Justice K.T.SANKARAN\n\n Dated :31\/03\/2010\n\n O R D E R\n                          K.T.SANKARAN, J.\n             ------------------------------------------------------\n\n                       B.A. NO. 1869 OF 2010\n\n             ------------------------------------------------------\n\n             Dated this the 31st day of March, 2010\n\n\n                                O R D E R\n<\/pre>\n<p id=\"p_1\">      This is an application for bail under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of the Code of<\/p>\n<p>Criminal Procedure. The petitioner is the accused in C.R. No.11 of<\/p>\n<p>2010 of Chengannur Excise Range.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">      2. The offence alleged against the petitioner is under <a href=\"\/doc\/1308622\/\" id=\"a_1\">Section<\/p>\n<p>8(1)<\/a> and (2) of the Abkari Act.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">      3. The prosecution case is that on 13.3.2010, the petitioner<\/p>\n<p>was found in possession of one litre of arrack. The petitioner was<\/p>\n<p>arrested on 13.3.2010 and he was remanded to judicial custody.<\/p>\n<p id=\"p_5\">      4. Learned Public Prosecutor submitted that the petitioner is<\/p>\n<p>involved in four other cases of similar nature.<\/p>\n<p id=\"p_6\">      5. It is submitted by the learned counsel for the petitioner that<\/p>\n<p>B.A. NO. 1869 OF 2010<\/p>\n<p>                                       :: 2 ::\n<\/p>\n<p id=\"p_7\">the petitioner undertakes not to commit any offence of similar nature<\/p>\n<p>while on bail in the present case.             The above undertaking is<\/p>\n<p>recorded.\n<\/p>\n<p id=\"p_8\">\n<p id=\"p_9\">      6.   Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the petitioner,<\/p>\n<p>the nature of the offence and the present stage of investigation, I am<\/p>\n<p>of the view that bail can be granted to the petitioner.<\/p>\n<p id=\"p_10\">      7. The petitioner shall be released on bail on his executing<\/p>\n<p>bond for Rs.25,000\/- with two solvent sureties for the like amount to<\/p>\n<p>the satisfaction of the Judicial Magistrate of the First         Class,<\/p>\n<p>Chengannur, subject to the following conditions:<\/p>\n<blockquote id=\"blockquote_1\"><p>       a)    The petitioner shall report before the investigating officer<br \/>\n             between 9 A.M.        and 11 A.M. on all Mondays, till the<br \/>\n             final report is filed or until further orders;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>       b)    The petitioner shall appear before the investigating<br \/>\n             officer for interrogation as and when required;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>       c)    The petitioner shall not try to influence the prosecution<br \/>\n             witnesses or tamper with the evidence;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>       d)    The petitioner shall not commit any offence or indulge in<br \/>\n             any prejudicial activity while on bail;\n<\/p><\/blockquote>\n<p id=\"p_11\">B.A. NO. 1869 OF 2010<\/p>\n<p>                                   :: 3 ::\n<\/p>\n<p id=\"p_12\">\n<p id=\"p_13\">      e)    In case of breach of any of the conditions mentioned<br \/>\n            above, the bail shall be liable to be cancelled.<\/p>\n<p>      The Bail Application is allowed as above.<\/p>\n<p id=\"p_14\">                                                   (K.T.SANKARAN)<br \/>\n                                                          Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Omanakuttan vs State Of Kerala Represented By The on 31 March, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 1869 of 2010() 1.
