On 2.5.1998&#8211;fii2\u00abt:&#8217;t&#8217;he__&#8217;<\/p>\n<p>morning, it is alleged that the accused had <\/p>\n<p>house of N13 and over an altercati,ont_he <\/p>\n<p>husband and wife, he stabbed her \u00a7i=i,th:da  <\/p>\n<p>her crim, when people were attracted, it&#8221;is__alie\u00a7e&#8217;d&#8217;7th&#8217;atVVt&#8217;he<br \/>\naccused ran away with the wea,o\u00abp\u00a7&#8221;rf:v._ &#8216;thereafter,  was<br \/>\nshifted to a hospital wherxeixn.as&#8217;~i_t iegal case,<br \/>\non receipt of the if\ufb01o__rmatio&#8217;n,&#8217;  police go to<\/p>\n<p>the hospital, \u00a7.rec&#8217;nrd&#8217;:.:h.er&#8221;etatetneet \u00a7&#8217;avn&#8217;d_ the basis of the<\/p>\n<p>same, aiicasex &#8216;iSl:o&#8221;.-.\u00a72;f1_&#8217;998 is registered for the<\/p>\n<p>offences under  324, 504, 505 <a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a> and<\/p>\n<p>investigavtion  &#8216;taken up.  Statement of the neighbours,<\/p>\n<p>:&#8217;vj._V.relati&#8217;ves ~r_ecordVedA.A Necessary mahazar iike spot<\/p>\n<p>in the presence of the independent<\/p>\n<p>2  _witnAe&#8217;eses__,&#8221; &#8216; Search for the accused is carried out. He is<\/p>\n<p>&#8216;&#8221;&#8221;:l&#8221;farrested.&#8221;and on interrogation, alleged to have made<\/p>\n<p>  statement ieading to the discovery of the<\/p>\n<p>&#8221; &#8220;if-eteaipon, the same is seized and on completion of the<\/p>\n<p> &#8216;iinvestigation and receipt of the records, including the<\/p>\n<p>wound certi\ufb01cate, charge sheet is \ufb01led. The tria! Court on<\/p>\n<p>K<\/p>\n<p><a href=\"\/doc\/895891\/\" id=\"a_1\">Section 320<\/a> of IPC. These injuries do not specify as<\/p>\n<p>criteria laid down under <a href=\"\/doc\/915147\/\" id=\"a_2\">Section 2<\/a> to become  <\/p>\n<p>nature. As such, though the lnvfestigatinfjWesgjeincyix&#8217; has  it<\/p>\n<p>rightly framed charge under <\/p>\n<p>accused, there is mistake in  Atvhe.ch,erg\u00e9:.,;e&#8217;\u00a7eiiist<br \/>\nthe accused for the offence under:..Sectio.n s2&#8217;6-{PISS That<br \/>\nhowever, should not deter&#8217;   whether the<br \/>\nprosecution has iiiede outi&#8217; ctiriuiction of the<br \/>\naccused Mr  iris we noted that any<\/p>\n<p>mistakeiin _frarri&#8217;i.ng,,_ t\u00abh,e&#8221;-&#8216;recharge will not enure to the<\/p>\n<p>bene\ufb01t ofthe accuVsed.,&#8217;as&#8221;&#8216;p.e:r&#8217; Section 215 Cr.i&gt;.C. unless it .<\/p>\n<p>is Shilitfiili thatxwro_nig&#8217;1 framing of the charge or erroneous<\/p>\n<p>  charge,&#8217; has prejudiced the case of the<\/p>\n<p> noting the fact that in our view, the<\/p>\n<p>i  _charg&#8221;e is..__vo&#8217;flesser degree than the one framed, there is<\/p>\n<p>&#8216; ..injpezdiirhent for us to consider the same. We have also<\/p>\n<p> ,.i\u00a7eo&#8217;t\u00bb&#8211;in\u00e9i&#8221;mind the well laid principles of interference by the<\/p>\n<p> &#8216;:&#8217;_4&#8217;~Vap;3\u00a7ellate Court with the judgment of acqauittals passed by<\/p>\n<p>it  &#8221; &#8220;the trial Court, i.e., to say, even if two alternate views are<\/p>\n<p>possible, the appelaite Court shoutd not interfere