No.476 of 2009 registered with Umra<br \/>\nPolice Station, Surat for the offences punishable under <a href=\"\/doc\/1317063\/\" id=\"a_1\">Sections 465<\/a>,<br \/>\n<a href=\"\/doc\/1985627\/\" id=\"a_2\">467<\/a>, <a href=\"\/doc\/556166\/\" id=\"a_3\">468<\/a>, <a href=\"\/doc\/1944660\/\" id=\"a_4\">384<\/a>, <a href=\"\/doc\/1897847\/\" id=\"a_5\">120-B<\/a> and <a href=\"\/doc\/112749\/\" id=\"a_6\">114<\/a> of the Indian Penal Code.\n<\/p>\n<p id=\"p_1\">2.\tAs<br \/>\nper the allegation made in the complaint dated 10.12.2009, the<br \/>\nincident took place in January, 2008 and October, 2008. The<br \/>\ncomplainant, who is a builder and agriculturist, has registered the<br \/>\nFIR with Umra Police Station alleging that he has purchased<br \/>\nagricultural land being old Survey No.434 and New Survey No.307 from<br \/>\nthe original land owners i.e. Maisuriya family by way of sale deed<br \/>\ndated 9.4.2003. In the month of October, 2008, the complainant<br \/>\nreceived telephone call from the present applicant and the applicant<br \/>\nthreatened the complainant that in the absence of meeting, the<br \/>\ncomplainant would have to repent because the original owners Naynaben<br \/>\nand Jagdishbhai Maisuria were regular visitors to the office of the<br \/>\napplicant. Thereafter, the complainant and his uncle Hitesh Ratilal<br \/>\nPatel went the office of applicant, where the applicant and advocate<br \/>\nMr. Modi were present. The applicant informed that the applicant<br \/>\nobtained the General Power of Attorney and Release-deed regarding the<br \/>\nsaid land treating the land as of clear title and asked the applicant<br \/>\nto pay Rs.1.5 Crores for treating the agreement with agriculturists<br \/>\nas cancelled. It is further alleged in the complaint by the<br \/>\ncomplainant that later on, he was informed that the original land<br \/>\nowners were asked to put the signature on certain documents by<br \/>\nVinubhai Malavia, advocate Mr. Modi, Naynaben Maisuria, Jagdishbhai<br \/>\nMaisuria by representing that they were advocates of the complainant,<br \/>\nthe power of attorney was obtained in favour of Naynaben and release<br \/>\ndocument was obtained in favour of Bhikhiben which all were notarized<br \/>\nwith Notary Mr. Dilip Desai on 10.1.2008, 20.6.2007 and 18.7.2007. It<br \/>\nis also alleged that the signatures were obtained on such bogus,<br \/>\nfalse documents of release deed and power of attorney by causing<br \/>\nmisunderstanding to the original owners and tried to grab the<br \/>\nvaluable land.\n<\/p>\n<p id=\"p_2\">3.\tLearned<br \/>\nSenior counsel Mr. B.B. Naik with Mr. N.M. Kapadia appearing for the<br \/>\napplicant, submitted that the applicant is an innocent person and<br \/>\nwrongly arraigned in the commission of the offence. There is no role<br \/>\nattributed to the applicant as reflected in the FIR or there is no<br \/>\nany direct or overt act on the part of the applicant. The dispute is<br \/>\npurely of civil nature and therefore, with malafide on the part of<br \/>\nthe complainant for abusing the process of law, criminal complaint is<br \/>\nfiled. He further submitted that on 2.6.2010, the applicant has filed<br \/>\nan affidavit in the present matter and declared that he has no<br \/>\nrelation with the said Survey No.434 and also has no any right over<br \/>\nthe same and he has never raised any right and will not raise any<br \/>\nright over the said land.\n<\/p>\n<p id=\"p_3\">4.