Jha.\nFor the petitioner               : Shri Rajneesh Gupta, Advocate.\nFor the respondent no.2 : Shri Parag Chaturvedi, Advocate.\nFor respondent no.3              : Shri Anshuman Singh, Advocate.\n-------------------------------------------------------------------------------------------\n                                      ORDER\n<\/pre>\n<p id=\"p_1\">                                     (05\/10\/2010)<\/p>\n<p>        The petitioner has filed this petition being aggrieved by order<\/p>\n<p>dated 7.11.2007 passed by the Labour Commissioner, Madhya<\/p>\n<p>Pradesh Industrial Tribunal, Indore, whereby sanction has been<\/p>\n<p>granted for prosecution of the petitioner under the provisions of<\/p>\n<p>Section 29 read with <a href=\"\/doc\/1757864\/\" id=\"a_1\">Section 34<\/a> of the Industrial Disputes Act, 1947<\/p>\n<p>(hereinafter referred to as &#8216;the Act&#8217;).\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">2.      It is submitted by the learned counsel for the petitioner that<\/p>\n<p>initially certain awards were passed by the Labour Court on<\/p>\n<p>23.2.1988 and 29.4.1997, in the disputes raised by the Nagar Nigam<\/p>\n<p>Jal Praday Shramik Sangh Avam Lok Karm Vibhag, Shramik Sangh,<\/p>\n<p>Jabalpur, directing regularization of the employees of the Municipal<\/p>\n<p>Corporation. It is stated that these awards were not complied with<\/p>\n<p>and, therefore, the President of the Sangh again approached the<\/p>\n<p>Labour Court under <a href=\"\/doc\/1218044\/\" id=\"a_1\">section 10(1)(c)<\/a> of the Industrial Disputes Act,<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                    2                 W.P No.16859\/2007<\/span><\/p>\n<p>1947 and by award dated 23.11.2004 which was subsequently<\/p>\n<p>modified by order dated 6.4.2005 the Municipal Corporation,<\/p>\n<p>Jabalpur was directed to regularize the members of the petitioner&#8217;s<\/p>\n<p>Union.   As all the members of the petitioner&#8217;s Union were not<\/p>\n<p>recognized, the Sangh filed a petition and thereafter an application<\/p>\n<p>under <a href=\"\/doc\/226033\/\" id=\"a_2\">section 29<\/a> read with <a href=\"\/doc\/1757864\/\" id=\"a_3\">section 34<\/a> of the Act on 20.8.2007 before<\/p>\n<p>the Labour Commissioner, Indore seeking prosecution of as many<\/p>\n<p>as 8 previous Commissioners of Municipal Corporation, Jabalpur<\/p>\n<p>which application has been allowed by impugned order dated<\/p>\n<p>7.11.2007 directing initiation of prosecution of the petitioner who was<\/p>\n<p>the Commissioner of the Municipal Corporation, Jabalpur from<\/p>\n<p>September 2007 onwards for a period of five months.<\/p>\n<p id=\"p_3\">3.    It is submitted by the learned counsel for the petitioner that in<\/p>\n<p>the proceedings initiated by the Sangh the petitioner had neither<\/p>\n<p>been impleaded nor was he made a party. It is, however, submitted<\/p>\n<p>that he was, at the relevant point of time, Commissioner of the<\/p>\n<p>Municipal Corporation, Jabalpur and in that capacity accepted the<\/p>\n<p>notice issued by the Labour Commissioner though the Municipal<\/p>\n<p>Corporation, Jabalpur had also not been impleaded as a respondent<\/p>\n<p>in the application.   It is stated that in the year 2005 the State<\/p>\n<p>Government had imposed a total ban on regularization and that<\/p>\n<p>there were conflicting orders of the State Government regarding<\/p>\n<p>their policy for regularization and in such circumstances the<\/p>\n<p>petitioner, who was posted as Commissioner, Municipal Corporation,<\/p>\n<p>Jabalpur in the year 2007 could not have been directed to be<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                          3                 W.P No.16859\/2007<\/span><\/p>\n<p>prosecuted in view of the total ban on regularization imposed by the<\/p>\n<p>State.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">4.       The learned counsel for the petitioner has also pointed out<\/p>\n<p>that several employees of the Municipal Corporation, Jabalpur had<\/p>\n<p>approached this Court by filing petitions claiming relief of<\/p>\n<p>regularization which were disposed of by order dated 27.2.2003 with<\/p>\n<p>the following directions:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>                &#8220;(a) Respondent Corporation who has already<br \/>\n         prepared the seniority list of daily rated employees who<br \/>\n         are working prior to 31st December, 1988 will regularise<br \/>\n         the services of daily rate employees strictly as per their<br \/>\n         seniority and eligibility subject to availability of post.