DAVE\n\t\t\n\t\n\n \n\nDate\n: 26\/04\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">This<br \/>\n\tapplication is filed under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of the Code of Criminal<br \/>\n\tProcedure in connection with First Information Report registered as<br \/>\n\tI-C.R. No.14\/2011 with J.P. Road Police Station, Vadodara City for<br \/>\n\tthe offences punishable under <a href=\"\/doc\/92983\/\" id=\"a_1\">Sections 306<\/a>, <a href=\"\/doc\/1868826\/\" id=\"a_2\">498(A)<\/a>, <a href=\"\/doc\/1868826\/\" id=\"a_3\">498(B)<\/a> and <a href=\"\/doc\/112749\/\" id=\"a_4\">114<\/a><br \/>\n\tof Indian Penal Code.\n<\/p>\n<p id=\"p_1\">Learned<br \/>\n\tCounsel Mr. P.S. Gondalia appearing for the applicant has<br \/>\n\tdrawn attention of this Court to the dying declaration of the<br \/>\n\tdeceased recorded by the Executive Magistrate and alleged note of<br \/>\n\tsuicide and none of the above implicate the applicant herein.  It is<br \/>\n\talso submitted that the complaint was filed on 10.01.2011 for the<br \/>\n\talleged incident which occurred on 09.12.2010.  It is therefore,<br \/>\n\tsubmitted that subject to imposition of suitable conditions, the<br \/>\n\tapplicant  may be enlarged on bail.\n<\/p>\n<p id=\"p_2\">\tMr. J.K.\n<\/p>\n<p id=\"p_3\">\tShah learned APP and Mr. R.C. Jain learned Advocate for the<br \/>\n\tcomplainant have opposed this application for bail on the ground<br \/>\n\tthat in a short span of a married life of one year and due to demand<br \/>\n\tfor dowry of Rs.7,00,000\/= and mental cruelty inflicted upon the<br \/>\n\tdeceased, she took the unfortunate and extreme step of ending her<br \/>\n\tlife for which no discretion can be exercised in favour of the<br \/>\n\tapplicant herein.\n<\/p>\n<p id=\"p_4\">Heard<br \/>\n\tlearned APP Mr. J.K. Shah for the respondent-State.\n<\/p>\n<p id=\"p_5\">Having<br \/>\n\theard learned Counsels for the parties and considering all other<br \/>\n\tattending circumstances including allegations of physical and mental<br \/>\n\ttorture, the dying declaration recorded before the Executive<br \/>\n\tMagistrate, the suicide note alleged to have been written by the<br \/>\n\tdeceased and time duration after which the complaint is filed, at<br \/>\n\tthis stage, I deem it just and proper to enlarge the<br \/>\n\tapplicant on bail.\n<\/p>\n<p id=\"p_6\">Learned<br \/>\n\tCounsels for the parties do not press for further reasoned order.\n<\/p>\n<p id=\"p_7\">In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith First Information Report registered as I-C.R. No.14\/2011 with<br \/>\n\tJ.P. Road Police Station, Vadodara City, on executing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand Only) with one surety of the like<br \/>\n\tamount to the satisfaction of the Trial Court and subject to the<br \/>\n\tconditions that he shall;\n<\/p>\n<p id=\"p_8\">a)<br \/>\n\tnot take undue advantage of liberty or misuse liberty;\n<\/p>\n<p id=\"p_9\">b)<br \/>\n\tnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_10\">c)<br \/>\n\tsurrender passport, if any, to the lower court within a week;\n<\/p>\n<p id=\"p_11\">d)<br \/>\n\tnot leave the State of Gujarat without prior permission of the<br \/>\n\tSessions Judge concerned;\n<\/p>\n<p id=\"p_12\">e)<br \/>\n\tmark presence at the concerned Police Station on the first Sunday of<br \/>\n\tevery month between 10.00 a.m. and 3.00 p.m. for three months only;\n<\/p>\n<p id=\"p_13\">f)<br \/>\n\tfurnish the present address of his residence to the Investigating<br \/>\n\tOfficer and also to the Court at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of this<br \/>\n\tCourt;\n<\/p>\n<p id=\"p_14\">The<br \/>\n\tauthorities will release the applicant only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p id=\"p_15\">If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p id=\"p_16\">Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p id=\"p_17\">At<br \/>\n\tthe trial, the Trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p id=\"p_18\">Rule<br \/>\n\tmade absolute.
