(ORAL)\n<\/pre>\n<p id=\"p_1\">            Challenge in the present Writ Petition is to the order dated<\/p>\n<p>14.12.1990 (Annexure P4), whereby penalty of stopping of one increment<\/p>\n<p>with cumulative effect was imposed upon petitioner. The appeal against the<\/p>\n<p>said order was dismissed vide order dated 08.01.1992 (Annexure P5).<\/p>\n<p id=\"p_1\">            The said order has been challenged on the ground that such<\/p>\n<p>punishment is a major penalty, but the same has been imposed by adopting<br \/>\n the procedure meant for minor penalty.\n<\/p>\n<p id=\"p_2\">            In reply, it was averred that stoppage of one increment with<\/p>\n<p>cumulative effect is a minor punishment in terms of Regulations 5 and 10 of<\/p>\n<p>the Punjab State Electricity Board Employees (Punishment and Appeal)<\/p>\n<p>Regulations 1971.\n<\/p>\n<p id=\"p_3\">            In Kulwant Singh Gill Vs. State of Punjab, 1991 Supp (1)<\/p>\n<p>SCC 504, the Hon&#8217;ble Supreme Court has held that the order imposing<\/p>\n<p>penalty of stoppage of increment with cumulative effect is a major<\/p>\n<p>punishment. It was held to the following effect:-<\/p>\n<blockquote id=\"blockquote_1\"><p>              &#8220;When penalty was imposed withholding two<br \/>\n              increments i.e. for two years with cumulative<br \/>\n              effect, it would indisputably mean that the two<br \/>\n              increments earned by the employee was cut off<br \/>\n              as a measure of penalty for ever in his upward<br \/>\n              march of earning higher scale of pay. The clock<br \/>\n              was put back to a lower stage in the time scale of<br \/>\n              pay and on expiry of two years the clock started<br \/>\n              working from that stage afresh. The insidious<br \/>\n              effect of the impugned order, by necessary<br \/>\n              implication, is that the appellant employee is<br \/>\n              reduced in his time scale by two places and it is<br \/>\n              in perpetuity during the rest of the tenure of his<br \/>\n              service with a direction that two years&#8217;<br \/>\n              increments would not be counted in his time<br \/>\n              scale of pay as a measure of penalty. The words<br \/>\n              are the skin to the language which if peeled off<br \/>\n              its true colour or its resultant effects would<br \/>\n              become apparent. When the problem is<br \/>\n              approached from this perspective the effect is as<br \/>\n              envisaged under R. 5(v). Rule 5(iv) does not<br \/>\n              empower the disciplinary authority to impose<br \/>\n              penalty of withholding increments of pay with<br \/>\n              cumulative effect except after holding inquiry<br \/>\n              and following the prescribed procedure. Then the<br \/>\n              order would be without jurisdiction or authority<br \/>\n              of law, and it would be per se void.&#8221;<\/p><\/blockquote>\n<p id=\"p_4\">\n<p id=\"p_5\">            In view of the above, the order passed by the respondents is<\/p>\n<p>void as it is not a minor penalty. Admittedly, due procedure for imposing<\/p>\n<p>major penalty was not followed.\n<\/p>\n<p id=\"p_6\">            In view of the above, the order dated 14.12.1990 and order<br \/>\n dated 08.01.1992 (Annexure P4 and Annexure P5) respectively are set-<\/p>\n<p>aside.\n<\/p>\n<p id=\"p_7\">             The Writ Petition is thus allowed with no order as to costs.<\/p>\n<pre id=\"pre_1\">\n\n\n\n                                                      (HEMANT GUPTA)\n10.03.2009                                                JUDGE\nAmodh\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court Shri Manohar Lal Sharma vs The Punjab State Electricity &#8230;
