( Oral )<\/p>\n<p>            The petitioners have filed this petition under Articles 226\/227<\/p>\n<p>of the Constitution of India, for directing the official respondents to declare<\/p>\n<p>petitioner No.4 as an elected Sarpanch of Gram Panchayat, Village Lahori<\/p>\n<p>Mal, Khatera, Tehsil and District Amritsar.\n<\/p>\n<p id=\"p_1\">            During the course of arguments, learned counsel for the<\/p>\n<p>petitioners states at bar that now, respondent No.5 has been illegally<\/p>\n<p>declared elected as Sarpanch, in spite of the fact that the petitioners were in<\/p>\n<p>majority.\n<\/p>\n<p id=\"p_2\">            In this petition, the disputed questions of facts have been<\/p>\n<p>raised, which cannot be gone into in the writ jurisdiction of this Court. This<\/p>\n<p>Court in Baljit Singh v. State of Punjab and others (CWP No. 13643 of<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> CWP No. 13654 of 2008                                                -2-<\/span><\/p>\n<p>2008, decided on August 22, 2008), has held that in view of Clause (b) of<\/p>\n<p><a href=\"\/doc\/718864\/\" id=\"a_1\">Article 243-O<\/a> of the Constitution of India and Section 76 of the Punjab<\/p>\n<p>State Election Act, 1994 (hereinafter referred to as `the Act&#8217;), election of<\/p>\n<p>Sarpanch is to be challenged by filing an election petition under section 76<\/p>\n<p>on the grounds mentioned in Section 89 of the Act. In the facts and<\/p>\n<p>circumstances of the case, no exceptional case is made out to invoke the<\/p>\n<p>extra ordinary powers of this Court under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of<\/p>\n<p>India for setting aside the election of Sarpanch. Thus, we do not find any<\/p>\n<p>ground to entertain this petition.\n<\/p>\n<p id=\"p_3\">             Dismissed.\n<\/p>\n<p id=\"p_4\">             However, it will be open for the petitioners to avail the remedy<\/p>\n<p>of election petition under section 76 read with section 89 of the Act.
