Rachh for the applicants claimants.\n<\/p>\n<p id=\"p_1\">Present<br \/>\n\tcivil application is filed with a prayer to disburse the amount in<br \/>\n\tfavour of the applicants. Copy of this application is served to<br \/>\n\tlearned advocate Mr.HM Bhagat as per the endorsement made on this<br \/>\n\tcivil application. Learned Advocate Mr. Rachh for the applicants<br \/>\n\talso submitted that the copy of this application has been served to<br \/>\n\tlearned advocate Mr. HM Bhagat but learned advocate Mr.HM Bhagat has<br \/>\n\tnot remained present before this court and, therefore, this court is<br \/>\n\tconsidering this application in absence of the learned advocate Mr.<br \/>\n\tHM Bhagat.\n<\/p>\n<p id=\"p_2\">On<br \/>\n\t9th August, 1995, following order was passed by this<br \/>\n\tcourt (Coram : Hon&#8217;ble Mr. Justice RA Mehta and Hon&#8217;ble Mr. CK<br \/>\n\tThakkar,JJ.) in Civil Application NO. 2649 to 2654 of 1995:\n<\/p>\n<p id=\"p_3\">?SInterim<br \/>\n\tstay as the amount is deposited by the appellant insurance company.<br \/>\n\tThe tribunal shall invest 80 per cent of the entire amount deposited<br \/>\n\tincluding costs and interest in long term fixed deposits so as to<br \/>\n\tcontinue at least till the disposal of the first appeal. The<br \/>\n\tremaining 20 per cent of the amount to be paid to the concerned<br \/>\n\tclaimants by account payee cheques in their names. Rule made<br \/>\n\tabsolute.??\n<\/p>\n<p id=\"p_4\">Accordingly,<br \/>\n\t20 % amount has been ordered to be paid to the claimants and 80 per<br \/>\n\tcent has been ordered to be invested till the disposal of the first<br \/>\n\tappeal and accordingly rule has been made absolute in each civil<br \/>\n\tapplication.\n<\/p>\n<p id=\"p_5\">In<br \/>\n\tview of this back ground, wife of the deceased has also expired<br \/>\n\tduring the pendency of appeal on 18.11.99. Now, these three<br \/>\n\tapplicants namely applicants no.2,3 and 4 are here who are married<br \/>\n\tdaughters of the deceased praying for disbursement of some amount in<br \/>\n\ttheir favour as they are the only legal heirs and representatives of<br \/>\n\tthe deceased and there is no other legal heirs and representatives<br \/>\n\tof the deceased except them in the family.\n<\/p>\n<p id=\"p_6\">Considering<br \/>\n\tthe facts that the accident occurred on 19th June, 1983<br \/>\n\tand award was made by the claims tribunal on 7th April,<br \/>\n\t1995 and deceased was aged 46 years at the time of accident and the<br \/>\n\tclaims tribunal awarded Rs.5,40,000.00 out of which only 20% has<br \/>\n\tbeen received by the claimants, it is directed to the claims<br \/>\n\ttribunal at Jamnagar to pay 10% amount to each applicant No.2,3 and<br \/>\n\t4 namely Sherebanu H. Sugarwala,Nishrin H. Sugarwala and Munira H.<br \/>\n\tSugarwala by account payee cheque in their name and favour, meaning<br \/>\n\tthereby, each applicant no.2,3 and 4 are entitled to get 10% amount<br \/>\n\teach which is to be disbursed by the claims tribunal Jamnagar by<br \/>\n\taccount payee cheque in their favour and rest of the amount is to be<br \/>\n\tinvested in any nationalized bank for a period of three years with<br \/>\n\tperiodical renewal in the name of the respondents claimants but FDRs<br \/>\n\tto remain in the custody of the Nazir of the claims tribunal<br \/>\n\tconcerned and the respondents claimants are entitled to have<br \/>\n\tproportionate periodical interest on such FDRs of the remaining<br \/>\n\tamount to be invested.\n<\/p>\n<p id=\"p_7\">In<br \/>\n\tview of these observations and directions, this civil application is<br \/>\n\tdisposed of with no order as to costs. It is necessary to be noted<br \/>\n\tthat this court has waited enough for learned advocate Mr.HM Bhagat<br \/>\n\tfor two occasions in first and second session but learned advocate<br \/>\n\tMr. Bhagar has not appeared before this court and no mention was<br \/>\n\tmade on his behalf before this court and, therefore, considering<br \/>\n\thard reality, this court has passed aforesaid order in absence of<br \/>\n\tlearned advocate Mr. HM Bhagat. Accordingly, this civil application<br \/>\n\tis disposed of.\n<\/p>\n<p id=\"p_8\">At<br \/>\n\tthis stage, it is submitted by the learned advocate Mr. Rachh that<br \/>\n\t20% amount which was ordered to be disbursed to the claimants as per<br \/>\n\tthe order referred to above dated 9th August, 1995 has<br \/>\n\tnot been paid to the claimants. If that be so, then, the claims<br \/>\n\ttribunal at Jamnagar shall have to verify the same and if the amount<br \/>\n\thas yet not been paid to the claimants, then, to pay the said 20 per<br \/>\n\tcent amount to the applicants by implementing order of this court<br \/>\n\tdated 9th August, 1995 amongst applicants equally by<br \/>\n\taccount payee cheque.\n<\/p>\n<p id=\"p_9\">With<br \/>\n\tthese observations and directions, this civil application is<br \/>\n\tdisposed of.
