NO. 719 OF 2000\n                = = = = = = = = = = = = = = =\n         Dated this the 7th day of December , 2010.\n\n                      J U D G M E N T\n<\/pre>\n<p id=\"p_1\">    This  appeal      is      preferred      against  the<\/p>\n<p>judgment and decree passed by the Subordinate<\/p>\n<p>Judge, Irinjalakuda in O.S.556\/95.            The suit is<\/p>\n<p>one  for   a    declaration          and     consequential<\/p>\n<p>injunction.    The plaintiff is an unfortunate<\/p>\n<p>small  scale  unit      &#8216;S.M.Industries&#8217;        which was<\/p>\n<p>started but had only a short span of life.             On<\/p>\n<p>account  of  the      labour       problems    and   other<\/p>\n<p>difficulties repayment to the K.F.C. became an<\/p>\n<p>impossibility     which        resulted       in    taking<\/p>\n<p>possession of the assets of the firm by the<\/p>\n<p>Corporation and it led to the non-functioning of<\/p>\n<p>the unit.   The Kerala State Electricity Board<\/p>\n<p>had sent a notice demanding Rs.40,052\/- which<\/p>\n<p>according to them are the dues from the month of<\/p>\n<p>January, 1992 till 1994.           It is also contended<\/p>\n<p>A.S. 719 OF 2000<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                            -2-<\/span><\/p>\n<p>that there had been a subsequent dismantlement<\/p>\n<p>of connection and therefore the plaintiff prays<\/p>\n<p>for the declaratory relief that it cannot be<\/p>\n<p>directed to pay amount as it had not been<\/p>\n<p>functioning and as electricity connection has<\/p>\n<p>been disconnected.\n<\/p>\n<p id=\"p_1\">        2. Defendants 1 and 2 would contend that<\/p>\n<p>there      was   disconnection  of  electricity  on<\/p>\n<p>29.1.92        and  dismantlement   of    electrical<\/p>\n<p>connection      on  31.12.94.  Irrespective of  the<\/p>\n<p>question of disconnection the consumer is liable<\/p>\n<p>to pay the fixed charges and therefore the<\/p>\n<p>demand is in order and further as there is an<\/p>\n<p>alternate remedy the suit is not entertainable.<\/p>\n<p>The     Revenue   authorities   had  acted  on  the<\/p>\n<p>requisition      of  the  K.S.E.B.  and  they would<\/p>\n<p>contend that the suit as filed against them is<\/p>\n<p>not maintainable.       The learned trial judge on<\/p>\n<p>exhaustive consideration of the materials held<\/p>\n<p>A.S. 719 OF 2000<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                             -3-<\/span><\/p>\n<p>that     the    plaintiff  is   not  entitled to the<\/p>\n<p>declaration,       found  that    the  suit  is   not<\/p>\n<p>maintainable but ultimately granted a relief in<\/p>\n<p>the form of a direction to file an appeal or<\/p>\n<p>complaint to the Board and on condition that it<\/p>\n<p>deposits the amount in five monthly instalments.<\/p>\n<p>There was also a direction, in case of success<\/p>\n<p>for the plaintiff, to get back the amount with<\/p>\n<p>12% interest from the K.S.E.B.         but ultimately<\/p>\n<p>the suit had been dismissed.       It is against that<\/p>\n<p>decision the plaintiff has come up in appeal.<\/p>\n<p id=\"p_2\">       3.   The learned counsel for the appellant<\/p>\n<p>would      submit    before  me    that  the  learned<\/p>\n<p>Subordinate judge had lost sight of Rules 34(c)<\/p>\n<p>and (d) and thereby has committed grave error.<\/p>\n<p>As per Rule 34(c) of the conditions of supply of<\/p>\n<p>electric        energy   if   the    service  remains<\/p>\n<p>disconnected for more than one month, energy<\/p>\n<p>charge will not be levied for that period.       But<\/p>\n<p>A.S. 719 OF 2000<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                           -4-<\/span><\/p>\n<p>there is a liability to pay fixed charge. Under<\/p>\n<p>Rule 34 clause (c) (ii) normally no service<\/p>\n<p>shall be kept disconnected for more than six<\/p>\n<p>months continuously at a time and under Rule 35<\/p>\n<p id=\"p_3\">(d)     &#8220;no     service shall  remain  disconnected<\/p>\n<p>continuously for a period exceeding six months<\/p>\n<p>for non-payment of amount due to the Board.     