Mr.So.Paramasivam\n\t\t      Government Advocate\n\t\t\t\n:JUDGMENT\n<\/pre>\n<p id=\"p_1\">\tThis second appeal is focussed as against the  judgment and decree dated<br \/>\n23.11.1998 in A.S.No.32 of 1998 on the file of the learned Subordinate Judge,<br \/>\nDindugal in confirming the judgment and decree dated 18.09.1997 in O.S.No.679 of<br \/>\n1994 on the file of the learned Principal District Munsif, Dindugal.\n<\/p>\n<p id=\"p_1\">\t2. Being aggrieved by the concurrent finding of both the Courts below, the<br \/>\nplaintiff filed this second appeal on the ground that the plaintiff suit for<br \/>\ndeclaring his caste status was erroneously dismissed by both the Courts below.\n<\/p>\n<p id=\"p_2\">\t3. The following substantial question of law was framed by my learned<br \/>\nPredecessor at the time of admitting this second appeal:<br \/>\n\t&#8220;Whether the civil Court has no jurisdiction to decide the issue in<br \/>\nquestion in view of the Judgment reported in 2000-2-L.W.Page 495?&#8221;\n<\/p>\n<p id=\"p_3\">\t4. Heard both sides.\n<\/p>\n<p id=\"p_4\">\t5. My mind is redolent with the Full Bench decision of this Court in<br \/>\n<a href=\"\/doc\/96038845\/\" id=\"a_1\">P.Maragathamani v. General Manager(In-charge), Bharat Heavy Electricals Limited,<br \/>\nTrichy Complex, Tiruchirapalli-14 and others<\/a> reported in 2006(1)CTC 497.  An<br \/>\nexcerpt from it would run thus:\n<\/p>\n<p id=\"p_5\">\t&#8220;38. This contention also, in our view, is not tenable, for the reason<br \/>\nthat the ratio decidendi, decided by the Supreme Court, taking into<br \/>\nconsideration the importance of the disposal of the claims with regard to<br \/>\ncommunity certificates by the Scrutiny Committee, would amount to the law<br \/>\nlegislated by the Judiciary.  Further, on the basis of judicial directions, the<br \/>\nGovernment has passed relevant orders, appointing various committees at the<br \/>\nDistrict Level and the State Level.  If  the orders passed by the authorities at<br \/>\nthe District level and at the State level would not satisfy the parties, then,<br \/>\nthe said orders can be challenged under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution in the<br \/>\nHigh Court, which again will be challenged under <a href=\"\/doc\/427855\/\" id=\"a_2\">Article 136<\/a> in the Supreme<br \/>\nCourt.  Enactment, if made, would bar the civil jurisdiction expressly.  But, in<br \/>\nthis case, we are concerned with implied bar, which is inbuilt.\n<\/p>\n<p id=\"p_6\">\t39. When the Civil Court has no jurisdiction, then it goes without saying<br \/>\nthat the decree passed by the Civil Court Without Jurisdiction is a nullity.<br \/>\nThe Supreme Court, in <a href=\"\/doc\/89704603\/\" id=\"a_3\">Secretary, Ministry of Chemicals and Fertilizers,<br \/>\nGovernment of India v. Cipla Ltd, and others<\/a>, 2003(7) SCC 1, held that an order,<br \/>\nwhich lacks inherent jurisdiction, would be a nullity and, thus, the procedural<br \/>\nlaw of waiver or estoppel would have no application in such a situation.  The<br \/>\nsame view has been taken by the Supreme Court in subsequent judgments Dwaraka<br \/>\nPrasad Agarwal (D) by L.Rs. and another v. B.D. Agarwal &amp; Others, 2003(6) SCC<br \/>\n230; <a href=\"\/doc\/121162\/\" id=\"a_4\">Ashok Leyland Ltd v. State of Tamil Nadu and another<\/a>, 2004(3) SCC 1; and<br \/>\n<a href=\"\/doc\/231673\/\" id=\"a_5\">MD, Army Welfare Housing Organisation v. Sumangal Services (P) Ltd<\/a>., 2004(9) SCC\n<\/p>\n<p id=\"p_7\">619.  Therefore, any decree granted by the Civil Court, declaring that a person<br \/>\nbelongs to a particular community and a mandatory injunction to grant community<br \/>\ncertificate to that effect is a nullity and cannot be enforced, since the Civil<br \/>\nCourt has no jurisdiction to entertain the suit, as its jurisdiction is<br \/>\nimpliedly ousted.\n<\/p>\n<p id=\"p_8\">&#8230; &#8230; &#8230;\n<\/p>\n<p id=\"p_9\">\t43.Sum up-\n<\/p>\n<p id=\"p_10\">\t(1)Suit in Civil Court for declaration that a person belongs to a<br \/>\nparticular community and for mandatory injunction, directing the authorities to<br \/>\nissue community certificate in pursuance of the said declaration, is not<br \/>\nmaintainable; the decree in the said suit is a nullity and, as such, it is not<br \/>\nbinding on the authorities.\n<\/p>\n<p id=\"p_11\">\t(2) Decision of the Division Bench of this Court in <a href=\"\/doc\/103855076\/\" id=\"a_6\">Union of India v. The<br \/>\nRegistrar, Central Administrative Tribunal, Chennai<\/a>, 2002 (3) CTC 411, holding<br \/>\nthat the learned single Judges&#8217; decision that the suit is maintainable must be<br \/>\nregarded as per incuriam, is upheld.\n<\/p>\n<p id=\"p_12\">\t(3) Writ Petitions are dismissed.  No costs&#8221;.\n<\/p>\n<p id=\"p_13\">\t6. It is explicitly clear that a suit will not lie for the purpose of<br \/>\ndeclaring the caste status of a particular individual of this nature.<br \/>\nAccordingly, I could see no merit in this second appeal and accordingly, the<br \/>\nsubstantial question of law is answered.\n<\/p>\n<p id=\"p_14\">\t7. In the result, there is no merit in the second appeal and the same is<br \/>\ndismissed, confirming the judgments and decrees of both the Courts below.<br \/>\nHowever, in the facts and circumstances of the case, there is no order as to<br \/>\ncosts.\n<\/p>\n<p id=\"p_15\">smn<\/p>\n<p>To<\/p>\n<p id=\"p_16\">1.
