J.\n<\/p>\n<p id=\"p_1\">     The seven\tappellants in  these appeals and one Mahadev<br \/>\nPrasad Pandey  were  placed  on\t trial\tbefore\tthe  learned<br \/>\nAdditional Sossions  Judge, Mathura.  Against the appellants<br \/>\ncommon charges\tunder Sections\t120-B. 148, 302\/149. and 454<br \/>\n<a href=\"\/doc\/1569253\/\" id=\"a_1\">I.P.C<\/a>. and  against  Mahadev  Prasad  Pandey  charges  under<br \/>\n<a href=\"\/doc\/1560742\/\" id=\"a_1\">Sections 302<\/a>\/<a href=\"\/doc\/513074\/\" id=\"a_2\">109<\/a>  and <a href=\"\/doc\/455468\/\" id=\"a_3\">307<\/a>\/<a href=\"\/doc\/513074\/\" id=\"a_4\">109<\/a>  IPC were\t framed. A  separate<br \/>\ncharge under  <a href=\"\/doc\/1560742\/\" id=\"a_5\">Section 302<\/a>  IPC was  also framed\t against the<br \/>\nappellant Anokhey  Lal.\t On  conclusion\t of  the  trial\t the<br \/>\nlearned Judge.\twhile acouitting  Mahadev Prasad,  convicted<br \/>\nall the\t appellants under  <a href=\"\/doc\/763672\/\" id=\"a_6\">Sections 148<\/a>\t and <a href=\"\/doc\/724142\/\" id=\"a_7\">324<\/a>\/<a href=\"\/doc\/999134\/\" id=\"a_8\">149<\/a> IPC and<br \/>\nfurther convicted  Anokhey Lal\tunder <a href=\"\/doc\/1560742\/\" id=\"a_9\">Section  302<\/a> IPC.\t For<br \/>\neach of\t their convictions  the appellants were sentenced to<br \/>\nsuffer rigorous\t imprisonment for  two years and Anokhey Lal<br \/>\nwas sentenced  to imprisonment\tfor life  for his conviction<br \/>\nunder <a href=\"\/doc\/1560742\/\" id=\"a_10\">Section  302<\/a> IPC.\t The sentences\twere directed to run<br \/>\nconcurrently. Against  the above  judgment two\tappeals were<br \/>\nfiled; one by the appellants assailing their convictions and<br \/>\nthe other  by the State against their acquittal of the other<br \/>\ncharges. The  High Court  dismissed  both  the\tappeals\t and<br \/>\naffirmed  the  judgment\t of  the  High\tCourt.\tHence  these<br \/>\nappeals.\n<\/p>\n<p id=\"p_2\">     According to  the prosecution case on March 27, 1975 at<br \/>\nor  about  6.30\t A.M.  the  appellants.\t armed\twith  deadly<br \/>\nweapons, raided the house of Gopal and appellant Anokhey Lal<br \/>\nthrust a  spear on  the chest  of Makhan,  brother of Gopal,<br \/>\nfelling him  down. On  hearing the  hue and  cry  raised  by<br \/>\nMakhan, Ram Dayal, Gopal and Ram Krishan came there and they<br \/>\nwere also  attacked by\tthe appellants\tby their  respective<br \/>\nweapons. Finding  no other  alternative. when  Gopal started<br \/>\nthowing brick-bats  towards the appellants and Ram Dayal and<br \/>\nRam Krishan started beating them with small dandas they fled<br \/>\naway.\n<\/p>\n<p id=\"p_3\">     Makhan, who  was seriously injured, was taken to police<br \/>\nstation along  with the\t other injured by Giriraj. his elder<br \/>\nbrother. and there he (Giriraj) gave a written report of the<br \/>\nincident, on  the basis\t of  which  a  case  was  registered<br \/>\nagainst the  appellants. Since\tthe condition  of Makhan was<br \/>\ngrave he  was immediately sent to Mathura Hospital while the<br \/>\nother injured  were sent  to  local  Government\t dispensary.<br \/>\nMakhan, however,  did not  respond to  the medical treatment<br \/>\ngiven to  him at  the hospital and succumbed to his injuries<br \/>\nwithin an hour.\n<\/p>\n<p id=\"p_4\">     The  appellants  pleaded  not  guilty  to\tthe  charges<br \/>\nlevelled against  them and  took up  the plea  of  right  of<br \/>\nprivate defence of their persons.\n<\/p>\n<p id=\"p_5\">     To prove  its case\t the prosecution  examined a host of<br \/>\nwitnesses of  whom Giriraj  (P.W.1).  Ram  Krishan  (P.W.2),<br \/>\nRameshwar Prasad  (P.W.3), Puran  Devi (P.W.4) and Ram Dayal<br \/>\n(P.W.5)\t gave  the  ocular  version  of\t the  incident.\t The<br \/>\nappellants also examined a number of witnesses in support of<br \/>\ntheir defence.