Mali as respondents<br \/>\nnos. 4 &amp; 5 respectively. Notice returnable on 7th<br \/>\nApril, 1998. If the respondent no. 3 passes an order adverse to the<br \/>\nDeesa Municipality the same shall not be implemented for a period of<br \/>\none week from the date of communication. Direct Service is permitted.<br \/>\nTo be heard with Spl. C.A. No. 1939\/1998.&#8221;\n<\/p>\n<p id=\"p_2\">2.\t\tThis Court in Special<br \/>\nCivil Application No. 1939 of 1998 had passed the following order :-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>       &#8221;\tThe  petitioners,  two  residents  of Deesa, have<br \/>\n      filed this petition for challenging the grant of land  in<br \/>\n      Deesa  town  for the purpose of construction of town hall<br \/>\n      and library by the Deesa Municipality.  The  said  action<br \/>\n      is  being  challenged  on  the  ground  that  the land in<br \/>\n      question was meant to be a playground for  children  and,<br \/>\n      therefore, the Municipality be restrained from putting up<br \/>\n      any construction thereon.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>      2.\tIn response to the notice issued by  this  Court,<br \/>\n      affidavit  in  reply is filed by the Chief Officer, Deesa<br \/>\n      Municipality pointing out that the petitioners have  made<br \/>\n      various  incorrect  statements  and  the  petition is not<br \/>\n      filed bona  fide.    It  is  specifically   stated   that<br \/>\n      petitioner No.    1  is publishing a weekly newspaper and<br \/>\n      since the Municipality is not  giving  advertisements  in<br \/>\n      the  same,  in  order  to pressurize the Municipality the<br \/>\n      present petition is filed.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>      3.\tOn merits, the affidavit in  reply  has  given  a<br \/>\n      detailed history  of  the  project  under challenge.  The<br \/>\n      land in question is shown in the development plan as land<br \/>\n      reserved for the purposes  of  the  Municipality  and  is<br \/>\n      placed in  the  Commercial  zone.    Earlier the land was<br \/>\n      granted by the Government to  the  Municipality  for  the<br \/>\n      purpose  of  garden  for  only  15  years  from 1968, but<br \/>\n      thereafter the grant was not renewed.    The  project  of<br \/>\n      construction  of a shopping centre was to be commenced in<br \/>\n      the year 1987 and the  Central  Government  sanctioned  a<br \/>\n      loan of  Rs.    50.38  Lacs  for the said project under a<br \/>\n      scheme called  &#8220;Integrated  Developmental  of  Small  and<br \/>\n      Medium Towns&#8221;.    The project was for the construction of<br \/>\n      shops.  Even in the year 1993, the land in  question  was<br \/>\n      ordered to be granted to the Municipality for the purpose<br \/>\n      of  constructing  a shopping centre, but the Municipality<br \/>\n      could not make arrangements  at  that  time  to  pay  the<br \/>\n      purchase price   to   the  Government.    Therefore,  the<br \/>\n      Government had on 3.1.1996 decided to  auction  the  land<br \/>\n      for  the  commercial  purpose,  but  on  account  of  the<br \/>\n      consistent demand of the  Municipality  for  constructing<br \/>\n      town  hall and public library from the funds which may be<br \/>\n      obtained out of auction  of  the  shops,  the  Government<br \/>\n      decided   on   10.10.1997   to  grant  the  land  to  the<br \/>\n      Municipality to construct the shopping centre.  The price<br \/>\n      was fixed at Rs.  18,43,846\/-.  Upon payment of the  said<br \/>\n      price  to  the  Government  by  9.12.1997, the Government<br \/>\n      issued the order granting the land to the Municipality on<br \/>\n      13.12.1997.  It is pointed out that  since  the  land  in<br \/>\n      question  is  in  commercial zone, after getting grant of<br \/>\n      the land from the Government, the  Town  Development  and<br \/>\n      Town  Planning  Committee  of the Municipality sanctioned<br \/>\n      the building plans.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>      4.\tAt the hearing of the petition, Mr Mehul  Rathod,<br \/>\n      learned  counsel  appearing  for  Deesa  Municipality has<br \/>\n      stated that recently the Municipality  put  the  property<br \/>\n      constructed  on  one  floor  to  public auction which has<br \/>\n      fetched a sum exceeding Rs.  1 Crore and it is  submitted<br \/>\n      that the Deesa Municipality has been acting bona fide and<br \/>\n      in  public interest and any interference by this Court at<br \/>\n      this stage would destroy  the  entire  project  which  is<br \/>\n      ultimately going to benefit the people of Deesa at large.<br \/>\n      Mr  Rathod  has  further  stated  that in the Development<br \/>\n      Plant, the land is not reserved for the purposes  of  the<br \/>\n      garden  or  playground  and that there are other lands in<br \/>\n      the development plan which are reserved for the  purposes<br \/>\n      of  garden\/playground which are not going to be disturbed<br \/>\n      by the  Municipality.    However,  the  petitioners  have<br \/>\n      approached  this  Court  without  making  any  bona  fide<br \/>\n      inquiries on these lines, but have  come  forward  making<br \/>\n      rackless   allegations   against   the  Municipality  and<br \/>\n      respondent Nos.  4 and 5.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>      5.\tHaving heard the learned counsel for the parties,<br \/>\n      this Court is of  the  view  that  the  aforesaid  public<br \/>\n      project  of  construction  of  a  town  hall and a public<br \/>\n      library and construction of shops for getting  funds  for<br \/>\n      the  aforesaid  project and for augmenting public revenue<br \/>\n      does not call for any interference  and that  too  at<br \/>\n      the  instance of the persons whose bona fides are under a<br \/>\n      serious cloud.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>      6.\tThis  petition  under  Articles  226 &amp; 227 of the<br \/>\n      Constitution is, therefore, summarily dismissed.   Notice<br \/>\n      is discharged.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>      7.\tIn the facts and circumstances of the  case,  the<br \/>\n      petitioners are  directed  to  pay  respondent  No.   1 &#8211;<br \/>\n      Municipality costs of this petition which are  quantified<br \/>\n      at Rs.  5,000\/- (Rupees five thousand only).&#8221;\n<\/p><\/blockquote>\n<p id=\"p_3\">3.\t\tIn view of the aforesaid order, this petition also stands disposed of on the same line.  However, Ms. Renu Chaudhary, learned counsel appearing for respondent No.5 states that respondent no. 5 has expired in the year 2005.  Hence, petition qua respondent no. 5 stands abated. Rule is discharged.
