PUBLIC PROSECUTOR for\nOpponent(s) : 1, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 23\/12\/2010\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">The<br \/>\n\tappellant has preferred the present appeal under <a href=\"\/doc\/1903086\/\" id=\"a_1\">Section 374<\/a> of the<br \/>\n\tCode of Criminal Procedure, 1973 against the judgment and order of<br \/>\n\tconviction and sentence dated 30th June 2008<br \/>\n\tpassed by the learned Special Judge in Special Case No.02 of 2008,<br \/>\n\twhereby the appellant has been held guilty for the offences<br \/>\n\tpunishable under <a href=\"\/doc\/1828439\/\" id=\"a_1\">Sections 4(1)(3)<\/a> of the Probation of Offenders Act.\n<\/p>\n<p id=\"p_1\">It<br \/>\n\tis the case of the prosecution that while the complainant was<br \/>\n\tpassing through the land of the appellant-accused in night hours, he<br \/>\n\thad been injured by the appellant-accused along with other persons<br \/>\n\twith wooden stick. It is also the case of the complainant that when<br \/>\n\tthe complainant was shouted, brother of the complainant along with<br \/>\n\tone other person arrived at the place of offence and saved the<br \/>\n\tcomplainant from the appellant-accused. Thereafter, seeing the crowd<br \/>\n\tgathering at the place of offence, the appellant-accused and others<br \/>\n\twere went away. Therefore, a complainant to the said effect was<br \/>\n\tfiled.\n<\/p>\n<p id=\"p_2\">After<br \/>\n\tfiling of closing pursis by the prosecution, further statement under<br \/>\n\t<a href=\"\/doc\/767287\/\" id=\"a_2\">Section 313<\/a> of the Code of Criminal Procedure, 1973 of the appellant<br \/>\n\twas recorded. The appellant has denied the case of the prosecution<br \/>\n\tand claimed to be tried.\n<\/p>\n<p id=\"p_3\">\tThereafter,<br \/>\n\ttrial was conducted before the learned Judge. To prove the case of<br \/>\n\tthe prosecution, prosecution has produced oral as well as<br \/>\n\tdocumentary evidence.\n<\/p>\n<p id=\"p_4\">After<br \/>\n\thearing both the sides, the learned Special Judge by his judgment<br \/>\n\tand order dated 25th<br \/>\n\tJune 2008 convicted the appellant-accused under <a href=\"\/doc\/1011035\/\" id=\"a_3\">Section 323<\/a> of the<br \/>\n\tIndian Penal Code. Thereafter, when the appellant-accused was asked<br \/>\n\tby the learned Judge about his sentence, the appellant-accused<br \/>\n\tconveyed that he was a government servant and he was at the fag end<br \/>\n\tof his retirement and therefore, the appellant-accused prayed to<br \/>\n\tgive benefit of Probation.\n<\/p>\n<p id=\"p_5\">Therefore,<br \/>\n\tProbation Officer&#8217;s Report was called for. Probation Officer also<br \/>\n\treiterated to give benefit under the provision of <a href=\"\/doc\/1828439\/\" id=\"a_4\">Section 4(1)<\/a> of<br \/>\n\tthe Probation of Offenders Act. Therefore, after going through the<br \/>\n\tReport of Probation Officer and as the appellant-accused was a<br \/>\n\tgovernment employee, by order dated 30th<br \/>\n\tJune 2008 the learned Special Judge, Panchmahal, Godhra,<br \/>\n\thas been pleased to give benefit under <a href=\"\/doc\/1828439\/\" id=\"a_5\">Section 4(1)(3)<\/a> of the<br \/>\n\tProbation of Offenders Act on the condition of a Character Bond in<br \/>\n\tthe sum of Rs.05,000\/- and a Personal Bond of the like amount<br \/>\n\tinstead of convicting the appellant-accused under <a href=\"\/doc\/1011035\/\" id=\"a_6\">Section 323<\/a> of the<br \/>\n\tIndian Penal Code.\n<\/p>\n<p id=\"p_6\">Being<br \/>\n\taggrieved by and dissatisfied with the said judgment and order of<br \/>\n\tconviction dated 30th<br \/>\n\tJune 2008 passed by the learned Special Judge, Panchmahal, Godhra in<br \/>\n\tSpecial Case No.02 of 2008, the appellant hereinabove has preferred<br \/>\n\tthe present Criminal Appeal before this Hon&#8217;ble Court.\n<\/p>\n<p id=\"p_7\">Heard<br \/>\n\tMr.A.Y. Kogje, learned counsel for the appellant and Ms.C.M. Shah,<br \/>\n\tlearned Additional Public Prosecutor, appearing on behalf of the<br \/>\n\trespondent-State.\n<\/p>\n<p id=\"p_8\">Mr.Kogje<br \/>\n\thas contended that the order passed by the learned Judge is bad in<br \/>\n\tlaw and the same is passed without appreciating the facts and<br \/>\n\tcircumstances of the case and evidence on record, provisions of law<br \/>\n\tand settled legal position. He has also contended that there are<br \/>\n\tmaterial omissions in the evidence of prosecution, which has been<br \/>\n\toverlooked by the learned Judge. He has also contended that case of<br \/>\n\tthe prosecution rests on the circumstantial evidence, but the<br \/>\n\tprosecution has also not conclusively proved the individual<br \/>\n\tcircumstances. He, therefore, contended that the order passed by the<br \/>\n\tlearned Judge is required to be quashed and set aside.\n<\/p>\n<p id=\"p_9\">I<br \/>\n\thave<br \/>\n\tgone through papers produced before me and the judgment and order<br \/>\n\tpassed by the learned trial Court. I have also perused the oral as<br \/>\n\twell as documentary evidence led before the trial Court and also<br \/>\n\tconsidered the submissions made by learned counsel for the parties.\n<\/p>\n<p id=\"p_10\">Looking<br \/>\n\tto the facts and circumstances of the case and looking to the<br \/>\n\tevidence on record, it appears that the appellant-accused choose<br \/>\n\t<a href=\"\/doc\/167447\/\" id=\"a_7\">Probation of Offenders Act<\/a> to come out from the conviction under<br \/>\n\t<a href=\"\/doc\/1011035\/\" id=\"a_8\">Section 323<\/a> of the Indian Penal Code and now by way of present<br \/>\n\tappeal, he is challenging the conviction order. Thus, when the<br \/>\n\tappellant has chosen provision of <a href=\"\/doc\/167447\/\" id=\"a_9\">Probation of Offenders Act<\/a>, I am<br \/>\n\tof the opinion that he has no right to challenge the order of<br \/>\n\tconviction.\n<\/p>\n<p id=\"p_11\">\tWhen<br \/>\n\tthis Court has made it clear that the present appeal is not tenable,<br \/>\n\tMr.Kogje, learned counsel for the appellant, after arguing the<br \/>\n\tmatter at length, seeks to withdraw the present appeal.\n<\/p>\n<p id=\"p_12\">\tIn<br \/>\n\tview of prayer prayed by Mr.Kogje, learned counsel for the<br \/>\n\tappellant, permission is granted. Hence, the present appeal is<br \/>\n\tdisposed of as withdrawn.
