NO. 4879 OF 2007\n            = = = = = = = = = = = = = = =\n       Dated this the 25th day of February, 2009.\n\n                      J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      This writ petition is filed for a direction to the 5th<\/p>\n<p>respondent to investigate Crime No.124\/00 in the Feroke<\/p>\n<p>Police Station. The gist of the case is that one Jayakumar,<\/p>\n<p>son of Appukutty aged 39 years was found hanging on a<\/p>\n<p>plastic rope in the upstairs of his bed room. His wife and<\/p>\n<p>aunt and others rushed him to TMH Hospital, Kadalundi and<\/p>\n<p>later to Medical College Hospital, Calicut but he was declared<\/p>\n<p>dead. Jayakumar&#8217;s wife&#8217;s uncle N.R. Sekharan lodged a<\/p>\n<p>complaint before the Feroke Police Station which was<\/p>\n<p>registered under the caption of unnatural death.      Autopsy<\/p>\n<p>was conducted on the body of the deceased. Initially 18<\/p>\n<p>witnesses were questioned. Their statements were recorded.<\/p>\n<p>A final report was filed opining that the death was due to<\/p>\n<p>hanging. In the meanwhile the petitioner herein filed a writ<\/p>\n<p>petition before the High Court and this Court handed over<\/p>\n<p>W.P.C 4879 OF 2007<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                -:2:-<\/span><\/p>\n<p>the investigation to the Crime Branch and accordingly the<\/p>\n<p>Superintendent of Police Crime Branch had taken over the<\/p>\n<p>investigation.   From his report it can be seen that he had<\/p>\n<p>examined as many as 37 witnesses and had given a brief<\/p>\n<p>description of what all the witnesses had stated. He had also<\/p>\n<p>pointed out important materials and had arrived at a decision<\/p>\n<p>that it is a case of suicide and further stated that there was<\/p>\n<p>no abetment to commit suicide and therefore ruled out the<\/p>\n<p>possibility of any homicidal death.       He had specifically<\/p>\n<p>referred to the evidence of CW17, Sindhu and had also<\/p>\n<p>discussed in detail regarding the absence of abetment or<\/p>\n<p>instigation to commit suicide. Though an attempt was made<\/p>\n<p>with reference to a property dispute there was nothing to link<\/p>\n<p>the same. The Superintendent of Police also even doubted<\/p>\n<p>the manner in which the investigation is conducted by the<\/p>\n<p>Sub Inspectors of Police for the reason that they did not<\/p>\n<p>question the psychiatrist who treated the deceased before his<\/p>\n<p>death.    The investigation also revealed that there was an<\/p>\n<p>earlier occasion when the deceased had taken excessive<\/p>\n<p>W.P.C 4879 OF 2007<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 -:3:-<\/span><\/p>\n<p>sleeping pills and he was admitted in the hospital. Ultimately<\/p>\n<p>Superintendent of Police completed the investigation and<\/p>\n<p>submitted a final report which was approved by the Addl.<\/p>\n<p>Director General of Police(Crimes) and a final report was<\/p>\n<p>submitted before the Executive Magistrate, Kozhikode on<\/p>\n<p>9.5.2006. The statement filed by the Superintendent of<\/p>\n<p>Police shows that all particulars of possible evidence has<\/p>\n<p>been looked into and a decision has been arrived at that it is<\/p>\n<p>a case of suicide and not homicide and there is nothing<\/p>\n<p>further to reveal that there was an abetment to commit<\/p>\n<p>suicide. From these materials I do not find any ground to<\/p>\n<p>entertain this writ petition and therefore it is dismissed.<\/p>\n<p id=\"p_1\">                             M.N.