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>                (b)    The respondent Corporation has prepared<br \/>\n         aforesaid seniority list in two heads, technical and non-<br \/>\n         technical, will be at liberty to fill up the technical post on<br \/>\n         availability of technical post from daily rated worker who<br \/>\n         possesses requisite qualification. If the technical post is<br \/>\n         not available and the employee comes in the seniority<br \/>\n         criteria then respondent Corporation will be at liberty to<br \/>\n         regularise that person even on non-technical post, if<br \/>\n         such employee so chooses or opts such regularization.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>                (c)    So far as non-technical persons                are<br \/>\n         concerned, all the daily rated workmen will get their<br \/>\n         regularization as soon as the posts become available as<br \/>\n         per his seniority and eligibility.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>                (d)    This order will not effect those employees<br \/>\n         who have already been regularized because of the<br \/>\n         order passed by the High Court or by Labour Court and<br \/>\n         the aforesaid order has reached its finality. But so far<br \/>\n         as the other employees are concerned, their services<br \/>\n         will be regularized as per the direction issued today<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                       4                 W.P No.16859\/2007<\/span><\/p>\n<p>      including    those     whose     regularization   are    under<br \/>\n      challenge before this Court.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>             (e)    As the employees are to be regularized or<br \/>\n      classified on particular post on the availability of vacant<br \/>\n      post, as has been held in Full Bench decision by this<br \/>\n      Court in <a href=\"\/doc\/890601\/\" id=\"a_4\">Superintending Engineer vs. State of M.P.<br \/>\n      and others<\/a> (1999 (1) MPJR 1), in the circumstances, if<br \/>\n      any litigation in respect of employee who is working<br \/>\n      prior to 31.12.1988 or after 1.1.1989 respondent<br \/>\n      Corporation will place this order before the Labour<br \/>\n      Court in that case and labour courts will strictly follow<br \/>\n      the decision of Full Bench Judgment and directions<br \/>\n      issued today in this case.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>             (f)    In respect of those cases in which any<br \/>\n      junior person has been regularized ignoring seniority of<br \/>\n      other daily rated employees and if presently the order is<br \/>\n      under challenge before this Court, the aforesaid order of<br \/>\n      regularization by the labour court would stand modified,<br \/>\n      as per this order.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>             (g)    Those employees who are not satisfied<br \/>\n      with their seniority in the seniority list will file fresh<br \/>\n      representation before respondent Municipal Corporation<br \/>\n      within a period of sixty days from today and Municipal<br \/>\n      Corporation will decide the seniority of those unsatisfied<br \/>\n      employees within a period of ninety days thereafter.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_7\"><p>             (h)    So     far   as   the   regularization    of   the<br \/>\n      employees working prior to 31.12.1988 are concerned,<br \/>\n      the respondent will consider the cases for regularization<br \/>\n      as and when the posts are available strictly according to<br \/>\n      their seniority.\n<\/p><\/blockquote>\n<p id=\"p_6\">5.   As the aforesaid directions were not complied with Contempt<\/p>\n<p>Petition No.70\/2004 was filed which was also disposed of with a<\/p>\n<p>direction to the Commissioner, Municipal Corporation, Jabalpur to<br \/>\n<span class=\"hidden_text\" id=\"span_3\">                                    5                W.P No.16859\/2007<\/span><\/p>\n<p>complete the exercise of regularization within three months. The<\/p>\n<p>aforesaid orders, passed by the High Court including the one passed<\/p>\n<p>in the case of Om Prakash Dubey vs. R. K. Goyal, Contempt<\/p>\n<p>Petition No.70\/2002 decided on 18.8.2005, travelled to the Supreme<\/p>\n<p>Court and the Supreme Court in the case of <a href=\"\/doc\/1845696\/\" id=\"a_5\">Municipal<\/p>\n<p>Corporation, Jabalpur vs. Om Prakash Dubey<\/a>, 2007 (1) SCC<\/p>\n<p>373 set aside the impugned order passed by this Court in C.P<\/p>\n<p>No.70\/2004, Annexure P-4, dated 18.8.2005 with the following<\/p>\n<p>observations:-\n<\/p>\n<blockquote id=\"blockquote_8\"><p>            &#8220;20.   