If<\/p>\n<p>the dues are not paid within the six months<\/p>\n<p>period of disconnection, the service shall be<\/p>\n<p>dismantled and agreement terminated immediately<\/p>\n<p>after the six months of disconnection after<\/p>\n<p>giving 15 days notice to the consumer.&#8221;<\/p>\n<p id=\"p_4\">       4.   In this case admittedly disconnection<\/p>\n<p>has been done in the month of January, 1992 more<\/p>\n<p>specifically on 29.1.1992 and the dismantlement<\/p>\n<p>has been done only on 31.12.94.     So it is really<\/p>\n<p>against the rules.       I have just stated these<\/p>\n<p>things for the authority to consider it.<\/p>\n<p>A.S. 719 OF 2000<br \/>\n<span class=\"hidden_text\" id=\"span_3\">                           -5-<\/span><\/p>\n<p id=\"p_5\">       5.   The  trial  court  has  non-suited  the<\/p>\n<p>plaintiff in the light of the decision of the<\/p>\n<p>Hon&#8217;ble Supreme Court reported in <a href=\"\/doc\/1780398\/\" id=\"a_1\">Punjab State<\/p>\n<p>Electricity Board &amp; another v. Ashwani Kumar<\/a><\/p>\n<p>(1997 (5) SCC 120).     The learned counsel for the<\/p>\n<p>appellant wanted to distinguish that decision<\/p>\n<p>stating that it is only one for injunction<\/p>\n<p>whereas the suit is filed by the plaintiff is<\/p>\n<p>one for declaration.       But the principle laid<\/p>\n<p>down by the Hon&#8217;ble Supreme Court is that when<\/p>\n<p>there is an alternate remedy provided under the<\/p>\n<p>statute itself by way of departmental appeal<\/p>\n<p>then it is desirable to exercise that and not to<\/p>\n<p>entertain a case by the civil Court.     So in the<\/p>\n<p>light of the same I am also to hold that the<\/p>\n<p>civil suit need not be entertained but some<\/p>\n<p>remedy for a hearing is absolutely necessary for<\/p>\n<p>the     plaintiff   in  the   light of  the   rules<\/p>\n<p>extracted above.      Therefore I close this appeal<\/p>\n<p>A.S. 719 OF 2000<br \/>\n<span class=\"hidden_text\" id=\"span_4\">                           -6-<\/span><\/p>\n<p>with a direction to the plaintiff to file an<\/p>\n<p>appeal or complaint as provided under Rules<\/p>\n<p>before appropriate authority and direct that<\/p>\n<p>authority to consider the case of the plaintiff<\/p>\n<p>especially with reference to Rules 34(c) and (d)<\/p>\n<p>of     the    conditions of   supply of  electrical<\/p>\n<p>energy.        An open hearing may be provided to<\/p>\n<p>raise all contentions by the department as well<\/p>\n<p>as by the plaintiff and thereafter the matter<\/p>\n<p>may be decided in accordance with law.      I also<\/p>\n<p>make it clear if at all there is any question<\/p>\n<p>regarding interest that also may have to be<\/p>\n<p>considered      judiciously in   the light of  the<\/p>\n<p>Hon&#8217;ble Supreme Court&#8217;s decisions and the matter<\/p>\n<p>be disposed of in accordance with law.<\/p>\n<p id=\"p_6\">       6.   The   legal   representatives of   the<\/p>\n<p>appellant are directed to prefer an appeal or<\/p>\n<p>complaint as the case may be within six weeks<\/p>\n<p>from today and it is further made clear till a<\/p>\n<p>A.S. 719 OF 2000<br \/>\n<span class=\"hidden_text\" id=\"span_5\">                         -7-<\/span><\/p>\n<p>final decision is taken in the matter coercive<\/p>\n<p>proceedings be averted to realise the amount<\/p>\n<p>demanded by the notice.   Parties are directed to<\/p>\n<p>bear their respective costs.\n<\/p>\n<p id=\"p_7\">       7.   It  is made clear that  any   finding<\/p>\n<p>entered into by the trial Court shall not be the<\/p>\n<p>criteria for deciding the case and untrammeled<\/p>\n<p>by the observations thereunder, the matter can<\/p>\n<p>be heard and disposed of.\n<\/p>\n<p id=\"p_8\">\n<p id=\"p_9\">                         M.N.