with the<\/p>\n<p>it\/&#8217;<\/p>\n<p> \\\u00a7\u00a2&#8217;e,_._ha\\IAe&#8221;&#8221;&#8216;the evidence of the doctor PW.10<br \/>\n far as the injuries are concerned,<\/p>\n<p>  _ remaih  It is reievant to note neither there is<br \/>\nVsugzgestion to this doctor that these injuries are self<br \/>\nit   nor any suggestion put to any of the witnesses to<br \/>\n that the victim PW.3 had any other enemy, who<\/p>\n<p>  ecouid have caused these injuries. in the absence of such<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">11<\/span><\/p>\n<p>injuries and attracted by her cries, the neighbours,&#8221;:.:hei*~.V<br \/>\nfather came to the spot, she was taken to the   H<br \/>\nher statement came to be recorded:-irithe   the<br \/>\ncross-examination, it is eiicited<br \/>\nher husband 10 years baci&lt;V\u00bba:;:jfVa..,waAs&#039; stayinjg  her<br \/>\nparents. The other suggestions&quot;&#039;aVs&#039;i_;toitthe prese-ncei of the<br \/>\naccused or bringing theEi&lt;ni_fe&quot;&#039;w.ift&#039;|&quot;!:&#039; V&#039;anti&#8211;.&#039;.that she has<br \/>\ngiven the compiaijnt  by her.\n<\/p>\n<p id=\"p_1\">What is    spite of searching<br \/>\ncross  to the arrival of_ the<br \/>\naccused,&#8217;A&#8217;a\u00a7t,ercatien&#8217; by the accused with a<\/p>\n<p>knife, ; is inotudisturbedv;  So far as the injuries are<\/p>\n<p>material, in our view, the uncorroborated testimony of the<\/p>\n<p>5\/&#8221;\n<\/p>\n<p id=\"p_2\">\n<p><span class=\"hidden_text\" id=\"span_1\">12<\/span><\/p>\n<p>injured, if it inspires confidence in the mind of the Court,<\/p>\n<p>was to be accepted. The trial Court white consi\u00abde&#8217;ring&#8221;&#8216;a:&#8217;her4 3<\/p>\n<p>evidence, has rejected the same on the ground ofjjnon  &#8216;<\/p>\n<p>corroboration and discrepancies.\n<\/p>\n<p id=\"p_3\">her evidence is accpetable as<br \/>\ncorroboration. In our vieteg this discrepancy<\/p>\n<p>  tfirne  !.iyl&#8217;i_:{. not go much against the prosecution and<\/p>\n<p>the,\u00e9vidence,.&#8217;especially, when the witnesses are rustic<\/p>\n<p>%l&#8221;~.-t.._&#8217;_&#8217;v-viiiagefawand unlike the urban peopie, who always refer to<\/p>\n<p>   or clocks to state the time factor, their<\/p>\n<p>&#8216;  assessment of time would be roughly stated and many<\/p>\n<p> .  times according to the movement of the sun in the sky.<\/p>\n<p>What the trial Court has forgotten to consider is that by<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">16<\/span><\/p>\n<p>instead of sending him to prison now. Since  V.<\/p>\n<p><a href=\"\/doc\/1569253\/\" id=\"a_3\">IPC<\/a> provides for alternate sentence of imp\ufb01so.nm;e-zitt&#8217;x <\/p>\n<p>fine, In our view, it would be just and broper to jAirnpo$e:&#8217;\u00ab&#8217;a <\/p>\n<p>fine of Rs.10,000\/-, in default totum-gos,,x_ rdg&#8217;e n~<\/p>\n<p>months. Exercising the jurfsd~\u00e9:&#8217;ction &#8216;&#8221;3V&#8217;57<br \/>\n<a href=\"\/doc\/445276\/\" id=\"a_4\">Cr.P.C<\/a>. we direct that if the  isahdepos\u00e9ted or<br \/>\nrecovered, the same shahhlhth be &#8216;pve;:d::V PW.3 as<br \/>\ncompensation.  \u00abAepea!