\n<\/p>\n<p id=\"p_6\">     On consideration  of evidence  adduced during trial the<br \/>\ntrial  Court   accepted\t the  case  of\tthe  prosecution  in<br \/>\npreference to  that of\tthe defence  and held the appellants<br \/>\nguilty. The  High Court\t also in  its turn.  reappraised the<br \/>\nevidence and upheld the order of the trial Court.\n<\/p>\n<p id=\"p_7\">     Having heard  the learned\tcounsel\t appearing  for\t the<br \/>\nparties and  considered the  judgments of the learned Courts<br \/>\nbelow in  the light  of the evidence adduced during trial we<br \/>\ndo not\tfind any reason whatsoever to disturb the concurrent<br \/>\nfindings of  fact recorded  by them,  more so,\tas they\t are<br \/>\nbased on  detailed  and\t proper\t discussion  of\t the  entire<br \/>\nevidence and supported by cogent reasons.\n<\/p>\n<p id=\"p_8\">     It was,  however,\tstrongly  urged\t on  behalf  of\t the<br \/>\nappellants that\t even if  the entire  prosecution  case\t was<br \/>\naccepted as  true Anokhey Lal could only be, in view of fact<br \/>\nthat Makhan  sustained only one injury, guilty of an offence<br \/>\nunder <a href=\"\/doc\/409589\/\" id=\"a_11\">Section  304<\/a> (Part  II) IPC  and not under <a href=\"\/doc\/1560742\/\" id=\"a_12\">Section 302<\/a><br \/>\nIPC.\n<\/p>\n<p id=\"p_9\">     As already\t noticed the  prosecution case\twas that the<br \/>\nappellant Anokhey  lal had  thrust a  spear on\tthe chest of<br \/>\nMakhan. Dr.  Jagdish Lal  (P.W.\t 13)  who  held\t post-mortem<br \/>\nexamination on\tthe dead  body of Makhan found the following<br \/>\ninjury on his person:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>     &#8220;Incised would  1 1\/2&#8243;  x 1\/2&#8243;  x\tchest<br \/>\n     cavity deep  of linear  nature near  the<br \/>\n     sternum bone on the front side below the<br \/>\n     chest.&#8221;<\/p><\/blockquote>\n<p id=\"p_10\">     He further stated that on internal examination he found<br \/>\nthe pericardium\t damaged and  one ounce\t of  blood  present.<br \/>\nAccording  to  P.W.13  the  injury  was\t sufficient  in\t the<br \/>\nordinary course\t of nature to cause death of Makhan and that<br \/>\nthe same could be caused by a spear.\n<\/p>\n<p id=\"p_11\">     When considered in the context of the proved facts that<br \/>\nthe appellants had gone armed with deadly weapons, to attack<br \/>\nthe members of Gopal&#8217;s family and after trespassing into the<br \/>\nhouse Anokhey  Lal caused  a penetrating  injury on  a vital<br \/>\npart of the body of Makhan with a spear which was sufficient<br \/>\nin the\tordinary  course  of  nature  to  cause\t death,\t the<br \/>\nconclusion is  inevitable  that\t the  offence  committed  by<br \/>\nAnokhey Lal comes within clause III of <a href=\"\/doc\/626019\/\" id=\"a_13\">Section 300<\/a> IPC so as<br \/>\nto make\t Anokhey Lal liable for conviction under <a href=\"\/doc\/1560742\/\" id=\"a_14\">Section 302<\/a><br \/>\nIPC. As\t regards the other six appellants, whose convictions<br \/>\nare to\tbe upheld,  we do  not feel  inclined to  send\tthem<br \/>\nbehind the  bars again as more than twenty years have elapsd<br \/>\nsince the  offences were  committed by them and each of them<br \/>\nhas served a substantial part of their sentence of two years<br \/>\nrigorous imprisonment.\n<\/p>\n<p id=\"p_12\">     For the  foregoing discussion we uphold the convictions<br \/>\nand sentence  recorded against the appellant Anokhey lal and<br \/>\nthe convictions\t of the\t other six  appellants put we reduce<br \/>\ntheir sentence\tto the\tperiod already undergone. As all the<br \/>\nappellants are\ton bail.  Anokhey Lal  will now surrender to<br \/>\nhis bail  bond to  serve out  the sentence imposed upon him,<br \/>\nwhile the  other six  appellants will  stand discharged from<br \/>\ntheir respective  bail bonds.  The appeals are thus disposed<br \/>\nof.\n<\/p>\n<p id=\"p_13\">     Since the\tappeals have  been disposed of Special Leave<br \/>\nPetition filed\tby the complainant and the other injured and<br \/>\nthe Crl. M.P.
