Mohan<\/p>\n<p> Respondents : Neyveli Lignite Corporation Limited<\/p>\n<p>       This second-appeal by Shri K.Mohan (appellant) against the order of the<br \/>\nAppellate Authority, dated 29.10.2007, came up for hearing on 15.07.2008<br \/>\npursuant to Commission&#8217;s hearing notice dated 28.05.2008. Appellant was<br \/>\nabsent, while the respondents were represented by Shri S.Sridhar, CPIO and<br \/>\nShri S.Gurusamynathan, C.M. (Pers).\n<\/p>\n<p id=\"p_2\">2.      Respondents pointed out that the three items of information, which the<br \/>\nappellant has listed in his second-appeal dated 11.02.2008, comprise requests for<br \/>\ninformation which are broader than the scope of the queries originally made by<br \/>\nhim in his RTI-application dated 13.08.2007. Part of the information is already<br \/>\navailable in the form of priced documents and can be purchased by the appellant<br \/>\nfrom the respondents. The balance information such as a log and copy of the LC<br \/>\nrequested by him were not available for past years. Besides, these are also not<br \/>\nmaintained in the form appellant has requested, i.e. work-wise. These are<br \/>\nmaintained for each division for all variety of equipment and machines used<br \/>\nthere. It is a log-record of the working of those machines on a day-to-day basis.<br \/>\nRespondents stated that this information is available only for the recent times,<br \/>\nsay a given year. Being extremely voluminous, disclosing this information to the<br \/>\nappellant will be both expensive in terms of cost and time and, therefore, would<br \/>\nattract the provisions under <a href=\"\/doc\/1322680\/\" id=\"a_1\">Section 7(9)<\/a> of the RTI Act.\n<\/p>\n<p id=\"p_3\">3.     Upon hearing the respondents and perusing the submissions of the<br \/>\nappellant made through his second-appeal petition, it is noted that items 1 and 2<br \/>\nof his second-appeal petition regarding certain Annual Maintenance Contract<br \/>\ntender given out by the respondents to M\/s.Vasavi Engineering, did not find<br \/>\nmention in the appellant&#8217;s first RTI-application (dated 13.08.2007). He cannot<br \/>\nbe authorized to bring up new items for disclosure of information at the appellate<br \/>\nstage.\n<\/p>\n<p id=\"p_4\">4.     As regards item 3 \u2015 viz. the copy of the tender schedule, etc. for the<br \/>\nyears 2003 to 2007 \u2015 it is found that these are priced documents, which are<br \/>\navailable in the public domain and can be purchased on payment of the listed<br \/>\nprice. Respondents were wholly correct in stating that a priced document cannot<br \/>\nbe asked to be disclosed to a petitioner through the process of the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                       Page 1 of 2<\/span><\/p>\n<p id=\"p_5\"> 5.     As regards item 4 \u2015 viz. Log and copy of LC \u2015 in view of what has been<br \/>\nstated by the respondents during the hearing, this information comes within<br \/>\n<a href=\"\/doc\/1322680\/\" id=\"a_2\">Section 7(9)<\/a> and, therefore, cannot be authorized to be disclosed.\n<\/p>\n<p id=\"p_6\">6.    The appeal is disposed of with these directions.\n<\/p>\n<p id=\"p_7\">7.
