7. Respondents have filed the objection<\/p>\n
statement in the Claims Tribunal as under:
\nAverments made in the claim petition were all<\/p>\n
denied. The alleged accident took place due to.th-e_l’1?ash<\/p>\n
and negligent driving by the driver of <\/p>\n
No.C.’i’.G–1004 is denied. The tregatment’vtjaiieririihy the’<\/p>\n
minor claimant is also denied. <\/p>\n
8. The sum and sub_stance_lof   <\/p>\n
Claims Tribunal is as under;\n<\/p>\n
 “Tri’i’31gii1ai relying on the oral evidence<\/p>\n
of PW\u00a5.l and  evidence viz., Ex.P–1<\/p>\n
  certi\ufb01edcopy of complaint have come to a<\/p>\n
 ce:nlclti\u00a3S.ior1.. thaltllthelaccident occurred due to the rash<\/p>\n
  and 1  driving of the driver of car bearing<\/p>\n
 The Claims Tribunal has awarded a<\/p>\n
 Acompentsation of Rs.36,400\/– with interest at 6% per<\/p>\n
  annfum from the date of judgment.<\/p>\n

\nhas preferred this appeal seeking enhancement of<\/p>\n

F.I.R, Ex.P~2 Complaint have coineito a conchisiionj <\/p>\n
the driver of the vehicle in (ii1!%s’tion drove *the’:’vehic1e in

\ntaken contention thatntiiere   negligence<\/p>\n
on thei’part’:iieof   but they have not
\nadduc’ed:the  driver of the car. Normally<\/p>\n

  is so far as accident is concerned is<\/p>\n
based appreciation of evidence and does not call for<\/p>\n

“Whether the compensation awarded by the
\nClaims Tribunal is reasonable or seeks<\/p>\n
enhancement?”\n<\/p>\n

It is the contention of the<\/p>\n
appellant that the claimant has illsustainedlaceratedvy<\/p>\n
injury over the left frontallllftegion oflllthethealdg 2″ x 1\/2″
\nskin deep. The  the injury No.3 is
\ngrievous in nature.   of the learned<\/p>\n
counsel  that the Claims Tribunal has
\nover leekea .,E$<,.1:$;a_";j_isabi1ity Certificate wherein the<\/p>\n
 vvyhasllsustained permanent partial disability of<\/p>\n
 V  limb at 40% and whole body disability is<\/p>\n
  is the X~ray report. Its contents disclose<\/p>\n
 that claimant has sustained following injuries:<\/p>\n

i. Old healed fracture of mid shaft of left femur
\nnoted.\n<\/p>\n
ii. No lytic or sclerotic lesion seen in femur.<\/p>\n
iii. No cafci\ufb01cation or foreign body seen .p’i’n_s0ft<\/p>\n
tissues.\n<\/p>\n
iv. Cortex medulla of femur are nor1i’:–a1.Ai     A ~<\/p>\n
Therefore he seeks for enhancjern’en’t0V __0f’ <\/p>\n
compensation amount.\n<\/p>\n

Ex.AP\u00ab4  ddtierti\ufb01cate. The wound certi\ufb01cate<\/p>\n
 disclosesthat  c1aimant~So1’1aba1′ was treated at<\/p>\n
 :C.’:eneral..d.vIFf0’spitai, Humnabad on 09.02.2002 and she<\/p>\n
has sustained Contusion of size 3″ x 2″ over the left<\/p>\n
  Z Abrasion over the right foot 3″ x 1″ bleeding<\/p>\n
‘  Lacerated injuiy over the left frontal region of<\/p>\n
{y<\/p>\n
_ 3 –\n<\/p>\n
the head 2″ X 3\/2″ skin deep. According to the opinion of<\/p>\n
the doctor the injury No.1 is grievous in nature. Injury
\nNos.2 and 3 are simple in nature. Age of the injury<\/p>\n
No.1 is 2 hours.\n<\/p>\n
15. EX.P–6 is the Disability Certi\ufb01cate   <\/p>\n
Dr.V.S.Sajjanshetty, Orthopedic \u00bbAA\u00bbS.t,14rgeo~Vr’1H,l ” Ill!” 2<\/p>\n
Its content discloses that <\/p>\n
Bansi, R\/0 Vasar is aged -about l’3.__years.: ‘on her”<\/p>\n
physical and radiological elxairninationslor1–..’2.2\u00a7,03.20O5<\/p>\n
discloses that, modergiteiyi.lV1″yvasted\u00bb.VL”left thigh with<\/p>\n
restricted mo\\i”ernler1’tsfvof    Shortening of
\nthe limb by   partiaily bent
\nfemur. Partial loss  ‘power  the limb, not able to<\/p>\n
walk  E”S”L]pVV’I;\\(‘)’I’t ofm\ufb02stick properly. Permanent<\/p>\n
partial   lower limb is 40% and whole<\/p>\n
 disability  .\n<\/p>\n

EXP-8 X–ray Report. in my View the claimant is entitled
\nfor a compensation of Rs.22,000\/- under the head of<\/p>\n
pain and suffering.\n<\/p>\n
19. After the accident the  <\/p>\n
Walk without the help of stick,  lllsufferetill <\/p>\n
mentally. bodily pain. Thie.re1s’l <\/p>\n
enjoyment of life by the  A’I*he1’efor.el e._o’nsid’ering V it<\/p>\n
this aspect, in my View — is “awarded under<\/p>\n
the head of loss of amlen_i’tie’S.,V  f<\/p>\n
3:20.’ _A is the resident of Washer<\/p>\n
Tanda.”   The claimant has taken<\/p>\n
  Venkateshwar Clinic, Hurnnabad and also at<\/p>\n
 . ;l’l1’ereiore the claimant has taken treatment<\/p>\n
at”‘differe’n”t places and since she was a minor and she<\/p>\n
V.   has gotsdif\ufb01culty in walking to attend different hospitals<\/p>\n
em”\n<\/p>\n
for treatment at different places. on attendant has to
\naccompany her to hospital therefrom the claimant is
\nentitled for compensation of Rs.5,000\/- under the head
\nof conveyance expenses, nourishment <\/p>\n
attendant charges.\n<\/p>\n
21. Considering that the  <\/p>\n
treatment at General    <\/p>\n
Venkateshwar Clinic at l?i’LirI1riabad~. :_laIi’d .l’3f(~ray at
\nGulbarga, she has prodduicedLiniedicallf hills Worth<\/p>\n
about Rs.6,395_\/–  into acc?o:int;j_–treatrnent taken<\/p>\n
on dizvfferent\ufb01medifcal .ce~nters.and also medical bills, it is
\njust and g reaso.nable__l””\u00abt’o award compensation of<\/p>\n
Cl!  the head of medical expenses.<\/p>\n
 .:’vf’The claimant was a girl. aged about 10 years<\/p>\n
 ,;)ln._VthVe accident. Due to the accident she has<\/p>\n
sustained “fracture of mid shaft of left femur noted and<\/p>\n
it  also there is some dis\ufb01gurement in the leg. Considering<\/p>\n
