Secretary (CPIO)\n                                 &amp; Shri Kishan Pal, Under Secretary)\n\nDate of Hearing         :        26.10.2009\n\nDate of Decision        :        26.10.2009\n\nFACTS<\/pre>\n<p id=\"p_1\"> :\n<\/p>\n<p id=\"p_1\">        By his letter of 15.1.2009, the appellant had sought information on<br \/>\n05 paras relating to the processing of suitable officers for the post of Addl.<br \/>\nDirector General in the Bureau of Indian Standards. The appellant had also<br \/>\nrequested for inspection of the file in which the matter was processed and<br \/>\nalso to allow him to take extracts there from.\n<\/p>\n<p id=\"p_2\">2.     This was responded to by CPIO vide letter dated 13.2.2009 wherein<br \/>\npara-wise information was provided to the appellant. However, as regards<br \/>\nthe inspection of the relevant file, the CPIO had refused to permit<br \/>\ninspection in terms of section 8 (1) (i) of the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>. The Appellate<br \/>\nAuthority had affirmed the decision of CPIO vide letter dated 9.4.2009.\n<\/p>\n<p id=\"p_3\">3.     The present appeal is directed against the orders of the CPIO\/AA.\n<\/p>\n<p id=\"p_4\">4.     Heard on 26.10.2009. Appellant present. The public authority is<br \/>\nrepresented by the officers named above. During the hearing, the appellant<br \/>\npleads that the stand taken by the CPIO and the Appellate Authority that<br \/>\nthe inspection of the relevant file can not be permitted in terms of <a href=\"\/doc\/758550\/\" id=\"a_1\">section 8<\/a><br \/>\n(1) (i) of the <a href=\"\/doc\/671631\/\" id=\"a_2\">RTI Act<\/a> is not sustainable in law. He draws the<br \/>\nCommission&#8217;s attention to the proviso appended to clause (i) of <a href=\"\/doc\/758550\/\" id=\"a_3\">Section 8<\/a><br \/>\n(1) which provides for disclosure of the decisions of the Council of<br \/>\nMinister and the reasons thereof once decisions have been taken.\n<\/p>\n<p id=\"p_5\">5.     The appellant also draws my attention to several decisions of this<br \/>\nCommission in this regard wherein the cabinet papers etc have been<br \/>\nallowed to be disclosed.         One such case is Appeal No.<br \/>\nCIC\/WB\/A\/2008\/00081decided on 23.10.2008 (P.D. Khandelwal Vs<br \/>\nDoPT) wherein the Commission had held as follows :-<br \/>\n&#8220;6.    From a plain reading of the above provisos, the following may<br \/>\nbe inferred :-\n<\/p>\n<p id=\"p_6\"> (i)    &#8220;Cabinet papers, which include the records of deliberations of<br \/>\n       the Council of Ministers, Secretaries and other officers shall be<br \/>\n       disclosed after the decision has been taken and the matter is<br \/>\n       complete or over.\n<\/p>\n<p id=\"p_7\">(ii)   The matters which are otherwise exempted under <a href=\"\/doc\/758550\/\" id=\"a_4\">Section 8<\/a> shall<br \/>\n       not be disclosed even after the decision has been taken and the<br \/>\n       matter is complete or over.\n<\/p>\n<p id=\"p_8\">(iii) Every decision of the Council of Ministers is a decision of the<br \/>\n       Cabinet as all Cabinet Ministers are also a part of the Council of<br \/>\n       Ministers. The Ministers of State are also a part of the Council<br \/>\n       of Ministers, but they are not Cabinet Ministers.<br \/>\n       As we have observed above, the plea taken by the First<br \/>\nAppellate Authority the decision of the Council of Ministers are<br \/>\ndisclosable but Cabinet papers are not, is totally untenable. Every<br \/>\ndecision of the Council of Ministers is a decision of the Cabinet and, as<br \/>\nsuch, all records concerning such decision or related thereto shall fall<br \/>\nwithin the category of &#8220;Cabinet Papers&#8221; and, as such, disclosable<br \/>\nunder <a href=\"\/doc\/758550\/\" id=\"a_5\">Section 8<\/a> (1) sub-section (i) after the decision is taken and the<br \/>\nmatter is complete, and over.&#8221;\n<\/p>\n<p id=\"p_9\">6.     The appellant has also drawn my attention to two other cases<br \/>\ndecided by this Commission viz. Appeal No. CIC\/WB\/A\/2009\/000108<br \/>\ndecided on 28.7.2009 (A.K. Saxena Vs DoPT) and Appeal No.<br \/>\nCIC\/WB\/A\/2007\/01612 decided on 20.4.2009 (R.K. Tyagi Vs DoPT)<br \/>\nwherein disclosures were allowed on the authority of Khandelwal case<br \/>\nreferred to above. It is, thus, the plea of the appellant that decisions of the<br \/>\nCPIO and the Appellate Authority in not permitting him inspection of the<br \/>\nrelevant records and taking extracts there from are not sustainable in law.\n<\/p>\n<p id=\"p_10\">7.     On the other hand, it is the submission of Shri Pillai that the<br \/>\ndecision of the Appointments Committee of the Cabinet has already been<br \/>\nintimated to the appellant and as such the direction of law has been<br \/>\ncomplied with. As regards the inspection of the relevant records, he would<br \/>\nsubmit that clause (i) of <a href=\"\/doc\/1001313\/\" id=\"a_6\">section 8(1)<\/a> does not specifically provide that<br \/>\ninspection should be given to the appellant.\n<\/p>\n<p id=\"p_11\">                                DECISION\n<\/p>\n<p id=\"p_12\">8.     Clause (i) and proviso attached thereto is extracted below :-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>       &#8220;(i) cabinet papers including records of deliberations of the<br \/>\n       Council of Ministers, Secretaries and other officers:\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>              Provided that the decisions of Council of Ministers, the<br \/>\n       reasons thereof, and the material on the basis of which the<br \/>\n       decisions were taken shall be made public after the decision has<br \/>\n       been taken, and the matter is complete, or over:\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>              Provided further that those matters which come under<br \/>\n       the exemptions specified in this section shall not be disclosed.&#8221;<\/p><\/blockquote>\n<p id=\"p_13\">        A bare rading of it would indicate that the decisions of the Council<br \/>\nof Ministers are disclosable after the decisions have been taken, as is the<br \/>\ncase in the matter in hand.\n<\/p>\n<p id=\"p_14\">9.     I have also perused the decisions of this Commission referred to<br \/>\nabove wherein it has been categorically laid down that Cabinet Papers are<br \/>\ndisclosable once decisions have been taken. The decisions of the<br \/>\nCommission are in conformity with the statutory provisions. As to the<br \/>\npoint raised by Shri Pillai that the clause (i) does not specifically provide<br \/>\nfor inspection of documents etc, suffice to say that the text of the statute is<br \/>\nrequired to be interpreted in the proper context. When the proviso provides<br \/>\nfor disclosure of information, it ipso facto also provides for giving<br \/>\ninspection to the requester. Viewed thus, the plea taken by Shri Pillai does<br \/>\nnot have merit.\n<\/p>\n<p id=\"p_15\">                                DECISION\n<\/p>\n<p id=\"p_16\">10.    In view of the above, the CPIO is hereby directed to permit the<br \/>\nappellant to carry out inspection of the relevant files and also to provide<br \/>\nhim copies of documents on the payment of the prescribed fee.\n<\/p>\n<p id=\"p_17\">11.
