Shukla,J.\n<\/pre>\n<p id=\"p_1\">Heard learned counsel for the applicant and Sri G.S. Hajela, learned counsel<br \/>\nfor the respondent.\n<\/p>\n<p id=\"p_1\"> The first bail application of the applicant was rejected by this Court on<br \/>\n17.9.2009. It is submitted by learned counsel for the applicant that in<br \/>\nparagraph 5 of the charge sheet filed along with Ist bail application, it is<br \/>\nspecifically mentioned that the applicant&#8217;s company has fulfilled its export<br \/>\nobligation 34.93 % quantity wise and value wise 63.70% and it has been<br \/>\nfound that the forged shipping bills attributed to Vipul Shah and Abdul<br \/>\nQayyum alias Bababhai and Vipul Shah was acting as Agent of the applicant&#8217;s<br \/>\ncompany. It is further submitted that in paragraph 13 of the counter affidavit,<br \/>\nthis fact has not been disputed. Lastly, it is submitted by learned counsel for<br \/>\nthe applicant that only case against the applicant is under <a href=\"\/doc\/1466184\/\" id=\"a_1\">section 471<\/a> IPC,<br \/>\nwhich is a bailable offence and the applicant is in Jail for about 4 months and<br \/>\nhe has suffered much.\n<\/p>\n<p id=\"p_2\">Learned counsel for the respondent Sri G.S.Hajela, appearing for the<br \/>\nC.B.I.has submitted that the bail application of Vipul Shah was allowed on<br \/>\ndifferent ground and bail application of the applicant was rejected after<br \/>\nconsidering merit of the case. There is allegation against the applicant that he<br \/>\nhas submitted two forged shipping bills showing that goods mentioned herein<br \/>\nhave been exported but in reality, no export was made.<br \/>\nThe Civil Suit No. 242 of 2004 was filed in the Court of Civil Judge (Senior<br \/>\nDivision), Moradabad. The applicant&#8217;s company has fulfilled export<br \/>\nobligation 34.93% quantity wise and 63.70% value wise and agent of the<br \/>\ncompany has been allowed bail and that forged shipping bills were attributing<br \/>\nto Vipul Shah and Abdul Qayyub alias Bababhai and in the counter affidavit<br \/>\nthis fact has not been disputed.\n<\/p>\n<p id=\"p_3\">Considering the entire facts of the case and that the applicant is in jail for the<br \/>\nlast 4 months, the applicant is entitled to be released on bail.<br \/>\nLet the applicant Brahm Prakash Upadhyay involved in R.C. 3(E) \/<br \/>\n2006\/EOW-1, Case No. 2178 of 2008, under <a href=\"\/doc\/556166\/\" id=\"a_1\">sections 468<\/a>, <a href=\"\/doc\/1466184\/\" id=\"a_2\">471<\/a>, <a href=\"\/doc\/1436241\/\" id=\"a_3\">420<\/a>, <a href=\"\/doc\/1897847\/\" id=\"a_4\">120-B<\/a><br \/>\nIPC,P.S. CBI\/EOW-1\/DLI be released on bail on his executing a personal<br \/>\nbond and furnishing two sureties each in the like amount to the satisfaction of<br \/>\nthe court concerned subject to the following conditions:-1. The applicant shall<br \/>\nnot indulge in any such activity in future. 2. The applicant shall not<br \/>\npressurise\/intimidate the prosecution witnesses and evidence during trial.\n<\/p>\n<p id=\"p_4\">3.The applicant shall not leave the District\/country without permission of<br \/>\ncourt concerned and he shall submit his passport before the court concerned.<br \/>\nIn defiance of any of the aforesaid conditions, the court below will be at<br \/>\nliberty to cancel the bail of the applicant.
