{"id":253637,"date":"2011-05-12T00:00:00","date_gmt":"2011-05-11T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/appearance-vs-mr-rc-kodekar-on-12-may-2011"},"modified":"2019-02-06T18:32:31","modified_gmt":"2019-02-06T13:02:31","slug":"appearance-vs-mr-rc-kodekar-on-12-may-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/appearance-vs-mr-rc-kodekar-on-12-may-2011","title":{"rendered":"Appearance : vs Mr Rc Kodekar on 12 May, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Gujarat High Court<\/div>\n<div class=\"doc_title\">Appearance : vs Mr Rc Kodekar on 12 May, 2011<\/div>\n<div class=\"doc_author\">Author: J.B.Pardiwala,&amp;Nbsp;<\/div>\n<pre id=\"pre_1\">   Gujarat High Court Case Information System \n\n  \n  \n    \n\n \n \n    \t      \n         \n\t    \n\t\t   Print\n\t\t\t\t          \n\n  \n\n\n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t\n\n\n \n\n\n\t \n\nCR.MA\/6160\/2011\t 4\/ 4\tORDER \n \n \n\n\t\n\n \n\nIN\nTHE HIGH COURT OF GUJARAT AT AHMEDABAD\n \n\n \n\n\n \n\nCRIMINAL\nMISC.APPLICATION No. 6160 of 2011\n \n\n \n=================================================\n\n\n \n\nSANJAY\nCHINTAMANI MISHRA \n\n \n\nVersus\n \n\nSTATE\nOF GUJARAT \n\n \n\n=================================================\n \nAppearance : \nMr\n ZUBIN F BHARDA for Applicant(s) : 1, \nMR RC KODEKAR, PUBLIC\nPROSECUTOR for Respondent(s) :\n1, \n================================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.B.PARDIWALA\n\t\t\n\t\n\n \n\nDate\n: 12\/05\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">\tRule.\n<\/p>\n<p id=\"p_1\"> Mr Kodekar, learned APP waives service of notice of Rule on behalf<br \/>\nof the State.\n<\/p>\n<p id=\"p_2\">\tThe<br \/>\napplicant prays for regular bail in connection with the offences<br \/>\nregistered with Bilimora Police Station, vide C.R.No.II 53 of 2010<br \/>\nfor the offences punishable under <a href=\"\/doc\/1011035\/\" id=\"a_1\">Sections 323<\/a>, <a href=\"\/doc\/538436\/\" id=\"a_1\">498A<\/a> and <a href=\"\/doc\/1560742\/\" id=\"a_2\">302<\/a> of the<br \/>\nIPC.\n<\/p>\n<p id=\"p_3\">\tI<br \/>\nhave heard learned advocate Mr Zubin Bharda for the applicant and Mr<br \/>\nRC Kodekar, learned Additional Public Prosecutor for the respondent &#8211;<br \/>\nState and perused the charge-sheet papers.\n<\/p>\n<p id=\"p_4\">\tPrima<br \/>\nfacie, it appears that there are inconsistent versions of the<br \/>\ndeceased as regards the incident in question at different intervals.<br \/>\nThe FIR dated 16th May 2010 lodged by the father of the<br \/>\ndeceased would suggest that when he reached the hospital after<br \/>\nlearning about the burn injuries sustained by his daughter  i.e. the<br \/>\ndeceased, he inquired with his daughter in the ICU as to what had<br \/>\nhappened, and, in reply to the same, deceased is said to have made an<br \/>\noral dying declaration that on the date of the incident there was a<br \/>\nquarrel between the applicant herein and the deceased as the<br \/>\naccused-applicant was not going for work for the past 17 days.<br \/>\nDeceased is said to have further stated before her father that as the<br \/>\nhusband was not going for work and there were monetary constraints in<br \/>\nthe family, she picked up a plastic bottle of kerosene, doused<br \/>\nherself and then, set herself on fire.  She has further stated in the<br \/>\noral dying declaration that no sooner she was on fire, she started<br \/>\nraising the shouts as a result of which accused-applicant immediately<br \/>\nrushed and extinguished the fire by pouring water on her.  This<br \/>\nversion of the deceased, first in point of time before her father in<br \/>\nthe form of oral dying declaration, would suggest that it was an<br \/>\nattempt to commit suicide.  Further, when the deceased was taken to<br \/>\nthe hospital, the history of the case, recorded by the Doctor speaks<br \/>\nabout accidental burns while cooking, as narrated by the deceased and<br \/>\nher relatives.  On 16th May 2010 Dying Declaration came to<br \/>\nbe recorded by the Executive Magistrate, Gandevi,  in which, in<br \/>\nanswer to question No.7 the deceased replied that on the date of the<br \/>\nincident at about 8.30 to 9.00 AM in the morning the husband asked<br \/>\nher for cup of tea.  