There is another aspect of the matter which<br \/>\n      cannot be lost sight of. The Corporation may be bound<br \/>\n      by the decision of the High Court, but it was also bound<br \/>\n      by the directions of the State of Madhya Pradesh. If it<br \/>\n      had violated the direction of the State (sic High Court),<br \/>\n      in terms whereof its earlier policy decision stood<br \/>\n      reversed, it cannot be said to have committed a<br \/>\n      contempt of court. The question recently came up for<br \/>\n      consideration in <a href=\"\/doc\/561234\/\" id=\"a_6\">State of Orissa v. Aswini Kumar Baliar<br \/>\n      Singh<\/a>, (2006) 6 SCC 759, wherein a Division Bench of<br \/>\n      this Court held that the Court is primarily concerned with<br \/>\n      the question of contumacious conduct of the party who<br \/>\n      is alleged to have committed default in complying with<br \/>\n      the directions in the judgment and order. It was held:<br \/>\n      (SCC p.763, para 11).\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_9\"><p>                   &#8220;11.   In the instant case, the action<br \/>\n            taken by the respondent in purported<br \/>\n            violation of the Court&#8217;s order arose owing to<br \/>\n            a subsequent cause of action, namely,<br \/>\n            orders passed by the State of Orissa and<br \/>\n            unless the said orders were set aside, the<br \/>\n            Inspector of Schools can (sic cannot) be<br \/>\n<span class=\"hidden_text\" id=\"span_4\">                                     6                 W.P No.16859\/2007<\/span><\/p>\n<p>              said to have flouted the order of the High<br \/>\n              Court.&#8221;&#8221;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_10\"><p>6.    It is further stated that the Corporation has taken a policy<\/p>\n<p>decision, in view of the subsequent circulars issued by the State<\/p>\n<p>Government in the year 2008, to constitute a Screening Committee<\/p>\n<p>and to consider the cases of all daily waged employees working in<\/p>\n<p>the Municipal Corporation, Jabalpur on the basis of the parameters<\/p>\n<p>and guidelines laid down therein and in case they are found to be<\/p>\n<p>eligible for regularization, to pass appropriate orders in their case. It<\/p>\n<p>is stated that the aforesaid exercise is in progress and, therefore, the<\/p>\n<p>impugned order passed by the Labour Commissioner initiating<\/p>\n<p>prosecution of the petitioner deserves to be quashed.\n<\/p><\/blockquote>\n<p id=\"p_7\">7.    The learned counsel appearing for the respondent no.2<\/p>\n<p>submits that the Sangh had obtained awards from the Labour Court<\/p>\n<p>and had thereafter approached this court by filing a petition seeking<\/p>\n<p>a direction against the Municipal Corporation, Jabalpur for<\/p>\n<p>implementing the award dated 23.11.2004 and 6.4.2005 which was<\/p>\n<p>registered as W.P No.1430\/2006 (S) and which was disposed of by<\/p>\n<p>order dated 30.7.2007 with liberty to the respondents to initiate<\/p>\n<p>proceedings under <a href=\"\/doc\/226033\/\" id=\"a_7\">section 29<\/a> read with <a href=\"\/doc\/1757864\/\" id=\"a_8\">section 34<\/a> of the Act. It is<\/p>\n<p>stated that in view of the aforesaid direction issued by this court, the<\/p>\n<p>petitioner had filed an application initiating prosecution of the<\/p>\n<p>petitioner which has been allowed by the impugned order dated<\/p>\n<p>7.11.2007 and in such circumstances no fault can be found with the<\/p>\n<p>impugned order directing initiation of prosecution against the<\/p>\n<p>petitioner.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_5\">                                     7                  W.P No.16859\/2007<\/span><\/p>\n<p id=\"p_8\">\n<p id=\"p_9\">8.    