Anyhow, the Tribunal after\n\n: taking into consideration the contents of the F.I.R.\n\n \n\nC\n9\/\n0(\"___,\n\n\n\nL________(  \n\n[which has not been marked -in the evidence] held\nthat the offending vehicle was heavy vehicle when\ncompared to the motor cycle and in that viee%efrtue\n\nmatter assessed. the contributory neglicerlcefet \n\n(D\nI}.\n\non the part ef th\n\n(\"1'\nCI\n\nand 20% on the per\n\nriver of the offending vehicle '\n\nf the deceased. This finding is '\n\nnot in dispute. Though :it ieg_contendedi that 'the.\n\n\ufb02l\n\negligence was solely on the part er the driver of\nthe offending vehicle, *itheieT\u00a2the taut} of the\nclaimants to prove that act by ercdecing material on\nrecord and examinincwieye neiteeeaee; if available.\n\nIn view of the tact t\ufb01et no material has been placed\n\non record ite \"prove gebeclute rash and negligent\n\nan\n\ndriving on the part cf the driver of the offendin\n\nH'\nF.5-\n:3\n\nvehicle, we do not find any such ground made eu\nthe appeal tc.Qrove the eheclete negligence e1 the\n\nlpart'of*thewdriver ef the offending vehicle.\n\n4'\n\nViaoil'l3$he\"ilearned counsel for the appellants\n\n--' contended. that the deceased was a businessman and\nHd'the~_eseeeement of his income by the Tribunal at\n4iJRe;75eO0 per day is on lower eide= Apart from\nR\"=redistration certificate-Ex;-2 and licence\ufb01Ex.?3,\n\n\"nothing has been produced\n\nregarding\n\u00a7Ef:f'\n\n\n\ndeceased, Except interested version of ?.'u'u'.1, no\nmaterial is placed on record. In the absence of any\n\n'iaterial, the Tribunalhas taken the incotne'.:\"of\u00a5.4the\n\ndeceased at Rs.'75-00 per day as the :.'_'wa's'_\n\ncarrying on some business,.....Th'ere*f.orVe;.'.1\u00bb there .\n\nnoting on record to consider ;\"enjha\u00abncement\"' :'cff::,the\n\ncompensation towards loss:  denendenc-yr'\n\n'F. The Tribunal has\" notiuewarded\"conapensation\nfor loss of love an\u00e9dhi the deceased\nleft behind _:'\u00a2*l.\u00a7i1f\":'iit9' \\t\u00a7\"\"n:'inor children.\nTaking into  vasnect of the matter,\nwe deexnamount of Rs.15,000-00\nfor lose__ofilove'.antfaffection at Re.5,000-00 each\nfor apnelliant\/cla:;in:an't:\"Nos.2 to 4. In view of the\n\nfactjwthat uth-eAA'clai.1xr':ants are entitled to 80% of the\n\n3J\"=of cornbeinsation, they are entitled to\n\n  there is contributory negligence o\n\n25\n\nthe Vpart.--c--:VE'lV the deceased i.e.; rider cf the rotor\n\nu_cycle~~tcj.'rh extent of 20%.\n\n---cw\n\n The Tribunal has awarded compensation for\n\n_,loss of estate, loss of consortium, funeral\n\n expenses, etc. Hence we do not think that the ewe:\n\n13..\n\nof compensation by the Tribunal is unreasonable c\n\n:3\n\n \n \n\n\n\nother heads.
