The request is made<br \/>\nin light of the fact that the applicant being purchaser of the<br \/>\nproperty sold under the Securitization and Reconstruction of<br \/>\nFinancial Assets and <a href=\"\/doc\/198257891\/\" id=\"a_1\">Enforcement of Security Interest Act<\/a>, 2002<br \/>\n(&#8220;SARFAESI&#8221; Act for short) action, desires the conveyance<br \/>\ndeed may be executed. However, respondents have not executed the<br \/>\nconveyance deed.\n<\/p>\n<p id=\"p_1\">2.<br \/>\nMr. Yadav, learned advocate for OL has submitted that in this<br \/>\nparticular case OL had not taken possession of the property in<br \/>\nquestion because it was sold by the secured creditor under the<br \/>\nSARFAESI action without participation of the OL in any manner<br \/>\nwhatsoever. Therefore, when the entire transaction is executed by and<br \/>\nbetween the secured creditor and the purchaser, the OL is not in<br \/>\nposition and \/ or liable to execute sale deed and it is for the<br \/>\nsecured creditor to execute sale deed, if necessary.\n<\/p>\n<p id=\"p_2\">3.<br \/>\nLearned advocate for the secured creditor has submitted that in view<br \/>\nof the provisions under        Sub-Rule 6 of Rule 9 of the <a href=\"\/doc\/52229129\/\" id=\"a_1\">SARFAESI<br \/>\nAct<\/a> the secured creditor who sold the properties in question under<br \/>\nSARFAESI action has to issue share certificate which can be got<br \/>\nregistered by payment of appropriate stamp duty and any conveyance<br \/>\ndeed for the said purpose is not necessary.\n<\/p>\n<p id=\"p_3\"> \tSo<br \/>\nas to make submission in support of the said contention learned<br \/>\nadvocates have requested for some time.
