1.\tHeard
\nparty-in-person Shri Chandrakant Gajnandrao Jalnapurkar, who is
\npersonally present before this Court and  learned AGP Mr.Maulik
\nNanavati for respondent No.1 and learned advocate Mr.M.M.Desai for
\nrespondent No.4.\n<\/p>\n
2.\tThe
\nprayers made in Para.8(a) and (b) is quoted as under:\n<\/p>\n
“8(a)
\n\tYour Lordship may be pleased to admit and allow this petition and be
\nfurther pleased to issue writ of mandamus and\/or any other
\nappropriate writ, order or direction in the nature of mandamus and be
\npleased to direct the respondent No.2 the services of the petitioners
\nconsidered as a protected teacher and grant the pensionary benefit of
\npetitioner. And further be pleased to direct the State Government of
\nallow the pensionary benefit of the petitioner.\n<\/p>\n
(b)\tYour
\nLordship may be pleased to set aside the order of Director of primary
\neducation on 29th June,2010.”\n<\/p>\n
3.\tParty-in-person
\nhas pointed out before this Court that in identical and similar facts
\nand circumstances of the case, similarly situated employee, in whose
\nfavour this Court has passed an order in SCA No.5242 of 1992 dated
\n12.8.1992. The order dated 12.8.1992 passed in SCA No.5242 of 1992 is
\nquoted as under :\n<\/p>\n
”\tThe
\npetitioner has challenged the order dated 29.11.1991 passed by the
\nPrimary Education Tribunal in application No.40 of 1990 by which it
\nis declared that the action of the petitioner school in not
\nconsidering the respondent Nanjibhai Tejabhai Solanki as full time
\nuntrained assistant teacher is unjust, arbitrary and illegal. The
\nTribunal has directed the petitioner school to treat the respondent
\nNanjibhai Solanki as full time untrained assistant teacher from
\n15.6.1964 to fix his salary taking into consideration the pay and
\nother allowances according to the Rules with effect from 22.5.1986 to
\npay the difference thereof after deducting the payment already made
\nto him within three months from date of said order, to consider his
\npay in the pay scale of Rs.950-1400\/-, to pay his salary with all
\nother allowances payable on 10th of every calendar month
\nand to make necessary entries in the service book of the respondent
\nteacher.\n<\/p>\n
2.\tAgainst
\nthe said order, a review application being Review Application No.2 of
\n1992 was filed. However, the Tribunal has rejected the same on
\n24.3.1992 on the ground that there is no error of law.\n<\/p>\n
3.\tIn
\nthis matter, Mr.H.M.Desai, learned advocate for the petitioner,
\nstates that the entire order passed by the tribunal is illegal
\ninasmuch as there is no provision for making part time teacher as
\nfull time teacher. It may be stated that in fact,t he practice of
\nappointing part time teacher was not proper and legal and therefore,
\nthe Director of Education, Gandhinagar had issued a circular dated
\n22.1.1964\t (Annexure-C) to all the Director  Primary Education
\nOfficers for giving necessary instructions to all the school
\nmanagements having part time teachers to treat them as full time
\nteacher. In view of the said circular, respondent – teacher
\nshould have been treated as a full time teacher and would have been
\npaid salary and other allowances as such. In fact, the action of the
\npetitioner school in keeping the respondent No.1 teacher as part time
\nteacher itself is not proper and he should have been appointed as
\nfull time teacher from the beginning.\n<\/p>\n
4.\tIn
\nthat view of the matter, the order passed by the Tribunal is in no
\nway erroneous. I therefore do not find any substance in the petition.
\nHence, it is rejected.\n<\/p>\n
4.\tIn
\nview of aforesaid observations made by this Court in case of
\nsimilarly situated person, let petitioner may make detailed
\nrepresentation to the Director of Primary Education, Gandhinagar,
\nwithin a period of one month from date of receiving copy of present
\norder.\n<\/p>\n
5.\tAs
\nand when  the Director of Primary Education, Gandhinagar receives
\nsuch representation from petitioner, it is directed to  the Director
\nof Primary Education, Gandhinagar to consider representation of
\npetitioner in light of observations made in order dated 12.8.1992
\npassed in  SCA No.5242 of 1992 and examine case of petitioner on
\nsimilar basis and then, to pass appropriate reasoned order, without
\nbeing influenced by order dated 29.6.2010 (Annxure-J, Page-45).\n<\/p>\n
6.\tIt
\nis made clear that the Director of Primary Education, Gandhinagar
\nshould have to decide independently irrespective of earlier decision
\ndated 29.6.2010 and consider strictly the decision which has been
\ngiven by this Court, as referred above and also the case of
\npetitioner sympathetically and then, to pass appropriate reasoned
\norder, within a period of 3 months from date of receiving copy of
\nrepresentation from petitioner and communicate the decision to
\npetitioner immediately.\n<\/p>\n
7.\tIn
\nview of aforesaid observations and directions, present petition is
\ndisposed of without expressing any opinion on merits. Direct service
\nis permitted.\n<\/p>\n
