The Chief Medical Officer of Crpf, Composite Hospital\n               Group Kendra, Muzaffarpur\n\n                               ----------------------------------\n<\/pre>\n<p id=\"p_1\">03.   03.11.2011             Heard learned counsel for the petitioner.\n<\/p>\n<p id=\"p_1\">                             Nobody     has    appeared      on     behalf   of<\/p>\n<p>                   respondents.\n<\/p>\n<p id=\"p_2\">                             On 16.09.2011 this Court passed the<\/p>\n<p>                   following order:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>                                       &#8220;Learned counsel for the<br \/>\n                             petitioner and learned Assistant<br \/>\n                             Solicitor General for the respondent<br \/>\n                             Union and its official are present.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>                                       Learned counsel for the<br \/>\n                             petitioner seeks permission of this<br \/>\n                             Court to delete the averments made<br \/>\n                             in paragraph no.14 of the writ<br \/>\n                             petition.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>                                       Permission is accorded.<br \/>\n                                       Let the petitioner score off<br \/>\n                             paragraph in its entirety in course of<br \/>\n                             the day.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>                                       The    grievance     of   the<br \/>\n                             petitioner can be seen from averments<br \/>\n                             made in paragraph Nos. 10 and 11<br \/>\n                             which read as under:-\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>                                       &#8220;10. That, in pursuance his<br \/>\n                             aforesaid application petitioner was<br \/>\n                             called vide letter dated 11.5.2011<br \/>\n<span class=\"hidden_text\" id=\"span_1\">         2<\/span><\/p>\n<p>issued by Respondent No.3 for re-\n<\/p><\/blockquote>\n<p id=\"p_3\">medical examination on 25.05.2011<br \/>\nat the Composite Hospital CRPF,<br \/>\nMuzaffarpur, Bihar on 25.05.2011<br \/>\nwith all the requisites and Medical<br \/>\ncertificates and accordingly the<br \/>\npetitioner appeared on the aforesaid<br \/>\ndate at the aforesaid venue, but as a<br \/>\nmatter of fact nothing was done, no<br \/>\nresponse was taken and verbally he<br \/>\nwas told that he is medically unfit,<br \/>\nbut, no any document to the aforesaid<br \/>\neffect was given to the petitioner and<br \/>\nthe petitioner was returned empty<br \/>\nhanded.\n<\/p>\n<p id=\"p_4\">           11. That thereafter, became<br \/>\nhighly     perturbed    and    gave    a<br \/>\nrepresentation to respondent no.3 on<br \/>\n25.05.2011      stating   therein    the<br \/>\naforesaid fact that as to how nothing<br \/>\nwas done by the Review Medical<br \/>\nBoard and he requested for doing his<br \/>\nMedical Test again so that he may get<br \/>\njustice and may be able to serve the<br \/>\nnation.&#8221;\n<\/p>\n<p id=\"p_5\">           Learned counsel for the<br \/>\npetitioner states that in the facts akin<br \/>\nto the present case, this Court<br \/>\ndisposed of one writ petition being<br \/>\nC.W.J.C. No. 12642 of 2011 by order<br \/>\ndated 4.8.2011. The said order is part<br \/>\nof Annexure-6 series. It is contended<br \/>\nthat the present application may also<br \/>\nbe disposed of in the aforesaid terms.\n<\/p>\n<p id=\"p_6\">           Learned counsel for the<br \/>\nrespondent Union prays for and is<br \/>\ngranted four weeks&#8217; time to take<br \/>\ninstruction and file counter affidavit,<br \/>\nif any.\n<\/p>\n<p id=\"p_7\">           Post this matter after six<br \/>\nweeks as last zero item. It is made<br \/>\nclear that if no counter affidavit is<br \/>\nfiled, this Court shall proceed to<br \/>\ndispose      of   the    writ   petition<br \/>\nconsidering the averments made<br \/>\ntherein and the stand taken by the<br \/>\npetitioner.&#8221;\n<\/p>\n<p id=\"p_8\">It is the grievance of the petitioner that he<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                     3<\/span><\/p>\n<p>filed Appeal for subjecting him to review Medical<\/p>\n<p>Board and accordingly he was directed to appear<\/p>\n<p>with all requisite papers\/documents on 25.05.2011.\n<\/p>\n<p id=\"p_9\">Petitioner did appear before the respondent, but<\/p>\n<p>thereafter nothing was done inasmuch as the<\/p>\n<p>respondents have not made any correspondence<\/p>\n<p>with the petitioner. It is contended that a detailed<\/p>\n<p>representation in this regard has already been<\/p>\n<p>preferred before the Deputy Inspector General of<\/p>\n<p>Police, Group Kendra, Central Reserve Police Force,<\/p>\n<p>Muzaffarpur (respondent no.3). It is contended<\/p>\n<p>relying on an order of this Court passed in C.W.J.C.\n<\/p>\n<p id=\"p_10\">No. 12642 of 2011 (part of Annexure-6 series) that<\/p>\n<p>the   application       be    disposed       of    directing    the<\/p>\n<p>respondent    to     consider        and     dispose       of   the<\/p>\n<p>representation in accordance with law within a time<\/p>\n<p>frame.\n<\/p>\n<p id=\"p_11\">          Having heard learned counsel for the<\/p>\n<p>petitioner and on going through the pleadings on<\/p>\n<p>records, this Court is satisfied that the application<\/p>\n<p>be disposed of by the following orders.\n<\/p>\n<p id=\"p_12\">          Let petitioner file a fresh and detailed<\/p>\n<p>representation      in       this   regard        before   Deputy<\/p>\n<p>Inspector General of Police, Group Kendra, Central<\/p>\n<p>Reserve Police Force, Muzaffarpur (respondent no.3)<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                         4<\/span><\/p>\n<p>       within a period of three weeks from today along with<\/p>\n<p>       a copy of the present order, whereafter the said<\/p>\n<p>       representation shall be considered and disposed off<\/p>\n<p>       in accordance with law by a reasoned order under<\/p>\n<p>       intimation to the petitioner within a maximum<\/p>\n<p>       period   of   four   weeks    from   the    date   of<\/p>\n<p>       receipt\/production of the representation.\n<\/p>\n<p id=\"p_13\">                                    (Kishore K.