\tLearned<br \/>\nSenior counsel Mr. Naik further submitted that in the complaint, name<br \/>\nof Naynaben is shown as accused, who has been released by the learned<br \/>\nAdditional Sessions Judge on anticipatory bail vide order 19.1.2010<br \/>\npassed in Criminal Misc. Application No.2408 of 2009. Therefore, the<br \/>\npresent application was required to be released on bail, but the<br \/>\nlearned Sessions Judge has not considered submissions made by the<br \/>\npresent applicant. He also contended that from the statement of<br \/>\nwitness  Mr.Manibhai, the ingredients of <a href=\"\/doc\/1985627\/\" id=\"a_7\">Section 467<\/a> cannot  come<br \/>\ninto force. Originally from<br \/>\nthe stamp paper of Naynaben, who is released on anticipatory bail,<br \/>\nthe provisions of <a href=\"\/doc\/1745798\/\" id=\"a_8\">Section 464<\/a> cannot be considered that the document<br \/>\nis forged and fabricated. It is contended by the learned<br \/>\nSenior Counsel that the investigation is also over and availability<br \/>\nof applicant during trial can be secured and there is no chance of<br \/>\ntampering with the evidence by the applicant. Therefore, the<br \/>\napplicant may kindly be released on bail.\n<\/p>\n<p id=\"p_4\">5.\tMr.\n<\/p>\n<p id=\"p_5\">S.V. Raju with Mr. Munshi for the complainant submitted that the<br \/>\napplicant is involved in a serious offence and there is a huge amount<br \/>\nof transaction and thereby, the applicant has committed offence. He<br \/>\nhas read the order of the learned Sessions Court and therefore, the<br \/>\napplicant may not be granted bail.\n<\/p>\n<p id=\"p_6\">6.\tMr.\n<\/p>\n<p id=\"p_7\">H.L. Jani, learned APP for the respondent   State, submitted that<br \/>\nthe applicant is involved in the offence which is punishable under<br \/>\n<a href=\"\/doc\/1317063\/\" id=\"a_9\">Sections 465<\/a>, <a href=\"\/doc\/1985627\/\" id=\"a_10\">467<\/a>, <a href=\"\/doc\/556166\/\" id=\"a_11\">468<\/a>, <a href=\"\/doc\/1944660\/\" id=\"a_12\">384<\/a>, <a href=\"\/doc\/1897847\/\" id=\"a_13\">120-B<\/a> and <a href=\"\/doc\/112749\/\" id=\"a_14\">114<\/a> of the Indian Penal Code<br \/>\nand considering the seriousness of the offence, gravity and<br \/>\npunishment of the offence, the applicant is not entitled to release<br \/>\non bail. Therefore, discretion may not be exercise in favour of the<br \/>\napplicant.\n<\/p>\n<p id=\"p_8\">7.<br \/>\n\tI have perused the application along with papers produced before me<br \/>\nand submissions made by both the parties. It appears that against the<br \/>\npresent applicant, the complaint is filed for the offences punishable<br \/>\nunder <a href=\"\/doc\/1317063\/\" id=\"a_15\">Sections  465<\/a>, <a href=\"\/doc\/1985627\/\" id=\"a_16\">467<\/a>, <a href=\"\/doc\/556166\/\" id=\"a_17\">468<\/a>, <a href=\"\/doc\/1944660\/\" id=\"a_18\">384<\/a>, <a href=\"\/doc\/1897847\/\" id=\"a_19\">120-B<\/a> and <a href=\"\/doc\/112749\/\" id=\"a_20\">114<\/a> of the Indian Penal<br \/>\nCode and\tI have considered the main ingredients of the aforesaid<br \/>\nsections, quantum of punishment, gravity of the offence etc. The<br \/>\npresent applicant has prepared false document with a view to grab<br \/>\nhuge amount by preparing false document with respect to the property<br \/>\nbelonging to the complainant. Prima facie, it appears that the<br \/>\napplicant is involved in the commission of offence of forgery of<br \/>\nvaluable security just for the purpose of cheating. It is also on<br \/>\nrecord that the complainant was threatened by the applicant and other<br \/>\naccused persons and put under fear to deliver the property<br \/>\ndishonestly by way of observation. Even from the papers, I have also<br \/>\nfound that prima facie, there was conspiracy for getting of the huge<br \/>\namount illegally from the complainant by the applicant and other<br \/>\nconspirators and agreement executed by them. No doubt, affidavit has<br \/>\nbeen filed by the applicant in connection of his right but it appears<br \/>\nthat it is only made with a view to come out from the alleged<br \/>\noffence.\n<\/p>\n<p id=\"p_9\">8.\tSo,<br \/>\nfrom the above observation, it is established on record that prima<br \/>\nfacie case is made out against the applicant. Now a days, illegal<br \/>\nactivities of grabbing the land is always committed by the land mafia<br \/>\nand just to protect the right of the original owner or purchaser,<br \/>\ncannot be considered any lenient view. Hence, I am of the opinion<br \/>\nthat sufficient evidence is produced on record. Hence, the<br \/>\napplication is dismissed.
