\/p>\n<p>the   necessary   steps   to   get   the   notice   served   on   the   first<\/p>\n<p>respondent   for   the   reason   that   Protection   Officer   has   not   been<\/p>\n<p>appointed.     It   was   with   that   grievance   that   the   petitioner   had<\/p>\n<p>come to this court.  A report has been called for from the learned<\/p>\n<p>Magistrate and the report has been received.\n<\/p>\n<p id=\"p_1\">      2.     In   the   meantime,   it   is   submitted   that   Protection<\/p>\n<p>Officers   have   been   appointed   and   the   said   grievance   does   not<\/p>\n<p>survive.  Report of the learned Magistrate shows that the learned<\/p>\n<p>Magistrate  entertains serious doubts as to whether  the  petition<\/p>\n<p>is   maintainable   and   he   wants   the   matter   to   be   heard.     The<\/p>\n<p>learned counsel for the petitioner     had advanced arguments in<\/p>\n<p>part, it is mentioned.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P.C.No.1705\/07                         2<\/span><\/p>\n<p id=\"p_2\">       3.     I   am   of   the   opinion   that   the   petitioner   must   appear<\/p>\n<p>before   the   learned   Magistrate   and   advance   arguments   on   the<\/p>\n<p>question   of   maintainability  raised  by   the  learned  Magistrate.     I<\/p>\n<p>do not think it necessary to express any opinion on the question<\/p>\n<p>on which  the learned Magistrate wants the matter to be heard.\n<\/p>\n<p id=\"p_3\">The   petitioner   must   appear   before   the   learned   Magistrate   and<\/p>\n<p>advance his arguments whereupon the learned Magistrate shall<\/p>\n<p>take   appropriate   decision   in   the   matter.     It   is   reported   by   the<\/p>\n<p>learned Magistrate that the matter stands posted to 02\/03\/2007.\n<\/p>\n<p id=\"p_4\">The   petitioner   must   appear   before   the   learned   Magistrate   and<\/p>\n<p>make his submissions on that date.\n<\/p>\n<p id=\"p_5\">       4. Now,  considering  the   question  raised,  the   learned<\/p>\n<p>Government Pleader takes notice to the second respondent.   He<\/p>\n<p>shall   take   instructions.     It   shall   be   reported   specifically   to   this<\/p>\n<p>court   whether   Protection   Officer   has   been   appointed   to<\/p>\n<p>discharge   his   functions   within   the   jurisdiction   of   the<\/p>\n<p>Kunnamangalam Police Station.
