No one<\/p>\n<p>                         appears for the State.\n<\/p>\n<p id=\"p_1\">                               The petitioners pray for anticipatory bail in a case<\/p>\n<p>                         under <a href=\"\/doc\/538436\/\" id=\"a_1\">Sections 498A<\/a>, <a href=\"\/doc\/1011035\/\" id=\"a_1\">323<\/a>, <a href=\"\/doc\/180217\/\" id=\"a_2\">506<\/a>, <a href=\"\/doc\/1944660\/\" id=\"a_3\">384<\/a>\/<a href=\"\/doc\/37788\/\" id=\"a_4\">34<\/a> of the Indian Penal<\/p>\n<p>                         Code and <a href=\"\/doc\/751411\/\" id=\"a_5\">Sections 3<\/a>\/ <a href=\"\/doc\/1023340\/\" id=\"a_6\">4<\/a> of the Dowry Prohibition Act.<\/p>\n<p id=\"p_2\">                               Learned counsel for the petitioners submits that the<\/p>\n<p>                         allegations made in the FIR so far as these petitioners are<\/p>\n<p>                         concerned are omnibus in nature regarding demand of<\/p>\n<p>                         Rs.20,000\/- and gold chain as dowry. It is submitted that in<\/p>\n<p>                         the FIR itself it is clearly stated that the marriage had taken<\/p>\n<p>                         place 9 to 10 years earlier. The petitioner No.1 is the<\/p>\n<p>                         father-in-law, petitioner No.2 is the mother-in-law,<\/p>\n<p>                         petitioner No.3 is the husband&#8217;s elder brother and<\/p>\n<p>                         petitioner No.4 is the wife of petitioner No.3 and after so<\/p>\n<p>                         many years of marriage there could be no question of their<\/p>\n<p>                         demanding or being beneficiaries of any demand of dowry.<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                         2<\/span><\/p>\n<p>        It is further submitted that earlier a complaint case had<\/p>\n<p>        been filed by the informant which was ultimately<\/p>\n<p>        compromised. Learned counsel also points out that there is<\/p>\n<p>        allegation of severe assault and beating of the informant<\/p>\n<p>        but there is no injury report to corroborate the same. It is<\/p>\n<p>        also submitted that the FIR itself has been lodged 18 days<\/p>\n<p>        after the alleged occurrence of marpit.<\/p>\n<p id=\"p_3\">              On a consideration of the entire facts and<\/p>\n<p>        circumstances, it is directed that the petitioners, namely,<\/p>\n<p>        Chandeshwar Mistry, Baso Devi @ Raj Banshi Devi,<\/p>\n<p>        Sheopujan Mistry and Malti Devi, in the event of their<\/p>\n<p>        arrest\/surrender within a period of four weeks from today,<\/p>\n<p>        shall be released on bail on furnishing bail bonds of<\/p>\n<p>        Rs.10,000\/- (Rupees ten thousand) each with two sureties<\/p>\n<p>        of the like amount each to the satisfaction of the Chief<\/p>\n<p>        Judicial Magistrate, Aurangabad, in connection with Amba<\/p>\n<p>        P.S.Case No. 83\/2010, subject to the other conditions as<\/p>\n<p>        laid down under <a href=\"\/doc\/1692057\/\" id=\"a_7\">Section 438(2)<\/a> of the Code of Criminal<\/p>\n<p>        Procedure.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">                                  (Ramesh Kumar Datta,J.)<\/p>\n<p>Spal\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Chandeshwar Mistry And Ors. vs The State Of Bihar And Anr on 26 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
