Misc. Cases arise out of<\/p>\n<p>                 the same case i.e. Begusarai (Muffasil) P.S. Case No. 77 of<\/p>\n<p>                 2011 registered under Sections-364, 302, 201\/34, 120B<a href=\"\/doc\/1569253\/\" id=\"a_1\"> of the<\/p>\n<p>                 Indian Penal Code<\/a> and accordingly, they are being heard and<\/p>\n<p>                 disposed of by this common order.\n<\/p>\n<p id=\"p_2\">                            Heard learned counsel for the petitioners as well as<\/p>\n<p>                 learned Additional Public Prosecutor for the state.<\/p>\n<p id=\"p_3\">                            Petitioners are not named in the first information<\/p>\n<p>                 report but in course of investigation, it came to light that the<\/p>\n<p>                 deceased had entered the house of co-accused, Chandan Jha<\/p>\n<p>                 and forcibly established physical relationship with sister of the<\/p>\n<p>                 aforesaid Chandan Kumar Jha and while the deceased was<\/p>\n<p>                 present in the house of Chandan Jha, the above-said Chandan<\/p>\n<p>                 Jha came there and a scuffle took place between the<\/p>\n<p>                 deceased and Chandan Jha. In the meantime, the aforesaid<\/p>\n<p>                 Chandan Jha and his sister raised alarm which attracted the<\/p>\n<p>                 petitioners who are Gotiyas of aforesaid Chandan Kumar and<\/p>\n<p>                 after that allegedly, the petitioners and aforesaid Chandan Jha<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                             2<\/span><\/p>\n<p>        mercilessly beaten the deceased as a result of which, he died<\/p>\n<p>        then and there.\n<\/p>\n<p id=\"p_4\">                    It also came in course of investigation that one<\/p>\n<p>        skeleton was recovered from an orchard on the basis of<\/p>\n<p>        confessional statement of co-accused, Chandan Jha but there<\/p>\n<p>        is northing in the entire case diary to show this fact that the<\/p>\n<p>        aforesaid skeleton belonged to the deceased of the present<\/p>\n<p>        case.\n<\/p>\n<p id=\"p_5\">                    Learned counsel appearing for the informant<\/p>\n<p>        opposed the prayer submitting that both the petitioners<\/p>\n<p>        participated in committing the alleged crime and after<\/p>\n<p>        committing the murder of the deceased, the petitioners and<\/p>\n<p>        other accused tried to destroy the dead body of the deceased.<\/p>\n<p id=\"p_6\">                    Taking into consideration the aforesaid facts and<\/p>\n<p>        circumstances as well as submission of the parties, let the<\/p>\n<p>        petitioners, namely, Lalan Kumar (in Cr. Misc. No. 31535 of<\/p>\n<p>        2011) and     Sanjeev Kumar Jha (in Cr. Misc. No. 34100 of<\/p>\n<p>        2011) be released on bail on furnishing bail bonds of Rs<\/p>\n<p>        10,000\/- (ten thousand) each with two sureties of the like<\/p>\n<p>        amount each in connection with Begusarai (Muffasil) P.S.<\/p>\n<p>        Case No. 77 of 2011 to the satisfaction of Chief Judicial<\/p>\n<p>        Magistrate, Begusarai.\n<\/p>\n<p id=\"p_7\">\n<pre id=\"pre_1\">AKV\/-                           ( Hemant Kumar Srivastava,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
