No.204\/2009, 205\/2009, a case<br \/>\nvide C.R.No. I &#8211; 243\/2009 u\/s.354 of <a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a> to an independent<br \/>\ninvestigating agency.\n<\/p>\n<p id=\"p_5\">(D)<br \/>\n This  Hon&#8217;ble Court be pleased to initiate inquiry against opponent<br \/>\nNos.3 and 4 for misconduct  and showing undue favours to opponent<br \/>\nNos.5 and 6 to an independent investigating agency.&#8221;\n<\/p>\n<p id=\"p_6\">3.\tIt<br \/>\nis submitted by party-in-person that aforesaid prayer (C)  is made in<br \/>\nreference to C.R.No.I &#8211; 243\/09 for the offence punishable under<br \/>\n<a href=\"\/doc\/203036\/\" id=\"a_2\">Section 354<\/a> of Indian Penal Code. It is also submitted by<br \/>\nparty-in-person that, as far as FIR in question is concerned, it is<br \/>\nnot correct in eye of law in terms of place, date,  time and<br \/>\nwitnesses and so it is required to be quashed.\n<\/p>\n<p id=\"p_7\">4.\tIt<br \/>\nis submitted by learned APP Mr.L.R.Pujari, on instructions, that as<br \/>\nfar as C.R.No.I &#8211; 243\/09 is concerned, in this case chargesheet<br \/>\nis already filed.\n<\/p>\n<p id=\"p_8\">5.\tIn<br \/>\nview of the same, remedy is available to the petitioner to submit an<br \/>\napplication for discharge and\/or for dropping of proceedings  before<br \/>\nthe trial court under the provisions<a href=\"\/doc\/1569253\/\" id=\"a_3\"> of the Code<\/a> of Criminal<br \/>\nProcedure, and without availing this remedy the petitioner has<br \/>\nstraightway approached this Court.\n<\/p>\n<p id=\"p_9\">6.\tAs<br \/>\nobserved by this Court, when remedy is available to the petitioner to<br \/>\napproach the trial court as chargesheet is filed, and   if<br \/>\nsuch application is moved by the present petitioner before the trial<br \/>\nCourt,  then the trial court shall decide the same in  accordance<br \/>\nwith law and on its own merits after giving full opportunity of<br \/>\nhearing to the present petitioner.
