And Others\nPetitioner Counsel :- Deepak Kumar Singh\nRespondent Counsel :- C.S.C.,Anamika Singh\n\nHon'ble Sheo Kumar Singh,J.\n<\/pre>\n<p id=\"p_1\">Hon&#8217;ble Rajesh Chandra,J.\n<\/p>\n<p id=\"p_1\">Heard learned counsel for the petitioner, learned<br \/>\ncounsel who appears for the Bank and learned<br \/>\nStanding Counsel.\n<\/p>\n<p id=\"p_2\">Challenge in this petition is recovery proceeding by<br \/>\nwhich a particular amount is sought to be recovered<br \/>\nfrom the petitioner. Counsel for the petitioner has<br \/>\nmade statement at the bar that this is the first writ<br \/>\npetition against the recovery proceeding and this fact<br \/>\nhas also been stated in the writ petition. Submission is<br \/>\nthat if reasonable time is allowed to pay the amount<br \/>\nsought to be recovered, petitioner may be able to pay<br \/>\nthe same and irreparable injury on account of arrest<br \/>\nand auction of property may be avoided.<br \/>\nTo the aforesaid, learned counsel appearing for Bank<br \/>\nsubmits that intention of the respondent bank has<br \/>\nbeen never to cause any irreparable injury to the<br \/>\nloanee rather the loan amount was advanced with the<br \/>\npurpose to improve the petitioner&#8217;s future prospects<br \/>\nand thus if for justifiable reason the amount in terms<br \/>\nof the agreement has not been paid and now petitioner<br \/>\nhas bonafide intention to pay the amount within a<br \/>\nreasonable time then if that liberty is given, it will<br \/>\nserve the interest of both sides i.e. petitioner may be<br \/>\nsaved from the riggers of coercive process i.e. arrest,<br \/>\nauction of the properties and at the same time<br \/>\nrespondent bank will get its full amount with interest.<br \/>\nThus for grant of reasonable time, if that is to advance<br \/>\n justice, respondents may not have any objection.<br \/>\nIn view of aforesaid, this Court feels in the ends of<br \/>\njustice that amount sought to be recovered be<br \/>\npermitted to be deposited.\n<\/p>\n<p id=\"p_3\">Accordingly, this petition is disposed of with the<br \/>\nfollowing directions :\n<\/p>\n<p id=\"p_4\">i) Petitioner is to deposit an amount of Rs. 40,000\/-<br \/>\ndirectly in the concerned bank within a period of one<br \/>\nmonth from today to show bonafide on his part.\n<\/p>\n<p id=\"p_5\">ii) If petitioner deposits the above amount within the<br \/>\ntime so allowed then he is permitted to deposit the<br \/>\nremaining amount directly in concerned Bank in<br \/>\nthree quarterly instalments. In calculating the arrears<br \/>\nthe amount (if any) already paid will be adjusted.\n<\/p>\n<p id=\"p_6\">iii) The first installment may be deposited by 30th<br \/>\nNovember 2010, second instalment by 28th<br \/>\nFebruary, 2011, third by 31st May, 2011. These<br \/>\ndeposits may be made before the branch of the Bank<br \/>\nfrom where the loan was taken. In case instalments<br \/>\nare deposited in the Bank then only half of the<br \/>\nrecovery charges will be recovered from the<br \/>\npetitioner.\n<\/p>\n<p id=\"p_7\">iv) During period of deposit the recovery proceedings<br \/>\nwill be kept in abeyance. In case petitioners defaults<br \/>\nin depositing any of the instalments within the above<br \/>\nstipulated time, it will be open to the respondents to<br \/>\nstart recovery proceedings again by taking coercive<br \/>\nprocess at once.\n<\/p>\n<p id=\"p_8\">v) Petitioner may file an application for supply of<br \/>\nstatement of account alongwith duly stamped self<br \/>\naddressed envelope. In case any such application is<br \/>\nfiled, the concerned branch of the Bank will give the<br \/>\nsame to the petitioner after deposit of first instalment<br \/>\nwithin fifteen days.\n<\/p>\n<p id=\"p_9\"> vi) This order will not affect any auction if it has<br \/>\nalready taken place. In that event the petitioner may<br \/>\ntake appropriate legal proceedings to set aside the<br \/>\nauction under U.P.Z.A. &amp; L.R. Act and Rules ,1952<br \/>\nor file a suit in accordance with law.\n<\/p>\n<p id=\"p_10\">vii) It is clarified that this order will not be operative<br \/>\nand will not come in way of recovery process in any<br \/>\nmanner, if any other writ petition has been filed<br \/>\nbefore this Court against the recovery proceeding for<br \/>\nthe loan amount.\n<\/p>\n<p id=\"p_11\">viii) If any fact given from the side of the petitioners<br \/>\nare found to be incorrect by the bank authorities, it<br \/>\nwill be open for them to move an application for<br \/>\nmodification\/recall of the order.\n<\/p>\n<p id=\"p_12\">With the aforesaid direction, writ petition stands<br \/>\ndisposed of.\n<\/p>\n<p id=\"p_13\">Order Date :- 30.7.2010<br \/>\nM\/A.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Halim Khan vs State Of U.P.
