By this petition, petitioner seeks quashing for FIR No. 662\/2001 dated 16.12.2001 under Sections 408, 420, 120-B, <a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a> registered at P.S. Connaught Place on the basis of agreement\/compromise arrived at between the petitioner and respondent No. 3.\n<\/p>\n<p id=\"p_2\"> 2. The petitioner was engaged in business dealing with respondent No. 3 since 1.4.1999 and the petitioner&#8217;s company has done business transaction of approximately Rs. 1 crore with respondent No. 3. Dispute arose between the petitioner and respondent No. 3 pertaining to the payment of 31 tickets which culminated in registration of FIR in question.\n<\/p>\n<p id=\"p_3\"> 3. In the meantime, since the matter related to a commercial transaction and with mutual understanding and negotiation the dispute between the petitioner and respondent No. 3 was amicably settled and an agreement\/compromise dated 31.7.2002 was signed by both the parties settling all the claims and differences.\n<\/p>\n<p id=\"p_4\"> 4. Affidavit has been filed by Shri Shyam Mansharamani, Manager of respondent No. 3, complainant, wherein it is stated that petitioner Mr. Arun Marwah has paid a sum of Rs. 3,66,000\/- settling the claim of Forvol against him. As per the affidavit it is agreed between the parties that the agreement shall not in any way affect or mitigate the alleged offence or reduced the gravity of offence against the other accused Mr. G.L. Prasad. It is prayed that complaint may be permitted to be withdrawn.\n<\/p>\n<p id=\"p_5\"> 5. Since the petitioner and respondent No. 3 have settled their disputes between them, we are of the opinion that it is a fit case where power under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of India should be exercised. We accordingly direct that FIR No. 662\/2001 under <a href=\"\/doc\/988620\/\" id=\"a_2\">Sections 406<\/a>\/<a href=\"\/doc\/1131784\/\" id=\"a_3\">408<\/a>\/<a href=\"\/doc\/1436241\/\" id=\"a_4\">420<\/a>\/<a href=\"\/doc\/1985627\/\" id=\"a_5\">467<\/a>\/<a href=\"\/doc\/556166\/\" id=\"a_6\">468<\/a>\/<a href=\"\/doc\/1466184\/\" id=\"a_7\">471<\/a>\/<a href=\"\/doc\/1897847\/\" id=\"a_8\">120-B<\/a>, <a href=\"\/doc\/1569253\/\" id=\"a_9\">IPC<\/a> registered with P.S.
