No.15942 of 2011\n                           Babloo Yadav, son of Nageshwar Yadav\n                                            Versus\n                                    The State Of Bihar\n                                          -----------\n<\/pre>\n<p id=\"p_1\">3.   26.7.2011                 Heard learned counsel for the petitioner and the<\/p>\n<p>                 State.\n<\/p>\n<p id=\"p_1\">                               The petitioner seeks anticipatory bail in a case<\/p>\n<p>                 instituted for the offence under <a href=\"\/doc\/1560742\/\" id=\"a_1\">Sections 302<\/a>\/<a href=\"\/doc\/37788\/\" id=\"a_1\">34<\/a> of the Indian<\/p>\n<p>                 Penal Code.\n<\/p>\n<p id=\"p_2\">                               It is submitted that there is no eye witness to the<\/p>\n<p>                 occurrence and the only allegation against the petitioner apart<\/p>\n<p>                 from vague suspicion based on speculated motive, there is no<\/p>\n<p>                 further material against him.\n<\/p>\n<p id=\"p_3\">                             In view of such, let the petitioner in the event of<\/p>\n<p>                 surrender, named above, within four weeks from the date of<\/p>\n<p>                 receipt of this order, in connection with Dharhara P.S. Case No.<\/p>\n<p>                 93 of 2010, shall be released on anticipatory bail on furnishing<\/p>\n<p>                 bail bond of Rs. 5,000\/- (Five thousand) with two sureties of the<\/p>\n<p>                 like amount each to the satisfaction of Chief Judicial Magistrate,<\/p>\n<p>                 Munger, subject to conditions as laid down under <a href=\"\/doc\/1692057\/\" id=\"a_2\">Section<\/p>\n<p>                 438(2)<\/a> Cr. P.C., and (i) That one of the bailors will be a close<\/p>\n<p>                 relative of the petitioner, who will give an affidavit giving<\/p>\n<p>                 genealogy as to how he is related with the petitioner. The bailor<\/p>\n<p>                 will undertake to furnish information to the court about any<\/p>\n<p>                 change in the address of the petitioner. (ii) That the affidavit<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               2<\/span><\/p>\n<p>        shall clearly state that the petitioner is not an accused in any<\/p>\n<p>        other case and, if he is, he shall not be released on bail. (iii)<\/p>\n<p>        That the bailor shall also state on affidavit that he will inform the<\/p>\n<p>        court concerned if the petitioner is implicated in any other case<\/p>\n<p>        of similar nature after his release in the present case and<\/p>\n<p>        thereafter the court below will be at liberty to initiate the<\/p>\n<p>        proceeding for cancellation of bail on the ground of misuse. (iv)<\/p>\n<p>        That the petitioner will give an undertaking that he will receive<\/p>\n<p>        the police papers on the given date and be present on date<\/p>\n<p>        fixed for charge and if he fails to do so on two given dates and<\/p>\n<p>        delays the trial in any manner, his bail will be liable to be<\/p>\n<p>        cancelled for reasons of misuse.