At that point of time there was a quarrel and<br \/>\nher husband got excited and gave her a push as a result of which she<br \/>\nfell down on the cooking gas stove because of which she received burn<br \/>\ninjuries.  That immediately her husband poured water on her and her<br \/>\ninlaws came over there running.  In reply to question No.11 she<br \/>\nstated that nobody has done this act purposely or with any intention.<br \/>\n Husband loves her, but at times, such incidents of quarrel ensue<br \/>\nwhen he gets angry.\n<\/p>\n<p id=\"p_5\">\tIn<br \/>\nthe papers of the charge sheet the Investigating Agency has also<br \/>\nplaced a statement recorded of the accused-applicant herein in the<br \/>\nform of a Dying Declaration wherein, the accused-applicant has<br \/>\nexplained as to how the deceased had set herself on fire and as to<br \/>\nhow he extinguished the fire by pouring water.  It is only after a<br \/>\nperiod of almost 10 days that a second Dying Declaration came to be<br \/>\nrecorded by the Executive Magistrate, Surat wherein deceased stated<br \/>\nthat her husband poured kerosene on her body and set her on fire, on<br \/>\nthe basis of which the charge-sheet has been filed for offence of<br \/>\nmurder.\n<\/p>\n<p id=\"p_6\">\tPrima<br \/>\nfacie, it appears that the deceased has narrated different versions<br \/>\nat different intervals.  Prima facie, it appears to be a case of<br \/>\nsuicide.  It would be important to note that the accuse-applicant<br \/>\nherein has also sustained burn injuries at the time when he tried to<br \/>\nextinguish the fire on the body of his wife, that is, the deceased.<br \/>\nEven as per the case of the deceased herself, the husband used to<br \/>\nlove her and there was no such problem as such.  Taking into<br \/>\nconsideration different versions as narrated by the deceased, the<br \/>\noral dying declaration before the father, which was first in point of<br \/>\ntime, the history given before the Doctor and other circumstances, I<br \/>\nam persuaded to exercise my discretion in favour of the<br \/>\naccused-applicant.\n<\/p>\n<p id=\"p_7\">\tThe<br \/>\ninvestigation is over and the charge sheet is filed.\n<\/p>\n<p id=\"p_8\">\tThe<br \/>\ninterest of the prosecution can be protected by imposing certain<br \/>\nconditions.\n<\/p>\n<p id=\"p_9\">\tTaking<br \/>\ninto consideration the aforesaid prima facie aspects, I order release<br \/>\nof the accused-applicant on regular bail in<br \/>\nconnection with  offence registered with Bilimora Police Station,<br \/>\nbeing Crime Register No.II-53 of 2010 on his executing a bond in the<br \/>\nsum of Rs.25,000\/- (Rupees twenty five thousand only) with  one<br \/>\nsolvent surety of  the  like  amount  to  the  satisfaction  of  the<br \/>\nlower  Court  and  subject  to the  conditions that he shall,<\/p>\n<p> [a]\tnot take undue advantage of or misuse liberty;\n<\/p>\n<p id=\"p_10\">[b]\tmaintain<br \/>\nlaw and order and should co-operate with the investigating officer;\n<\/p>\n<p id=\"p_11\">[c]\tnot<br \/>\nact in a manner injurious to the interest of the \tprosecution;\n<\/p>\n<p id=\"p_12\">[d]\tsurrender<br \/>\nhis passport, if any, to the lower court<br \/>\nwithin a \tweek;\n<\/p>\n<p id=\"p_13\">[e]\tshall mark<br \/>\nhis presence before the concerned police station on 1st<br \/>\nand 4th Sunday between 10 AM and 5 PM;\n<\/p>\n<p id=\"p_14\">[f]\tnot leave<br \/>\nthe local limits of the State of Gujarat without prior permission of<br \/>\nthe Sessions Judge concerned;\n<\/p>\n<p id=\"p_15\">[g]\tshall not<br \/>\nenter not Surat City limits where his in-laws aer residing;\n<\/p>\n<p id=\"p_16\">[h]\tshall not<br \/>\napproach any of the family members of the deceased<\/p>\n<p>[i]\tfurnish the<br \/>\naddress of his residence at the time of execution of the bond and<br \/>\nshall not change the residence without prior permission of this<br \/>\nCourt.\n<\/p>\n<p id=\"p_17\">\tThe<br \/>\nauthorities will release the applicant only if he is not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p id=\"p_18\">\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant<br \/>\nor take appropriate action in the matter.\n<\/p>\n<p id=\"p_19\">\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case. This  application is allowed.\n<\/p>\n<p id=\"p_20\">\tRule<br \/>\nis made absolute. D.S.
