Justice V.GIRI\n\n Dated :09\/<a href=\"\/doc\/1390448\/\" id=\"a_1\">07\/2009\n\n O R D E R\n                       V.GIRI, J.\n         ----------------------------------------\n               W.P.(C).No<\/a>.16361 of 2009\n         ----------------------------------------\n          Dated this the 9th day of July, 2009.\n\n\n                      JUDGMENT\n<\/pre>\n<p id=\"p_1\">        The petitioner operates a regular stage<\/p>\n<p>carriage bearing registration No.Kl-9\/K565, on the<\/p>\n<p>route Pattambi-Kayiliyad and the timings in relation to<\/p>\n<p>the same was settled as per Ext.P2. According to the<\/p>\n<p>petitioner, the Secretary has settled the timings by<\/p>\n<p>Ext.P2 after regular permit was granted by the RTA,<\/p>\n<p>Palakkad. But, there was a variation in respect of<\/p>\n<p>commencement from Kayiliyad to Koppam via<\/p>\n<p>Puthiyaroad at 12.02 PM. This could have proceeded<\/p>\n<p>via Vallapuzha and Malayankavu, which was a route<\/p>\n<p>granted by the Regional Transport Authority. A new<\/p>\n<p>entrant to the field took note of this variation and<\/p>\n<p>complained that the petitioner was not operating his<\/p>\n<p>vehicle on the route granted by the Regional<\/p>\n<p>Transport Authority. A check report was drawn up and<\/p>\n<p>the petitioner&#8217;s permit was cancelled under Ext.P3.<\/p>\n<p>W.P.(C).No.16361 of 2009<\/p>\n<p>                         :: 2 ::\n<\/p>\n<p id=\"p_1\">\n<p>The petitioner preferred an appeal before the State<\/p>\n<p>Transport Appellate Tribunal, wherein he expressed<\/p>\n<p>his willingness to compound the offence. The tribunal<\/p>\n<p>set aside the cancellation of the permit and directed<\/p>\n<p>the Regional Transport Authority, to permit the<\/p>\n<p>petitioner to compound the offence.<\/p>\n<p id=\"p_2\">          2. The Regional Transport Authority, after<\/p>\n<p>remand, again affirmed its earlier decision vide<\/p>\n<p>Ext.P5 on the premise that the vehicle was not used<\/p>\n<p>in accordance with the permit.         This was again<\/p>\n<p>challenged by the petitioner before the tribunal. The<\/p>\n<p>tribunal by Ext.P7 set aside Ext.P5 and directed the<\/p>\n<p>Regional Transport Authority, to proceed in terms of<\/p>\n<p>its earlier judgment. The petitioner&#8217;s grievance is that<\/p>\n<p>he is not now      in a position to operate either in<\/p>\n<p>accordance with the varied permit granted by the<\/p>\n<p>Regional Transport Authority as per Ext.P5 or as per<\/p>\n<p>the timings settled as per Ext.P2, which was, in effect,<\/p>\n<p>set aside. Hence this writ petition.<\/p>\n<p>W.P.(C).No.16361 of 2009<\/p>\n<p>                           :: 3 ::\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">         3.    Learned Government Pleader submits<\/p>\n<p>that the timings will be settled in accordance with the<\/p>\n<p>permit Ext.P1.
