DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 14\/03\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">Rule.\n<\/p>\n<p id=\"p_1\">\tMr.  learned APP, waives service of notice of Rule for respondent<br \/>\n\tState.\n<\/p>\n<p id=\"p_2\">This<br \/>\n\tapplication is filed under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of the Code of Criminal<br \/>\n\tProcedure in connection with first information report registered at<br \/>\n\tCR No.I 95\/2009 with Ellisbridge Police Station,  for the offences<br \/>\n\tpunishable under <a href=\"\/doc\/1270615\/\" id=\"a_1\">Sections 380<\/a>, <a href=\"\/doc\/1286145\/\" id=\"a_2\">454<\/a> etc. of<a href=\"\/doc\/1569253\/\" id=\"a_3\"> the Indian Penal Code<\/a>.\n<\/p>\n<p id=\"p_3\">Learned<br \/>\n\tcounsel appearing for the applicants submits that charge<br \/>\n\tsheet is filed.  It is further submitted that the applicant<br \/>\n\tis falsely involved in the crime and he has not committee  the<br \/>\n\talleged crime.  It is further submitted that the<br \/>\n\tapplicant will not flee from justice and will cooperate with the<br \/>\n\tinvestigation as and when called for. It is further submitted that<br \/>\n\tin view of the above, the applicant may be enlarged on bail.\n<\/p>\n<p id=\"p_4\">Heard<br \/>\n\tlearned APP  for the respondent   State.\n<\/p>\n<p id=\"p_5\">Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, nature of<br \/>\n\tallegations, role attributed to the accused and punishment<br \/>\n\tprescribed for the alleged offences, without discussing the evidence<br \/>\n\tin detail, at this stage, I am inclined to enlarge the applicant on<br \/>\n\tbail by imposing an additional condition that the applicant shall<br \/>\n\tnot enter into the city and district of Ahmedabad for a period of 6<br \/>\n\tmonths.\n<\/p>\n<p id=\"p_6\">Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p id=\"p_7\">In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith first information report registered at C.R. No.I 95\/2009 with<br \/>\n\tEllisbridge Police Station on executing a bond of Rs.5,000\/- (Rupees<br \/>\n\tFive thousand only) with one surety of the like amount to the<br \/>\n\tsatisfaction of the trial Court and subject to the conditions that<br \/>\n\the shall;\n<\/p>\n<p id=\"p_8\">not<br \/>\n\ttake undue advantage of liberty or misuse liberty;\n<\/p>\n<p id=\"p_9\">not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_10\">surrender<br \/>\n\tpassport, if any, to the lower court within a week;\n<\/p>\n<p id=\"p_11\">not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p id=\"p_12\">mark<br \/>\n\tpresence at the concerned police station on the first Sunday of<br \/>\n\tevery month between 10.00 a.m. and 3.00 p.m. for three months only;\n<\/p>\n<p id=\"p_13\">furnish<br \/>\n\tthe present address of his residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p id=\"p_14\">shall<br \/>\n\tnot enter into the city and district of Ahmedabad for a period of<br \/>\n\tsix months;\n<\/p>\n<p id=\"p_15\">The<br \/>\n\tAuthorities will release the applicant only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p id=\"p_16\">If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p id=\"p_17\">Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p id=\"p_18\">At<br \/>\n\tthe trial, the trial court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p id=\"p_19\">Rule<br \/>\n\tis made absolute to the aforesaid extent.