The    learned    counsel    appearing     for   the   respondent<\/p>\n<p>Corporation submits that the cases of the daily wage workers in the<\/p>\n<p>Corporation are being scrutinized as per the policy of the State<\/p>\n<p>Government which has been adopted by the Corporation and also in<\/p>\n<p>view of the judgment of the Supreme Court               in the case of<\/p>\n<p><a href=\"\/doc\/179794777\/\" id=\"a_9\">Secretary, State of Karnataka and Others vs. Umadevi<\/a> (3) and<\/p>\n<p>Others, (2006) 4 SCC 1. In such circumstances the respondent<\/p>\n<p>authorities are already taking steps permissible in law towards<\/p>\n<p>consideration of cases for regularization and orders in respect of as<\/p>\n<p>many as 150 persons have already been issued.\n<\/p>\n<p id=\"p_10\">\n<p id=\"p_11\">9.    I have heard the learned counsel for the parties at length.<\/p>\n<p>From a perusal of the averments and the documents on record it is<\/p>\n<p>clear that the petitioner had not been impleaded as a respondent in<\/p>\n<p>the application filed by the respondent Sangh for initiating<\/p>\n<p>proceedings for prosecution filed by them under <a href=\"\/doc\/226033\/\" id=\"a_10\">section 29<\/a> read with<\/p>\n<p><a href=\"\/doc\/1757864\/\" id=\"a_11\">section 34<\/a> of the Act. It is also clear that the petitioner had joined as<\/p>\n<p>Commissioner, Municipal Corporation, Jabalpur only in the year<\/p>\n<p>September 2007 by which time the State had already taken a policy<\/p>\n<p>decision imposing a total ban on regularization in the year 2005.<\/p>\n<p>The law as laid down by the Supreme Court in the case of Umadevi<\/p>\n<p>(supra) had also come into existence and the order passed by the<\/p>\n<p>Supreme court in the case of Municipal Commissioner, Jabalpur<\/p>\n<p>(supra) on 5.12.2006 had also come on record. From a perusal of<\/p>\n<p>the documents it is clear that the petition, W.P No.1430\/2006 (S)<\/p>\n<p>filed by the respondent Sangh and W.P No.1464\/2001 for<\/p>\n<p>implementation of the award passed by the Industrial Tribunal dated<br \/>\n<span class=\"hidden_text\" id=\"span_6\">                                      8                 W.P No.16859\/2007<\/span><\/p>\n<p>23.11.2004 and 6.4.2005 were disposed of by stating that no case<\/p>\n<p>for interference by this Court i.e. the High Court was made out with<\/p>\n<p>an observation that the petitioner may move the appropriate<\/p>\n<p>authority for initiating proceedings under <a href=\"\/doc\/226033\/\" id=\"a_12\">section 29<\/a> read with <a href=\"\/doc\/1757864\/\" id=\"a_13\">section<\/p>\n<p>34<\/a> of the Act.\n<\/p>\n<p id=\"p_12\">\n<p id=\"p_13\">10.   It is also undisputed and a fact agreed to by the learned<\/p>\n<p>counsel for the parties that the process for scrutiny of cases of<\/p>\n<p>regularization, in accordance with the direction issued by the<\/p>\n<p>Supreme Court in the case of Umadevi (supra) and the subsequent<\/p>\n<p>circulars issued by the State Government, has been undertaken by<\/p>\n<p>the Municipal Corporation, Jabalpur and eligible persons are being<\/p>\n<p>scrutinized and regularized by them.       It is infact stated that the<\/p>\n<p>process is going on.\n<\/p>\n<p id=\"p_14\">\n<p id=\"p_15\">11.   In view of the aforesaid facts and circumstances it is clear that<\/p>\n<p>the petitioner cannot be held responsible for non-implementation of<\/p>\n<p>the impugned award passed in favour of the respondent Sangh in<\/p>\n<p>the year 1988 or 1997 or in view of the orders passed by the<\/p>\n<p>Division Bench dated 23.11.2004 and 6.4.2005 as the petitioner had<\/p>\n<p>joined the Municipal Corporation, Jabalpur as Commissioner only in<\/p>\n<p>September 2007 and remained there only for five months. It is also<\/p>\n<p>clear in view of the observations made by the Supreme Court in the<\/p>\n<p>case of Om Prakash Dubey (supra) in para-20 that there were<\/p>\n<p>conflicting   orders   of   the   State   Government     and   in   such<\/p>\n<p>circumstances no person can be held to have committed contempt<\/p>\n<p>of Court that the petitioner cannot be prosecuted.<br \/>\n<span class=\"hidden_text\" id=\"span_7\">                                  9               W.P No.16859\/2007<\/span><\/p>\n<p id=\"p_16\">12.   In view of the aforesaid facts and circumstances, the order<\/p>\n<p>dated 7.11.2007 passed by the Labour Commissioner, Indore, is<\/p>\n<p>hereby quashed.      The petition, filed by the petitioner, stands<\/p>\n<p>allowed.\n<\/p>\n<p id=\"p_17\">\n<p id=\"p_18\">13.   In the facts and circumstances of the case there shall be no<br \/>\norder as to the costs.\n<\/p>\n<p id=\"p_19\">                                                ( R. S.
